ORDINANCE N0. 1649
AN ORDINANCE ESTABLISHING AN ALARr1 RESPONSE FEE; R~;PEALING
ORDINANCE NO. 1493; AND DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF ~~VOODBURN DO ORDAIN:
Section 1. Definitions. As used in this ordinance,
the following definitions shall apply.
(1} "Alarm" means any mechanical or electrical device or
assembly of equipment, designed or arranged to signal the
occurrence of an illegal entry or other activity requiring
urgent attention and to which the police are expected to respond.
{2) "Alarm user" means any person, firm, partnership
or corporation of any kind in control of any building, premises,
structure or facility upon which an alarm is maintained.
(3) "False alarm" means an alarm signal to which the
city police respond with any emergency service personnel or
equipment when a situation requiring a response by the police
does not in fact exist end which signal is caused by the
inadvertence, negligence, or intentional act or omission of
an alarm user, or a malfunction of the alarm. The following
shall not be considered false alarms:
(a} Alarms caused by the testing, repair or
malfunction of telephone equipment or lines.
{b} Alarms caused by an act of God, including
earthquakes, floods, windstorms, thunder or lightning.
(c} Alarms caused by an attempted illegal entry
of which there is visible evidence.
(d) Alarms caused by the testing, repair or
malfunction of electrical utility equipment or lines.
Section 2. Fees. Alarm users shall pay a fee for
each false alarm response by the city police during a calendar
year according to the following schedule:

First false alarm No fee
Second false alarm $ 6.00
Third false alarm $25.00
Fourth false alarm $50.00
Section 3. Disconnection for Fifth False Alarm
Response. When the city police are required to respond to a
fifth false alarm of any alarm user during a calendar year,
that alarm system will be disconnected from the monitor service
of the police department at the expense of user far the duration
of the calendar year.
Section 4. Failure to Pay False Alarm Fee. The

Director of Finance, or his designate, shall notify an alarm
user of any fee assessed according to the terms of this
ordinance. Failure of the alarm user to pay the fee within
30 days of the receipt of notice shall result in the monitor
service of -the alarm user being disconnected at the expense
of user for the duration of the calendar year.
Section 5. Repeal.
Ordinance No. 1493, enacted
October 27, 1975, is repealed.
Section 6. Emergency. This ordinance being necessary
for the immediate preservation of the public peace, health and
safety, an emergency is declared to exist and this ordinance
shall take effect immediately upon passage by the Council and
approval by the Mayor.

I, BARNEY 0. BURRIS, Recorder of the City of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance Pdo. 1649, one of which said copies posted in the
City Hall on the bulletin board adjacent to the entrance to
the Recorder's Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 28Q Garfield Street, in full view
of the traveling public; a third one of said copies posted
on the Community Center bulletin board at 491 N. Third 5t.,
in full view of the traveling public; that all of. said places
are public places within the corporate limits of the City
of Woodburn and all of said copies were posted on the
day of September 1978.
