Ord 1732COUNCIL BILL NO. 604 ORDINANCE NO. 1732 AN ORDINANCE PROPOSING LEVIES OF TAXES OUTSIDE THE LIMITATION IMPOSED BY ARTICLE XI, SECTION 11, SUBSECTION (1) OF THE OREGON CONSTITUTION AGAINST THE TAXABLE PROPERTY IN THE CITY OF WOODBURN IN THE TOTAL AMOUNTS OF $4299757.00 FOR BALLOT A AND $526,947.00 FOR BALLOT B FOR THE FISCAL YEAR 1981-82; AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR THE BUDGET FOR THE FISCAL YEAR BEGINNING JULY 19 1981; CALLING A SPECIAL ELECTION AT WHICH SUCH LEVY OF TAX SHALL BE SUBMITTED TO THE LEGAL ELECTORS OF THE CITY OF WOODBURN; AND DECLARING AN EMERGENCY. WHEREAS, the total proposed budget amount for the fiscal year 1981-82 exceeds the limitation imposed by Article XI, Section 11, Subsection (1) of the Oregon Constitution; and WHEREAS, the Common Council of the City of Woodburn deems that a budget is necessary to provide City services to the residents and inhabitants of the City of Woodburn; and WHEREAS, Article XI, Section 11, Subsection (3)(b) of the Constitution of the State of Oregon provides that Article XI, Section 11, Subsection (1) of said Constitution shall not apply to that portion of any tax levied which is specifically voted outside the said limitation by a majority of the legal voters of the taxing unit voting on the question; now, therefore, THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That the Common Council of the City of Woodburn hereby proposes levies of taxes outside the limitation imposed by Article XI, Section 11, Subsection (1) of the Oregon Constitution in the total amounts of $429,757.00 for Ballot A and $526,947.00 for Ballot B for the fiscal year 1981-82 for the purpose of applying said sums to the budget for the fiscal year 1981-82. Section 2. That the proposed levies of taxes shall be submitted to the legal electors of said City at a special election, which is hereby called to be held therein in accordance with the laws of the State of Oregon and the Page 1 - COUNCIL BILL NO. 604 ORDINANCE NO. 1732 Charter and ordinances of said City governing elections, February 17, 1981. The City Recorder shall post a typewritten notice in each of the election precincts of the City of Woodburn and shall cause notice of said election to be published in the city official newspaper or in a newspaper of general circulation at least 10 days prior to said election. Section 3. That the form in which said questions shall be submitted to the electors of said City on the official ballots at such special election shall be as follows: (see attached Exhibit A and B) Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety, in order to meet the deadline requirement to get the measures on the official ballot, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the Council and approval by the Mayor. ALTER LAWS , Mayor January 12, 1981 January 12, 1981 January 13, 1981 January 13, 1981 Exhibit A SPECIAL MUNICIPAL ELECTION CITY OF WOODBURN Marion County, Oregon February 17, 1981 Submitted to the Voters by the Common Council Measure No. 51 BALLOT "A" AUTHORIZATION FOR TAX LEVY FOR WOODBURN QUESTION: Shall City of Woodburn be authorized to levy $429,757.00 outside the tax base to partially finance city operations during 1981-82? PURPOSE: The tax base for 1981-82 would fund less than 7% of the general fund budget for the current year. With inflation, the percentage would be even less for 1981-82. The purpose of this tax measure is to provide funds above the City's tax base. The present tax base is $96,780.00. EXPLANATION: This is one'of two tax levy measures before you today. The reason for this two -measure ballot is the State law creating the "A" and "B" ballot measures. The amounts requested by this measure, known as ballot "A", and the following measure, known as ballot "B" represent the total taxes required for the City's general fund budget over and above the current tax base. The total requested amount in this measure is for Police and Fire services, administrative costs,Municipal Court, City Attorney and prosecutor, City Hail maintenance, operation of Street Lights, Dial -a -Ride and R.S.V.P. matching funds. Ballot "A" represents only a portion of the taxes required for the City's general fund. The $429,757.00 tax levy on thin measure will finance approximately 26/ of the total General Fund operations, and nothing else. If this measure is approved, $429,757.00 of the taxes levied will be financed partially by the State of Oregon. VOTE -"YES" -OR "NO'" Mark a cross (X) ora check -mark (A/-) in the square of your choice Yes, I vote in favor of the tax levy No, I vote against the tax levy Exhibit B SPECIAL MUNICIPAL ELECTION CITY OF WOODBURN Marion County, Oregon February 17, 1981 Submitted to the Voters by the Common Council Measure No. 52 BALLOT "B" -- AUTHORIZATION FOR TAX LEVY FOR WOODBURN QUESTION: Shall City of Woodburn be authorized to levy $526,947.00 outside the tax base to partially finance City services during 1981-82? PURPOSE The purpose of this measure is to provide the additional monies along with the amount in the "A" ballot to balance the 1981-82 proposed budget. EXPLANATION: This is the second of the two tax levy measures to be known as the "B" ballot. This measure, in conjunction with ballot "A", is necessary to balance the proposed budget. The money in this measure will provide only for the continuation of present City services. It is estimated that the overall tax rate per $1,000 assessed valuation ($7.43) will remain the same as fiscal year 1980-81. The amount necessary to balance the General fund, in addition to that requested in Ballot "A", is $526,947.00. The reasons for increase in this year's levy are the projected inflation rate of at least 11% and the need to fund the street light system which was, until this year, funded by a special levy. If this measure is approved, $526,947.00 of taxes levied will be totally financed by the local taxpayers without any partial State payment.
