Ord 1650COUNCIL BILL NO. 482 ORD IT~IANCE NO. 16 5 0 AN ORDINANCE AMENDING WOODBURN ZONING ORDINANCE, SECTION 2.010, RELATING TO NON-RESIDENT MEMBERSHIP ON THE PLANNING COt~.~~ISSION. THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That Section 2.010 of the Woodburn Zoning Ordinance as enacted by Ordinance No. 1344, dated March 26, 1973, and as subsequently amended, is hereby amended to read as follows: °'Section 2.010. Planning Commission. The Woodburn Planning Commission, as created by and organized pur- suant to Ordinance No. 939, is hereby recreated and continued. The Commission shall consist of a total of nine members to be appointed by the Mayor, with consent of a majority of the Common Council, all of whom shall be legal residents of the City, except two, each of whom may be a legal resident of the City, a non-resident residing within the Urban Growth Program Boundary to the City, or a non-resident who is a resident of the State of Oregon and is employed within the City or Urban Growth Program Boundary of the City of Woodburn. In no event shall there be more than one member of the Planning Commission who is a non-resident of the City of Woodburn or the area of its Urban Growth Program Boundary. The City Administrator of the City of Woodburn shall be a Member of the Commission, and shall serve as an ex-officio non-voting member with the power to constitute a part of the quorum as hereinafter provided and with authority to participate in all business of the Commission. The Commission shall have the powers and duties hereinafter set forth and such further and additional powers and duties as may be conferred upon it by the constitutions and laws of the United States and the State of Oregon, the Charter, Ordinances, and Resolutions of the City of ~~oodburn, and orders of the Common Council. The terms of office shall be four years, or until their successors are appointed and qualified, and their terms shall be staggered so that the term of office of not more than two members will expire in the same year. ?embers shall be appointed at the first regular meeting of the Common Council following the expiration of the term of a predecessor member and the terms of office shall expire at midnight on December 31. Page 1 - COUNCIL FILL N0. 482 ORDINANCE N0. 1650 The term of office of the ex-officio member of the Commission shall be for the term of office by virtue of which he was appointed to the Commission. Any vacancy in the Commission shall be filled by appointment made by the I~yayor with the consent of a majority of the Common Council for the unexpired portion of the term. ~~embers appointed by the ~~tayor to the Commission shall qualify by taking and subscribing an oath of office to uphold the Constitutions of the United States and of the State of Oregon and to faithfully and impartially perform the duties of the office to the best of their ability.
