Ord 1680COUNCIL BILL N0. 529 ORDINANCE N0. 1680 AN ORDINANCE APPROVING THE OUTLINE PLAN OF THE SPRINGHAUEN PLANNED UNIT DEVELOPMENT AND PRESCRIBI~JG CO~dDTTIONS THEREOF. WHEREAS, Mike Sterrenberg has submitted a petition and an outline plan for approval of Springhaven Planned Unit Development, Staff File #79-2, in accordance with Chapter 14 of the Woodburn Zoning Ordinance, and WHEREAS, approval of said petition and outline plan was recommended by the ~loodburn Planning Commission with specifications, conditions, finding and conclusions, and a public hearing having been held by the Planning Commission, and ~~HEREAS, the Common Council finds that the proposed development is in the best interests of the health, safety, and general welfare of the people of the City of L~~oodburn, now, therefore THE PEOPLE OF THE CITY OF WOODBURN DO ORDAI~~: Section 1. That the outline plan of the Springhaven Planned Unit Development, Staff File #79-2, as presented by the petitioner under the pro- visions of Chapter 14 of the Woodburn Zoning Ordinance is hereby approved subject to the following conditions: (a) Park Avenue be improved through the entire width of the property by reconstructing the street out to the point the Public ~~~orks staff deems necessary. The City will agree to improve up to the half street front of the property which it owns, approximately the south 200 feet. (b) Side~valks shall also be installed on Park Avenue and Park Circle. They shall be one (1) foot from the property line. (c) All public services shall be on public right-of-way. Page 1 - COUNCIL BILL N0. 529 ORDINANCE ~~~0. 1580 ~d} The right-of-way required shall be 6o feet and a variance shall be granted for the 50 foot radius curves and 30 foot improvement. (e) The recreation area must be improved with the cost of at least $3,000 00, subject to approval by the Park and Recreation Board. The cost shall increase by the Consumer Price index for Portland from the date of the approval of the project. The play area shall be developed with low cost maintenance 1andscaping9 The detail plan submitted- for this project shall include the play area improvements ir, detail and cost estimates. ~f} Four percent ~4/) of the amount the petitioner paid for the land shall be contributed to the Woodburn Parks. Development and Acquisition Fund in lieu of land prior to final signature of the hardboard, fig) In addition to providing the parking required of the code, the petitioners provide 25 vn-street parking spaces Section 2.
