Ord 1697COUNCIL BILL NO. 554 ORDINANCE N0. 1697 AN ORDINANCE PROPOSING LEVIES OF TAXES OUTSIDE THE LIMITATION IMPOSED BY ARTICLE XI, SECTION 11, SUBSECTION (1) OF THE OREGON CONSTITUTION AGAINST THE TAXABLE PROPERTY IN THE CITY OF ~IOODBURN IN THE TOTAL AMOUNTS OF $304,541.00 FOR BALLOT A AND $599,022.00 FOR BALLOT B FOR THE FISCAL YEAR 1980-81; AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR THE BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 1980; CALLI~JG A SPECIAL ELECTION AT WHICH SUCH LEVY OF TAX SHALL BE SUBMITTED TO THE LEGAL ELECTORS OF THE CITY OF WOODBURN; AND DECLARING AN EMERGENCY. I~JHEREAS, the City of Woodburn proposes an annual budget for the operation of said City; and WHEREAS, the proposed budget for the fiscal year 1980-81 exceeds the limitation imposed by Article XI, Section 11, Subsection (1) of the Oregon Constitution; and ~~JHEREAS, the Common Council of the City of hoodburn deems that the proposed budget is necessary to provide City services to the residents and inhabitants of the Ci ty. of ~4Joodburn; and 4JHEREAS, Article XI, Section 11, Subsection (2)(b) of the Constitution of the State of Oregon provides that Article XI, Section 11, Subsection (1} of said Constitution shall not apply to that portion of any tax levied which is specifically voted outside the said limitation by a majority of the legal voters of the taxing unit voting on the question; now, therefore, THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That the Common Council of the City of l~Joodburn hereby proposes levies of taxes outside the limitation imposed by Article XI, Section 11, Subsection (1) of the Oregon Constitution in the total amounts of $304,547.00 for Ballot A and $599,022.00 for Ballot 6 for the fiscal year 1980-81 for the purpose of applying said sums to the budget for the fiscal year 1980-81. That the proposed levies of taxes shall be submitted to the legal electors of said City at a special election, which is hereby called to be held therein in accordance with the laws of the State of Oregon and the Charter and ordinances of said City governing elections, March 25, 1980. The City Recorder shall post a typewritten notice in each of the election precincts of the City of .Woodburn and shall cause notice of said election to be published for two consecutive weekly publications in the city official newspaper or in a newspaper of general circulation, the first said publication being at least 10 days prior to said election. Section 3. That the form in which said questions shall be submitted to the electors of said City on the official ballots at such special election shall be as follows: see attached Exhibit A and B) Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety, in order to meet the deadline requirement to get the measures on the official ballot, an emergency is declared to exist and this ordinance shall take effect. immediately upon passage by the Council and approval by the Mayor. PURPOSE: The chief purpose of this measure is to provide money to held the City of !"loodburn finance its operations for the fiscal year 1980-81. EXPLANATION: This is one of two tax levy measures before you today. The reason for this two-ballot vote is a new state law which limits the total amount of partial property tax relief to owner-occupied homes. This measure, known as Ballot A, represents only a portion of the taxes required to balance the proposed 1980-81 City budget. The balance is being submitted for your approva] on the Ballot "B" measure. In an overall view of the general fund, the Police and Fire f~epartments constitute 83/ of the total proposed expenditures. The remaining 17i includes the general fund's share of Administrative costs, matching funds for the Dial-A-Ride and Retired Senior volunteer Prt~grams, Municipal Court, City Hall Building Maintenance, Non-Departmental (Insurances, Auditing, Legal Publications, etc.) and Operating Contingency. The $304,547.00 tax levy on this measure will only finance 19/ of the city's general fund operations. If this measure is approved, $304,547.00 of the taxes levied will be financed partially by the State of Oregon. Exhibit B SPECIAL MUNICIPAL ELECTION CITY OF WOODBUR~J Marion County, Oregon March 25, 1980 Submitted to the Voters by the Common Council Measure No. 52 BALLOT "B" -- AUTHORIZATION FOR TAX LEVY FOR l~JOODBURN QUESTION: Shall City of ~Joodburn be authorized to levy $599,022.00 outside the tax base to partially finance city operations during 1980-81? PURPOSE: The chief purpose of this measure is to provide money over and above the amount requested in the Ballot "A" measure which is necessary to balance the proposed 1980-81 City budget. EXPLANATION: This is the second of the two tax levy measures, to be known as Ballot "B". This measure is in conjunction with Ballot "A" and is necessary to balance the proposed budget. The money requested in this measure will provide for the continuation of present services. Funds required to finance the following programs are: Main support of the Community Center General Fund services, as outlined in the Ballot "A" explanation Parks and Recreation Library personnel The main reasons for increase in this year`s tax levy are: 14.3% projected inflation rate Decrease in Federal Revenue Sharing $136,354 Decrease in cash carryover 119,983 Court and City Attorney requirements 3 Police cars (replacements) $ 61,980 ~k61,721 53,361 15,954 If this measure is approved, $599,022.00 of taxes levied will be totally financed by the local tax payers. without any partial state payment.
