AN ORDINANCE CREATING A LIBRARY BOARD, DEFINING ITS DUTIES AND
PROVIDING THE METHODS FOR SELECTION AND TERMINATION OF A LIBRARY
DIRECTOR AND ASSISTANT LIBRARY DIRECTOR, AND DECLARING AN EC~ERGENCY.
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. Establishment. There shall be a Library
Board for the city library. The Board shall consist of five
members to be appointed by the Mayor by and with the consent
of the Common Council.
Section 2. Term. The term of the Library Board
members shall be three years, staggered so that the terms of
not more than two positions expire in the same year.
Section 3. Organization, The said Library Board
shall select a chairman, secretary, and such other officers as
the Board may deem appropriate and shall meet at such times as
the Library Board may determine. Officers shall have such duties
and authority as the Board shall establish, consistent with other
provisions of this ordinance and with law.
Section 4. Duties and Functions.
1. The Library Board, under supervision of the Common
Council, shall have charge of the operation of the city library
and of the expenditure of all library funds.
2. The Board shall have charge of the preparation and
submission of an annual budget and such other budgets as it may
deem appropriate or as the Common Council may require.

3. The Library Board shall have the responsibility
and authority for all aspects of the operation of the library
subject to the following:
(A} other provisions of this ordinance,
(B) other ordinances unless the library is
expressly exempted therefrom,
(C} purchasing procedures and all other admin-
istrative procedures applicable to the city as a whole implemented
by the Mayor and Common Council, or City Administrator,
(D} labor agreements covering library employees,
(E) labor negotiations authorized by the Common
Council,
(F) other provisions of applicable law.
Section 5. Rules and Regulations. The Library Board
shall have the power to make any reasonable rules and regulations
governing the use of the library facilities.
Section 6. Library Director (formerly called Librarian).
A Library Director shall be hired by the Board as a whole, with
the consent of the Common Council. The Library Director must
be a qualified librarian and shall be responsible to the Board
as a whole for the effective and efficient operation of the
library. The Library Director shall be responsible for hiring,
firing, and discipline of all library employees. The Library
Director shall assist the Board as requested and shall direct
the day-to-day operation of the library within such limitations
and requirements as the Board may direct. The Library Director

serves at the pleasure of the Library Board, except that, upon
notice of termination of employment or other discipline, the
Library Director may, within 30 days, appeal to the Common Council,
which may reinstate the Library Director or modify the Board's
action in any way it deems appropriate. The action of the Common
Council, or of the Board if its decision is not appealed within
30 days, is final and not subject to judicial review for alleged
defects in procedure or substance. The right of appeal does not
vest a property right.
section 7. Assistant Library Director. An Assistant
Library Director may be hired by the Library Director. The Assistant
Library Director shall have such responsibilities and authority
as the Library Director gives. The Assistant Library Director serves
at the pleasure of the Library Director, except that, the Assistant
Library Director may appeal any termination of employment or other
discipline to the Library Board. The Library Board's decision may
be, but is not required to be, reviewed, and reversed or modified,
by the Common Council in its discretion. The Common Council's
decision, or the Board's decision if it is not reversed or modified
by the Common Council, is final and not subject to judicial review
for alleged defects in procedure or substance The right of appeal
does not vest a property right.
Section 8. Camplaint~s. Complaints, grievances, and
personnel matters of library employees shall be handled according to:
(l~ applicable labor agreements, or
(2) city personnel rules as appropriate

Section 9. Budget Preparation. The Library Board may direct the
Library Director to prepare an annual budget or assist in preparation of
the budget. In any event, the budget must be prepared in consultation with
the Board and with the City Administrator. Once submitted to the City Budget
Committee, the budget will be subject to the same treatment and procedures
as any other departmental budget.
Section 10. Service of Board ~~iembers. Each member of the Library
Board serves at the pleasure of the Mayor and Common Council and may be
removed prior to expiration of their terms without cause or hearing.
Section 11. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is declared
to exist and this ordinance shall take effect immediately upon passage by
the Counci 1 and approval by the Pi~ayor.

I, BARNEY 0. BURRIS, Recorder of the City of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance No. 1664, one of which said copies posted in the
City Hall on the bulletin board adjacent to the entrance
to the Recorders Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 280 Garfield St., in full view of
the traveling public; a third one of said copies posted on
the Cotunity Centex bulletin board at 491 N. Third St.,
in full view of the traveling public; that all of said
places are public places within the corporate limits of
the City of [~oodburn and all of said copies were posted
