Ord 1748 COUNCIL BILL N0. 627 ORDINANCE N0. 1748 AN ORDINANCE RELATING TO SURCHARGES ON WATER FOR THE OPERATION AND MAINTENANCE OF MUNICIPAL SEWERAGE SYSTEMS; PROVIDTNG FOR SUCH SURCHARGES AND THE COLLECTION THEREOF; AND REPEALING ORDINANCE NO. 1691. THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That a surcharges as provided in this ordinance, shall be added to each municipal water bill or statement issued by the City of Woodburn for all monthly periods of water use and service received from the City beginning in July of 1981, and that such surcharge shall be collected from water users in the same manner and under the same provisions of law as other charges for water use and service. Such surcharge shall be levied against each water account, excepting those accounts providing only fire or irrigation service, whether or not the premises are actually connected to the sanitary sewerage system, if the property is located within I00 feet from an adequate sewer line. Alike surcharge shall be made to all premises within the city limits which are supplied with water from sources other than the city water system and to all premises outside the city which discharge to the city sewerage system. The minimum surcharge for each class as specified in the rates hereunder shall accrue for each and every month, regardless of turn-off of the water to the premises for non-payment or whatever other reason. Separate, additional charges shall be collected for "trailer-dump" stations and for discharge of septic tank pumpers, at designated locations. All rates and charges established herein are tabulated in Section 4 hereunder. Charges for premises outside the city limits shall be one-and-one half times the rates shown in Section 4. Abbreviations used herein are defined as follows: BOD = Bio-chemical oxygen demand Ccf = hundred cubic feet gal = gallon(s) lbs =pounds SS =suspended solids Section 3. The distinction between small and large industrial users shall be based on the following criteria: a. Flow, 0.75 million gal./month b. BOD, 1250 1bs/month c. SS, 1250 lbs/month If in any month a user exceeds all three of the above criteria, such user shall henceforth be charged the large industrial rate hereinafter specified. For any month in which a user exceeds any two of the above criteria, such user shall be charged the large industrial rate for that month. Industrial users may be required to install metering and sampling devices to monitor flow, BOD, suspended solids, and any other extra-strength factor, and to combine all effluent lines to a common point for such metering and sampling. The responsibility for proper monitoring and metering is that of the user, If any user shall fail to recognize this, the City may bill on an estimated basis. Section 4. That the monthly surcharges required by Section 1 of this ordinance shall be according to the following schedule: CUSTOMER CLASS Residential Apartments & Condos,per unit Commercial & Small Industrial[Per Ccf] Large Industrial - the sum of Flow[per million gal.] BOD [per thousand lbs.} 5S [per thousand lbs.] Trailer-dump station,per month [in addition to standard surcharge] Septage per truck load, based on truck capacity: First 500 gal. That the monies collected persuant to the provisions of this ordinance shall be used to pay the costs of construction, operation, maintenance and expansion of sanitary and storm sewers, sewage treatment plants, pumping stations, and related facilities and services, including administrative and engi- veering costs. Section 6. Interpretation and administration of this ordinance and its provisions shall be the responsibility of the City Engineer. Section 7. Unless sooner modified by action of the Common Council all rates and charges in Section 4 shall be automatically increased by approximately 5% effective with billings for service beginning during the month of January, 1982. It is intended that there be two increases of 5% per year thereafter. The provisions of this ordinance shall be reviewed annually by the Common Council. Section 8. If any clause, sentence, paragraph, section or portion of this ordinance for any reason shall be adjudged invalid by a court of competent jurisdiction, such judgement shall not affect, impair, or invalidate any of the remainder of this ordinance. Section 9. That Ordinance No. 1691 of the City of Woodburn is hereby repealed, and Ordinance No. 1686 is not revived. _, APPROVED: E.
