ORDINANCE N0. 1752
AN ORDINANCE RELATING TO THE IMPROVEMENT OF PARK AVENUE FROM PARK CIRCLE
ON THE NORTH TO HARDCASTLE STREET ON THE SOUTH, IN THE CITY OF WOODBURN;
ADOPTING PLANS, SPECIFICATIONS, ESTIMATES, DIRECTING THE INVITATION AND
RECEIPT OF BIDS; PROVIDING FOR PAYMENT OF THE COSTS THEREOF BY GENERAL
OBLIGATION CONSTRUCTION WARRANTS; PROVIDING THAT THE COSTS THEREOF SHALL
BE ASSESSED TO THE PROPERTIES BENEFITED; AND DECLARING AN EMERGENCY.
WHEREAS, Resolution number 710 was passed to improve such street;
and legal notices were posted, and
WHEREAS, a public hearing was held June 8, 1981; and
WHEREAS, remonstrances sufficient in number to prevent such improve-
ment have not been received; now therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That Park Avenue from Park Circle on the North to Hard-
castle Street on the South in the City of Woodburn; be improved pursuant to
Resolution No. 710 proposing such improvement, by grading the same to proper
subgrade, by providing all necessary and expedient drainage facilities, by
placing upon said subgrade sufficient gravel to provide a proper base, by
constructing curbs, gutters, and sidewalks on both sides of the street and
paving said street with an asphaltic surface to an appropriate width, all
in accordance with the plans, specifications and estimates of the City
Engineer therefore, which said plans, specifications and estimates herein
and made a part of this ordinance by reference.
Section 2. That the cost of said improvement shall be done at the
expense of the properties specially and peculiarly benefited by such improve-
ment within the assessment district established by Section 3 of this ordinance.

Section 3. That the property specially and peculiarly benefited
by such improvement and to be assessed therefor is hereby declared to be
the parcels of real property described in the Marion County Record of
Deeds as follows:

Section 4. That the City Engineer's estimate of the probable cast
of said improvement is the sum of $299,695,00. That portion which is to be
assessed against the property especially and peculiarly benefited thereby is
declared to be only the sum of $38, 94 7.0 0
Section 5. That the limit of time such improvement shall be maintained
by the City of Woodburn is hereby fixed at ten years.
Section 6. That the City staff is hereby directed to request the State
Highway Division to invite bids for the construction of said street in
accordance with the plans, specifications and estimates in the manner provided
by the laws of the State of Oregon.

Section 7. That the treasurer of the City of Woodburn is hereby
authorized and directed to issue to the contractor, and to others furnishing
services in connection with this improvement, general obligation improvement
warrants of the City of Woodburn in partial payment of estimated-completed
work furnished monthly by the City Engineer of the City of Woodburn.
Section 8. That such warrants shall be a general obligation of the
City of Woodburn as provided in ORS 287.502 to ORS 287.510. The warrants
shall draw interest from the date of issue at the rate of lawful legal inter-
est per annum until called for payment. The warrants shall be callable as
provided by law and shall mature on or before two years after the date thereof.
Interest shall be paid annually if the warrant is presented to the City Trea-
surer for such interest payment, otherwise the interest shall be paid at the
time of redemption.
Section 9. This ordinance being necessary for the immediate preser-
vation of the public peace, health and safety, due to the substandard condi-
tion of the street; an emergency is declared to exist. This ordinance shall
take effect immediately upon passage by the Council and approval by the Mayor.

I, BARN~Y 0. BURRIS, Recorder of the City of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance No. 1752, on of which said copies posted in the
City Hall on the bulletin board opposite the entrance to
the Recorder`s Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 280 Garfield Street, in full view
of the traveling public; a third one of said copies posted
on the Community Center bulletin board at 491 N. Third St.,
places are public places within the corporate limits of the
City of Woodburn and all of said copies were posted on the
12th day of June ,1981.
