Ord 1749COUNCIL BILL N0. 628 ORDINANCE N0. 1749 AN ORDINANCE PRESCRIBING RATES TO BE CHARGED FOR USE OF CITY WATER, REPEALING SECTIONS 5, 10, 11 AND 12 OF ORDINANCE N0. 1622; AND DECLARING AN EMERGENCY. THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That the rates and charges for the supply and use of water from the water system and mains of the City of Woodburn shall be as follows: a. Additional water is sold at the established rate. b. Water consumed above minimum quantity allowed per month - $0.42 per 100 cubic feet. c. Multiple residential or commercial accounts - $3.70 per unit per month in establishing the minimum for each service. Quantity allowed shall be the number of units times 400 cubic feet, or the above-established quantity allowed for size of service, whichever is greater. d. Flat rate residential accounts existing at the date of this ordinance $5.60 per month. [Hardship cases may apply for and be granted a monthly charge of $4.00. Hardship may be established by submitting proof of $4,000.00 or less yearly income]. Page 1 - COUNCIL BILL N0. 628 ORDINANCE N0. I749 e. Fire sprinkler connections - $3.00 per diameter-inch per month. This charge shall be effegtive beginning with the service-month beginning in September, 1981. f. Turn-off and turn-on charges: (1) For turn-off and/or turn-on between 4 P,M, and 8 A.M. on Saturdays, Sundays, or holidays: $10.00. (2) For turn-off and turn-on for non-payment of water charges: $10.00. This charge, together with the account balance, in full, must be paid before the water may be turned on again.. g. Minimum monthly charge [flat rate, minimum metered, or fire] for each account shall accrue for each and every month, regardless of turn-off of the water to the premises for non-payment. h. Otherwise, deposit will be retained to cover cost of testing. i. Outside city limits: A factor of 1,5 shall be applied to alI rates and charges for services outside the City. Section 2, In case of leakage, an adjustment of billings may be provided if the leak has been proptly repaired. Such adjustment shall not exceed one-half of the estimated excess flow attrib~ztable to the leak. PagA 2 - COUNCIL BILL N0. 628 ORDINANCE N0. 1749 Section 3. That the monies collected persuant to the provisions of this ordinance shall be used to pay the costs of operation, maintenance and expansion of the water supply and distribution systems, and related facilities and services, including administrative and engineering costs. Section 4. Interpretation and administration of this ordinance and its provisions shall be the responsibility of the City Engineer. Section 5. A11 rates and charges in Section 1 shall be automatically in- creased by approximately 5% every 6 months, effective with billings for service beginning during the month of N©vember,l981. It is also intended that there be a one-time 10% increase in fiscal year 1982-83 only, in addition to the projected normal increases of 5% every 6 months. The provisions of this ordinance may be reviewed semi-annually by the Common Council. Section 6. If any clause, sentence, paragraph, section or portion of this ordinance for any reason shall be adjudged invalid by a court of competent juris- diction, such judgement shall not affect, impair, or invalidate any of the re- mainder of this ordinance. Section 7. That Sections 5, 10, 11 and 12 of Ordinance No. 1b22 are here- by repealed, and that Ordinances Nos. 1378, 1595 and 159b are not revived. Section 8. The provisions of this ordinance shall become effective with billings for monthly services beginning during the month of May, 1981. Section 9. Inasmuch as this ordinance is urgently required to provide adequate funds for increased operation and maintenance costs for water supply and distribution and this affects the health, peace and safety of the people of Wood- burn, an emergency is declared to exist and this ordinance shall be in full force and effect upon its passage by the Common Council and signature by the Mayor. ,w~...,,,ti.
