ORDINANCE N0. 1669
AN ORDINANCE REGULATING THE CONNECTION OF REAL PROPERTY TO PUBLIC STREETS AND
DRAINAGE FACILITIES; PROVTDTNG REQUIREMENTS AND FEES THEREFOR; AND DECLARING
AN EMERGENCY.
THE PEOPLE OF THE CITY OF C~OODBURN DO ORDAIN:
Section 1. That all applications for building permits, as required
by the building code of the City of Woodburn, or as required by the State
Building Code, should it at any time pre-empt the involvement of the building
code of the city, shall be accompanied by a separate application for permission
to connect real property to city streets and storm drainage facilities, and
that no building permit shall be issued by the city to any person until said
street and drainage facility application has been filed with and approved by
the City Engineer, and until a permit therefor has been issued by said City
Engineer, Said street and drainage permit shall be issued, conditioned only
upon payment of the fee required by Section 3 herein, and said fee shall be
returned to the applicant if no building permit is issued for the proposed
construction.
Section 2, That all persons proposing to construct a new structure,
or reconstruct, alter or repair an existing structure, who are or would be
exempt from building permit app]ica~i~on and approval requirements shall,
notwithstanding, be required to comply with the provisions of all sections
of this ordinance
Section 3. That a fee of said street and drainage facility permit
shall be paid to the City by each applicant therefor in accordance with the
following rate schedule, which fee shall be required to defray the costs of
regulating city street and drainage facility connections and of providing
said facilities:

(a} Single-Family Dwellings ................... $200.00
(b} Trailers, Mobile Homes and Mobile
Modular Dwelling Units .................. $200.00 Per Dwelling Unit
(c} Multiple-Family Dwellings and

(d} Motels and Hotels ......................... $150.00 Per Dwelling Unit

Section 4. That alterations to structures which do not increase the
floor space of said structure are exempt from the requirements provided herein;
and that additions to any structure or structures on property shall require a
permit and shall be assessed a fee therefor as provided in Section 3 (a} through
3 (e}. There shall be no fee for an addition to a dwelling unit when the
addition does not create another dwelling unit. No fee shall be charged for
wheel chair ramps at locations approved by the City Engineer.
Section 5. That all fees collected pursuant to the terms and provisions
of this ordinance shall be credited to and deposited in a fund which is hereby
created and which shall be used solely for engineering costs, capital improvement
expenditures in improving the arterial and collector street system and improving
the capacity Q~'the storm drainage system of the city, and capital expenditure
for the facilities used to maintain street and storm drain systems.
Secti:on 6. That the provisions of this ordinance shall in no way
suspends eliminate or supercede any ordinance requirements relating to public
facilities or the construction thereof, and that the fee required by Section 3
herein shall be separate from and in addition to any tax, fee, assessment or
charge otherwise required or provided by law.
Section 7. That the rates provided in Section 3 herein shall be
reyisewed annually by the Common Council , at which time said rates shal 1 be
revised to reflect changes in costs Qf construction occurring since the
preceding review.

Section 8. That the provisions of this ordinance shall apply only
to construction authorized by building permits issued or to be held after the
effective date of this ordinance.
Section 9. Ordinance Number 1394 is hereby repealed.
Section ]o. This ordinance being necessary for the immediate pre-
servation of the public peace, health and saftey, an emergency is declared to
exist and this ordinance shall take effect immediately upon passage by the
Council and approval by the Mayor.
