AN ORDICVANCE RELATING TO THE IMPROVEMENT OF THE SEWAGE COLLECTION SYSTEM OF
THE CITY OF WOODBURfV BY CONSTRUCTIiVG AND LAYING A NEW 8" SANITARY SEWER LINE
ALONG A PORTION OF CLEVELAND STREET FROM A POIfdT 351 FEET EAST OF THE INTER-
SECTION OF CLEVELAND STREET AND MARSHALL STREET EASTWARD 1130 FEET TO A POINT
NEAR U. S. 99E (PACIFIC HIGHWAY) IN THE CITY OF WOODBURN; DIRECTING THE INVI-
TATIOf~ AND RECEIPT OF BIDS; PROVIDING FOR PAYMENT OF THE COSTS THEREOF BY
GENERAL OBLIGATION CONSTRUCTION WARRANTS; AND PROVIDING THAT THE COSTS THEREOF
SHALL BE ASSESSED TO THE PROPERTIES BENEFITED AND DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. The Common Council deems that the public health, interest
and convenience requires that the sewage collection system of the City of Wood-
burn be improved by constructing and laying a new 8 inch sanitary sewer line
with all necessary manholes, branches and other matters necessary for the proper
construction thereof, all in accordance with the plans, specifications and esti-
mates of the City Engineer therefor, which said plans, specifications and esti-
mates are now on file in the office of the City Recorder and which have heretofore
been du]y adopted by the Common Council and are made a part of this ordinance by
reference, pursuant to Resolution Na. 678 proposing such improvement.
Section 2. That the cost of said improvements shall be assessed against
the property specially and peculiarly benefited thereby, which is hereby declared
to be all of the lots, parts of lots and parcels of land except those which are
served or will be served by existing sewers lying within the following boundaries,
to-wit: Beginning at a point on the Southerly right-of-way of East Cleveland 100
feet S 60° 45' E of the North East corner of Lot E Hendrick's Addition; thence
Southwesterly along the Westerly line of that Tract described in Deed Vol. 571,
Page 317 and Deed vol. 692, Page 032, Tax Lot ?_451 to the ~dorth line of Lot 4,
Block 1, Cherry Orchard Heights; thence S 69° 25' 39" E to the most Northerly
Northeast corner of Lot 5, Block 1, Cherry Orchard Heights, thence S 20° 15' 31" lV
49 feet; thence S 68° 32` 13" E 111.96 feet; thence S 20° 42' 13" W 29.50 feet;

thence S 63° 58' 47" E 123,14 feet; thence N 22° 26' 07" E 13.27 feet; thence

Southwest corner of that tract recorded in Vol, 733, Page 173; thence S 60°

a Northeasterly direction along the Easterly line of that tract recorded in
Vol. 733, Page 173, 260 feet more or less to the Southwesterly corner of that
tract described in Vol. 224, Page 379; thence South Easterly 103.5 feet more
or less to the South Easterly corner of said tract; thence N 32° 15' E 281,5
feet more or less to the Southerly right-of-way of Cleveland Street;
Thence S 60° 45' E 174.9 feet to the ~dorth Westerly corner of that
tract recorded in Vol, 730, Page 677; thence S 32° 19' W 130 feet more or less;
thence S 60° 45' E 197,14 feet; thence S 32° 19' W 20 feet; thence S 60°
45` E 66 feet; thence PJ 32° 19' W 20 feet; thence S 60° 45' E 66 feet; thence
S 32° 19' W 210 feet; thence S 60° 45' E 66 feet; thence N 32° 19' E 230 feet;
thence S 60° 45' E 130 feet; thence S 32° 19' E 70 feet; thence S 60° 45' E
110 feet; thence N 32° 19` E 180 feet more or less to the South right-of-way of
Cleveland; thence fd 60° 45' W along the South right-of-gray of Cleveland Street
to the point of beginning,
Section 3, That the City Engineer's estimate of the probable total
cost of said improvement is the sum of X101,222.00. The portion of the total
estimated cost that would be assessed to the benefited properties is X81,644.00.
Section 4. That the City Recorder be and he is hereby directed to give
notice of and invite bids for the construction of said ~a~- in accordance with
the plans, specifications and estimates in the manner provided in the Charter of
the City of Woodburn and the laws of the State of Oregon.

Section 5. Bids for such improvement will be received by the City
in accordance with ORS Chapter 279 and Ordinance No. 1498 pertaining to the
Woodburn Contract Review Board and in accordance with its rules and regulations,
Section 6, That the Treasurer of the City of Woodburn is hereby
authorized and directed to issue to the contractor, and to others furnishing
services in connection with this improvement, general abligation improvement
warrants of the City of Woodburn in payment of completed work on this improve-
ment in accordance with the estimates of completed work furnished monthly by
the City Engineer of the City of Goodburn,
Section 7. That such warrants shall be a general obligation of the
City of Woodburn as provided in ORS 287,502 to ORS 287.510. The warrants shall
draw interest from the date of issue at the rate of lawful legal interest per
annum until called for payment. The warrants shall be callable as provided by
law and mature on or before two years after the date thereof. Interest shall
be paid annually if the warrant is presented to the City Treasurer for such
interest payment, otherwise the interest shall be paid at the time of redemption.
Section 8, This ordinance being necessary for the immediate preser-
vation of the public peace, health and safety, an emergency is declared to exist
and this ordinance shall take effect immediately upon passage by the Council and
approval by the Mayor.

a second one of said copies posted on the Woodburn Public
Library bulletin board at 28a Garfield St., in full view of
the traveling public; a third one of said copies posted on
the Community Center bulletin board at 491 N. Third St.,
