ORDINANCE N0. 1646
AN ORDINANCE RECLASSIFYING CERTAIN PROPERTY LOCATED NORTH OF
STATE HIGHWAY 214 BY-PASS FROM RESIDENTIAL AGRICULTURE DISTRICT
(RA} TO COMMERCIAL OFFICE DISTRICT (CO); AND DECLARING AN EMERGENCY.
WHEREAS, Woodburn Zoning Ordinance and the Woodburn
Zoning Map made pursuant to said ordinance have heretofore established
certain use zones or districts within the City of Woodburn; and
WHEREAS, zone change proceedings have heretofore been had
before the Woodburn Planning Commission and the Common Council in
accordance with Chapter 16 of the Woodburn Zoning Ordinance; and
WHEREAS, the Common Council of the City of Woodburn deems
this reclassification to be in the public interest and to be in
satisfaction of a general public need; now, therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That the following described property within
the City of Woodburn, i~iarion County, State of Oregon, is hereby
reclassified from Residential Agriculture District (RA) to
Commercial Office District (CO):
Beginning at a point which is 2129.27 feet North 87° 25' West
from the Northeast corner of the B. F. Hall Donation Land
Claim No. 51 in Section 7, Township 5 South, Range 1 West,
Willamette Meridian, Marion County, Oregon; thence South 13°
32' S5" West 1117.06 feet to a point; thence North 88° 29'
10" West to a point on the East line of that parcel conveyed
to L. Simon on Reel 66, Page 1633; thence North 13° 32' 55"
East along the said Simon East line to the Northeast corner
thereof; thence West along the said Simon North line to the
East boundary of Boone's Ferry Road No. 69; thence North
along the said Boone's Ferry Road East line to the Southwest
corner of that parcel conveyed to A. H. Wellman and P. Wellman,
recorded in Deed Volume 526, Page 708; thence East along the
said Wellman South line 234 feet to the Southeast corner

thereof; thence North along the said Wellman East line 308.2
feet to the North line of the aforesaid B. F. Hall Donation
Land Claim; thence South 87° 25' East to the point of beginning.
SAVE AND EXCEPTING THEREFROM any part thereof lying within
the pub~.ic road and any portion conveyed to and by P7ilbro,
Inc., by Volume 713, Page 684, and Page 686, Deed Records
for Marion County, Oregon.
FURTHER EXCEPTING THEREFROM that portion of the above described
parcel of real property lying North of a line which line
bears South 86° 54' East from the Southeast corner of a
parcel of real property owned by A. B. Miller (Tax Lot 1739}
described in Volume 594, Page 737, Marion County Deed Records,
said line also being the Easterly extension of the Northerly
city limits line running to the Easterly boundary line of the
above described parcel.
ALSp,
Beginning at a point on the North line of the George Leasure
Donation Land Claim in Township 5 South, Range 1 West of the
Willamette Meridian in Marion County, Oregon, said point
being 2266.58 feet North 88° 30' West from the Northeast
corner of said Claim, and also the Southeast corner of a
tract of land conveyed to The First Presbyterian Church of
Woodburn, by deed recorded in Volume 543, Page 333; thence
South 88° 30' East along the North line of said Leasure Claim
1425.16 feet, more or less, to the Northeast corner of Third
Street in Tooze's First Addition to Woodburn, Marion County,
Oregon; thence North 13° 24' East parallel with the Easterly
line of the said Church tract 630.00 feet; thence North 88°
30' West parallel with the North line of said Leasure Claim
1425.16 feet, more or less, to a point on the Northerly
extension of the Easterly line of the said Church tract;
thence South 13° 24' West 630.00 feet to the point of beginning.
SAVING AND EXCEPTING THEREFROM any part hereof lying within
the relocated State Highway 214 and all of that portion
hereof lying South of said relocated State Highway 214.
Section 2. That the City Administrator is hereby
directed to correct the Woodburn Zoning Map to the reclassification
herein made.
Section 3. This ordinance being necessary for the
immediate preservation of the public peace, health and safety, an

emergency is declared to exist and this ordinance shall take
effect immediately upon passage by the Council and approval by
the Mayor.

Ordinance 1646 , one of which said copies posted in the
City Hall on the bulletin board adjacent to the entrance

Public Library bulletin board at 280 Garfield Street, in
full view of the traveling public; a third one of said
copies posted on the Community Center bulletin board at
