Av ORDINANCE RECLASSIFYING CERTAIN PROPERTY LOCATED AT THE NORTHWEST QUADRANT
OF INTERSTATE 5 AND STATE HIGHWAY 214 FROM CO (COMMERCIAL OFFICE) TO CG
(COMMERCIAL GENERAL).
WHEREAS, the Woodburn Comprehensive Plan Map made pursuant to said
ordinance has heretofore established certain use zones within the City of
Woodburn, and
WHEREAS, zone change proceedings have heretofore been had before
the Woodburn Planning Commission and the Common Council in accordance with
Chapter 16 of the Woodburn Zoning Ordinance, and
WHEREAS, the Common Council of the City of Woodburn deems this
classification to be in the public need and is in accord with the Comprehensive
Plan, and
WHEREAS, the Common Council finds that it would not be in the public
interest to allow uses permitted in CG until construction of a motel complex
on the subject parcel is commenced; now, therefore
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. The fo1]owing described property within the City of
Woodburn, Marion County, State of Oregon, is, subject to Section 2 of this
ordinance, hereby rec]assified from CO (Commercial Office} to CG (Commercial
General}:
Beginning at a point on the Northerly right-of-way of State Highway
214, said point being 30,00 feet Northerly and 40.00 feet Westerly
from the Southwest corner of the Wm, Durst donation land claim #60,
which is also the Southwest corner of that certain tract conveyed to
Marion County by instrument recorded in Volume 627, Page 739, Marion
County Deed Records; thence Northerly along the Westerly line of
that tract recorded in Volume 627, Page 739, Marion County Deed
Records 220,00 feet; thence Westerly parallel with the Northerly
right-of-way line of State Highway 214 300.00 feet; thence Southerly
parallel to the Westerly line of that tract recorded in Volume 627,
Page 739, Marion County Deed Records 220.00 feet to the Northerly

right-of-way line of State Highway 214; thence Easterly along
the Plortherly right-of-way of State Highway 214 300,00 feet to
the point of beginning; all situated in Section 12, Township 5
South, Range 2 West, of the Willamette Meridian, i~arion County
Oregon.
Section 2. The reclassification herein granted shall take effect
only after commencement of construction of a motel on the subject property.
Section 3. The City Administrator is hereby directed to correct
the Woodburn Zoning Map to the classification herein made,

I, BARNEY 0. BURRIS, Recorder of the City of Woodburn, do hereby certify
that I caused to be posted three copies of Ordinance No. 1764, one of
which said copies posted in the City Ha11 on the bulletin board
adjacent to the entrance to the Recorder's Office, in full view of
the traveling public; a second one of said copies posted on the Woodburn
Public Library bulletin board at 280 Garfield Street, in full view
of the traveling public; a third one of said copies posted on the
Community Center bulletin board at 491 N. Third St., in full view of
the traveling public9 all of said places are public places within
the corporate. limits of the City of Woodburn and a]1 of said copies
were posted on the 21th day of ~ August , 1981.
