Ord 1746°~ COUNCIL BILL N0. 624 ORDINANCE N0. 1746 AN ORDINANCE PROPOSING A SPECIAL TAX LEVY OUTSIDE THE LIMITATION IMPOSED BY ARTICLE XI, SECTTON II, SUBSECTION (1} OF THE OREGON CONSTITUTION AGAINST TAXABLE PROPERTY IN THE CITY OF WOODBURN IPd AN AMOUNT NOT TO EXCEED $49,112 FOR FISCAL YEAR 1981-82; AUTHORIZIPJG THE EXPENDITURE OF MONIES DERIDED THEREFROM FOR OPERATIONS OF THE CITY BUS SERVICE; CALLING FORA SPECIAL ELECTION AT WHTCH SUCH SHALL BE SUBP~ITTED TO THE LEGAL ELECTORS OF THE CITY OF WDODBURN; AND DECLARING AN EMERGENCY. WHEREAS, the City Bus Service was started with Federal and State grant monies in 1978 without any local property tax support; and WHEREAS, most of the operating grants will expire this year; and WHEREAS, Article XI, Section 11, subsection (3} (b} of the Consti- tution of the State of Oregon provides that Article XI, Section 11, subsection (1} of said Constitution shall not apply to that portion of any tax levied which is specifically voted outside the said limitation by a majority of the legal voters of the taxing unit voting on the question, now, therefore, THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That the Common Council of the City of Woodburn hereby proposes a levy of taxes outside the limitation imposed by Article XI, Section 11, subsection (1} of the Oregon Constitution in the amount of $49,112.00 for the purpose of providing funds to help support the City Bus Service within the City of Woodburn for fiscal year 1981-82. Section 2. That the proposed levy of taxes shall be submitted to the legal electors of the City of Woodburn at a special election, which is hereby called to be held therein inaccordance with the Laws of the State of Oregon and the Charter and Ordinances of said City governing elections, May 19, 1981. Page 1 - COUNCIL BILL NO. 624 ORDINANCE N0. 1746 The City Recorder shall post a typewritten notice in each of the election precincts of the City of Woodburn and shall cause notice of said election to be published in the City official newspaper or in a newspaper of general circulation at least 10 days prior to said election. Section 3. That the form in which said question shall be sub- mitted to the electors of said City on the official ballot at such special election shall be as follows: see attached Exhibit A7. Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety, in order to meet the deadline requirement to get the measure on the official ballot, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the Council and approval of the Mayor. ~,~., APPROVED: ~a ~. QUESTIOPd: Shall City of ~~oodburn be authorized to levy $442,0]2 outside the tax base to partially finance City Services during 1981-82? PURPOSE: This tax levy measure provides the additional monies needed to balance the 1981-82 proposed City Budget. EXPLANATION: In addition to the "A" ballot measure approved by voters February 17, 1981, $442,012 more money is necessary to balance the proposed 1981-82 City Budget. This amount will be allocated as follows: General Fund Operations $355,809 Library Fund Operations 16,617 Park & Recreation Operations 37,107 Street Lights Operations 32,479 The overall tax rate for the current year is $7.43 per $1,000 assessed valuation. The estimated rate for the same level of City Services for fiscal year 1981-82 will be $7.03 x.40 cents per $1,000 less than the current year}. If this measure is approved, $442,012 of taxes levied will be totally financed by the local taxpayers without any partial State aayment. QUESTIO`d: Sha11 City establish the existing bus system as a tax supported service and authorize a $49,112 tax levy for 1981- 82 . PURPOSE: The City Council is proposing this measure to the voters to see if they are willing to support the current bus system by authorizing it as a tax support service, and proposing a $49,112 tax levy to support the same level of service as now provided by grants, Federal Revenue Sharing and Ceta Funds. EXPLANATION: The City bus service started in Apri], 1978 with funding from State and Federal grants. The bus has continued to operate with the aid of these grants, and transfers from Federal Revenue Sharing Funds, up to and through this fiscal year without any local tax support. However, most of the operating grants will expire this year. The City has applied for a grant to purchase anew bus for the system. The current bus will be held for backup puraoses. Therefore, with the expiration of most of the State and Federal aid, the bus program is on the ballot for the voters to decide if they want to support it with property taxes and authorize a $49,112 tax levy for 1981-82. It is estimated that the $49,112 levy would be $ .Z1 per $1,000 of assessed value.
