AN ORDINANCE PROPOSING LEVIES OF TAXES OUTSIDE THE LIMITATION IMPOSED BY
ARTICLE XI, SECTION 11, SUBSECTION (1} OF THE OREGON CONSTITUTION AGAINST
THE TAXABLE PROPERTY IN THE CITY OF WOODBURN IN THE TOTAL AMOUNTS OF
$304,547.00 FOR BALLOT A AND $494,220.00 FOR BALLOT B FOR THE FISCAL YEAR
1980-81; AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR THE
BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 1980; CALLI~JG A SPECIAL ELECTION
AT WHICH SUCH LEVY OF TAX SHALL BE SUBMITTED TO THE LEGAL ELECTORS OF THE
CITY OF WOODBURN; AND DECLARING APB EMERGENCY.
WHEREAS, the City of Woodburn proposes an annual budget for the
operation of said City; and
WHEREAS, the proposed budget for the fiscal year 1980-81 exceeds
the limitation imposed by Article XI, Section 11, Subsection ~1) of the
Oregon Constitution; and
WHEREAS, the Common Council of the City of Woodburn deems that the
proposed budget is necessary to provide City services to tf~e residents and
inhabitants of the City of ti~loodburn; and
WHEREAS, Article XI, Section 11, Subsection ~2~(b} of the Constitution
of the State of Oregon provides that Article XI, Section 11, Subsection ~1~
of said Constitution shall not apply to that portion of any tax levied which
is specifically voted outside the said limitation 6y a majority of the legal
voters of the taxing unit voting on the question; now, therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN;
Section 1. That the Common Council of the City of l~loodburn hereby
proposes levies of taxes. outside the limitation imposed by Article XI, Section 11,
Subsection Ql) of the Oregon Constitution in the total amounts of $304,547.00
for Ballot A and $494,220.00 for Ballot B for the fiscal year 1980-81 for the
purpose of applying said sums to the budget for the fiscal year 198081.

Section 2. That the proposed levies of taxes shall be submitted to
the legal electors of said City at a special election, which is hereby called
to be held therein in accordance with the laws of the State of Oregon and the
Charter and ordinances of said City governing elections, June 24, 1980. The
City Recorder shall post a typewritten notice in each of the election precincts
of the City of Woodburn and shall cause notice of said election to be published
in the city official newspaper or in a newspaper of general circulation at
least 10 days prior to said election.
Section 3. That the form in which said questions shall be submitted
to the electors of said City on the official ballots at such special election
shall be as follows: see attached Exhibit A and B~
Section 4. This ordinance being necessary for the immediate preservation
of the public peace, health and safety, in order to meet the deadline requirement
to get the measures on the official ballot, an emergency is declared to exist
and this ordinance shall take effect immediately upon passage by the Council
and approval by the Mayor.

Measure No. 51
BALLOT "A" -- AUTHORIZATION FOR TAX LEVY FOR WOODBURN
QUESTION: Shall City of Woodburn be authorized to levy $304,547.00 outside
the tax base to partially finance city operations during 1980-81?
PURPOSE: The purpose of this tax measure is to provide funds above the City's
tax base which has been exceeded by vote of the people for the
last nine years. The present tax base is $91,302.00.
EXPLANATION: This is one of two tax levy measures before you today. The
reason for this two-measure ballot is the new State law creating the "A" and
"B" ballot measures which limits the total amount of partial property tax
relief to owner-occupied homes. This measure, known as Ballot "A", represents
oni a ortion of the taxes required for the City's General Fund budget of
1,461,944.00 of which $1,203,693.00 is for Police and Fire services.
The balance is for administrative costs, Municipal Court, City Attorney and
prosecutor, City Hall maintenance, Dia]-a-Ride and R.S.V.P. matching funds.
The additional amount of taxes necessary to support the current General Fund
services is being submitted for your approval on the Ballot "B" measure.
The $304,547.00 tax levy on this measure will finance Zl/ of the total
City's General Fund operations and nothing else.
If this measure is approved, $304,547.00 of the taxes levied will be
financed partially by the State of Oregon.

Measure No. 52
BALLOT "B" -- AUTHORIZATION FOR TAX LEVY FOR ~~JOODBURN
QUESTION: Shall City of ~~oodburn be authorized to levy $494,220.00 outside
the tax base to partially finance City services during 1980-81?
PURPOSE: The purpose of this measure is to provide the additional monies
along with the amount in the "A" Ballot to balance the 1980-81
proposed budget.
EXPLANATION: This is the second of the two tax levy measures to be known
as Ballot "B". This measure, in conjunction with Ballot "A", is necessary
to balance the proposed budget. The money in this measure will provide far
the continuation of present City services.

Some of the reasons for increase in this year's tax levy are:

financed by the local tax payers without any partial State payment.
