Ord 1647COUNCIL BILL N0. 469 ORDINANCE N0, 164? AN ORDINANCE AMENDING ORDINANCE N0. 1169, ADOPTING A HOUSING CODE, AND ORDINANCE No. 1344, A ZONING ORDI- NANCE. The people of the city of Woodburn do ordain: Section 1. Section 1 of Ordinance No. 1169 is amended to read: "Section 1. A certain book or publication, three copies of which are on file in the office of the city recorder marked and entitled "Uniform Building Code, Volume 3, Housing, 1976 Edition," published and copy- righted in 1976 by the International Conference of Building Officials, hereby is adapted in its entirety, except as hereinafter modified, as the housing code of the city of Woodburn for minimum requirements for the protection of life, limb, health, property, safety and welfare of the general public and the owners and occu- pants of residential buildings in the city of Woodburn; and all portions of said code on file in the office of the city recorder are hereby referred to, adopted and by this reference made a part of this ordinance as if fully set out herein, but excluding the provisions hereinafter mentioned. The additions, hereinafter made, and modifications of said code, hereinafter mentioned, shall constitute part of the housing code of the city of Woodburn." Section 2. Section 2 of Ordinance No. 1169 is amended to read: "Section 2. Section H.203 of the said Uniform Building Code, Volume 3, Housing, 1976 Edition, is not adopted as printed in said volume; but for the purposes of this ordinance, said section shall read as follows: 'Section H.203. In order to provide for reasonable interpretation of the provisions of this code, the board of examiners and appeals as appointed by the city building code, shall be the appeals board for this code.' The board shall adopt reasonable rules and regulations for conducting its investiga- tions and shall render all decisions and findings in writing to the building official with a duplicate copy to the appellant and may recommend to the common council such new regulations as are consistent there- with. If any member has a working interest in the matter before the appeal board, he may attend and take part in the discussion but will not be permitted to vote. The building official shall be an ex officio member and shall act as secretary of the board." Section 3. Anew Section 2A is added to Ordinance No. 1169 to read: "Section 2A, Section H,204 of the said Uniform Building Code, Volume 3, Housing, 1976 Edition, is not adopted as printed in said volume; but for the purposes of this ordinance, said section shall read as follows: 'Section H,204, A violation of any pro- vision of this code shall constitute a Class 1 city infraction and shall be dealt with according to the procedures established by Ordinance No. 1610 Civil Infractions} . "' Section 4. Section 3 of Ordinance NO, 1169 is amended to read: "Section 3. Section H.302 of the said Uniform Building Code, Volume 3, Housing, 1976 Edition, is not ,adopted as printed in said volume, but for the purposes of this ordinance, said section shall read and is adopted to read as follows: 'Section H,302. Wherever a building permit is required by Section.301 of this code, the appropriate fees shall be paid to the build- ing official as specified in the city building code."' Section 5, Anew Section 4A is added to Ordinance X10. 1169 to read: "Section 4A. Wherever in the said Uniform Building Code, Volume 3, Housing, 19x6 Edition, reference is made to "Uniform Building Code, 1967 Edition," it shall be read as "city building code as it is now or hereafter constituted," Section 6, Anew Section 4A is added to Ordinance No, 1344 to read: "Section 4A. Section 1.870 of the Woodburn zoning ordinance is amended to read as follows: 'Section 1,870. A violation of any provision of this ordinance shall constitute a Class 1 city infraction and shall be dealt with according to the procedures established by Ordi- nance No, 1610 Civil Infractions}. Page 2 tion will be deemed to occur on each calendar day that the infraction continues to exist, and a separate citation may be filed for each such infrac- t ion .
