AN ORDINANCE PROPOSING A SPECIAL TAX LEVY QUTSLDE THE LIMITATION
IMPOSED BY ARTICLE XI, SECTION 11, SUBSECTfiON (_1) 0~ TH:~ OREGON
CONSTITUTION AGAINST THE TAXABLE PROPERTX IN T~iE CITY OF WOODBURN
IN AMOUNTS NOT EXCEEDING $69,158 FOR FIS-CAL YEAR 1979-80, $76,073
FOR FISCAL YEAR 1980-81, AND $83,681 FOR THE FISCAL YEAR 1981-82;
AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR STREET
LIGHTING PURPOSES; CALLING FOR A SPECIAL ELECTION AT U~i~CH SUCH SHALL
BE SUBMITTED TO THE LEGAL ELECTORS OF THE CITY OF WOODBURN; AND
DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That the Common Council of the City o~ Woodburn
hereby proposed a special three (.3) year serial tax levy outside the
limitation imposed by Article XI, Section 11, Subsection (1), upon
the taxable property within the corporate limits of the City of
Woodburn, not exceeding $69,158 for the fiscal year 1979-80, $76,073
for the fiscal year 1980-81, and $83,681 for the fiscal year 1981-82
for the purpose of providing funds for street lighting purposes within
the City of Woodburn.
Section 2. That the proposed three (3} year serial tax levy
shall be submitted to the legal electors of said city at a special
election, which is hereby called to be held therein, in accordance
with the laws of the State of Oregon and the Charter and Ordinances
of said city governing elections, May 22, 1979. Polls will be
open between the hours of 8:00 a.m. and 8:00 p.m. that date. The
election shall be held at the regular polling places for the general
primary election in each ward. The City Recorder is authorized and
directed to appoint such election board, counting board, and such
other clerks and officials as may be required for the proper conduct
of such election.

Section 3. The City Recorder shall post a typewritten notice
in each of the election preQincts of the City of woodburn and shall cause
notice of said election to be published for two consecutive weekly
publications in the City's official newspaper or in a newspaper of
general circulation, The first said publication being at least ten (10}
days prior to said election.
Section 4, That the form in which said question shall be
submitted to the electors of said city on the official ballot at such
special election shall be as follows:

THREE (3} YEAR STREET LIGHTING TAX LEVY`
PURPOSE: To authorize a three (3} year tax levy fox paying the
expenses of street lights in the City in amounts not
exceeding $69,158 for fiscal year 1979-80, $76,,073 far
the fiscal year 1980-81, and $83681 for the fiscal year
1981--82; (-for a total levy of $228, 912 for the three
years at an estimated rate of $.39 per $1,000 assessed
valuation) .
QUESTION: Shall the City of woodburn be authorized to levy a t~,x
over a three ~,3 ) year period ~ as~ provided in Ordinance
No. 1662 , to accomplish. the above purpose for the
reason that an increased tax levy is required to
adequately provide for street lighting needs in the
City of Woodburn?

Section 5. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is
declared to exist, and this ordinance shall take effect upon its
passage by the Council and approval by the Mayor.

I, BARNEY O. BURRI5, Recorder of the City of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance No. 1662, one of which said copies posted in the
City Hall on the bulletin board adjacent to the entrance to
the Recorder's- Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 280 Garfield St., in full view of
the traveling public; a third one of said copies posted on
the Community Center bulletin board at 491 N. Third St.,
in full view o~ the traveling public; that all of said
places are public places within the corporate limits of
the City of Woodburn and all of said copies were posted
on the17th day of April ~ , 1979.
