Ord 1767COUNCIL BILL N0, 653 ORDINANCE N0, 1767 AN ORDINANCE DEFINING DUTIES AND RESPONSIBILITIES OF THE WOODBURN FIRE DEPARTMENT, IT'S OFFICERS, EMPLOYEES, AND voLUNTEER AUxILIARY, WHEREAS, the City of Woodburn has afull-time Fire Department commanded by a full-time professional Fire Chief, and WHEREAS, the Woodburn Fire Department is augmented by the Woodburn Firefighters, Inc., and WHEREAS, the Woodburn Fire Department, under agreement approved by the City of ~loodburn Common Council and the Woodburn Rural Fire Protection District's Board of Directors, provides fire and related services to the Woodburn Rural Fire Protection District, and WHEREAS, the Woodburn Fire Department may provide mutual aid assistance to neighboring cities and/or fire districts throughout Marion County, and WHEREAS, population in the City of Woodburn and it's neighboring cities and fire districts is increasing and fire science is becoming more complex, and WHEREAS, it becomes more and more important to have a smoothly functioning Fire Department, and WHEREAS, this necessitates establishment of clear lines of communication and authority, NOW, THEREFORE, THE CITY OF WOODBURN DOES ORDAIN: Section 1. Fire Chief, Appointment, Tenure, ~. The Fire Chief shall be technically qualified by training and experience and shall have the ability to command men and hold their respect and confidence, The Fire Chief shall be appointed as provided by Charter. Accou~ntabilit of the Fire Chief The Fire Chief shall be accountable to the City Administrator for the effective and efficient operation of the Fire Department. He shall make such written or verbal reports as may be required by the City Administrator, All Fire Department employees, including members of Woodburn Firefighters, Inc., shall be accountable to the Fire Chief and subject to discipline and removal by him Section 3 ~ Duties of the Fire Chief , (1} The Chief shall have complete direction of the department and charge of all men, including volunteer members of Woodburn Firefighters, Inc., all equipments a]1 fire stations, all fire fighting activities, all training drills, and all other fire department functions. (2} The Fire Chief will assist the proper authorities in suppressing the crime of arson by investigation, or causing to be investigated, the cause, origin and circumstances of all fires. (3} The Fire Chief, or his designate, is hereby empowered to enter any and all buildings and premises at any reasonable hour for the purpose of making inspections and to serve written notice upon the owner or occupant to abate, within a specified time, any and all fire hazards that may be found. If such entry is refused or authority for inspection is questioned, the Chief shall be authorized to obtain a warrant to enable him to perform the inspection, (4} Any person served with a notice to abate any fire hazard or hazards shall comply therewith and promptly notify the Fire Chief of such compliance! (5} The Fire Chief will perform any other such duties as may from time to time be required by the City Administrator, or the Common Council, Page 2 ~- COUNCIL BILL N0. 653 ORDINANCE N0. 1757 Section 4, Ilse of A aratus and E ui ment, No person shall use any fire apparatus or equipment for any private purposes nor shall any person willfully and without proper authority take away or conceal any article used in any way by the department, Section 5. Tam erin with E ui ment, Flo person shall enter any place where fire apparatus is housed, or handle any apparatus or equipment belonging to the department un]ess accompanied by, or having special permission of, an officer or authorized member of the department, Section 6, Obstruction of Firefi htin 0 erations, No person shall in any way obstruct any fire apparatus or interfere with or obstruct any fireman in the performance of his duties, PJo person shall fail to obey the lawful orders of any fire department officer or acting officer while such officer is engaged in fighting fire, cleaning up after a fire, responding to afire call or conducting a fire drill. Section 7. Police Powers, All regularly appointed department and company officers are hereby given the necessary special police powers for the purpose of enforcing the provisions of this ordinance or other ordinances relating to fire fighting or the use of fire fighting vehicles and equipment. Section 8, Rules and Re ul~ations, The Chief shall adopt such rules and regu]ations for the administrative training and conduct of the department as shall be appropriate to carry out the terms and intent of this ordinance, Section 9, Donated Equipment, All items of equipment donated to the Fire Department by any individual, group, or organization shall automatically become property of the City of Woodburn and shall be placed under control of the Fire Chief, Page 3 -~ COU(VCIL BItL N0, 653 ORDLPdAPJCE N0, 1767 Section 10. Penalties of~`Violation.
