AN ORDINANCE RELATING TO TREES AND BUSHES LOCATED WITHIN STREET RIGHTS-OF-WAY OR
ON UTILITY EASEMENTS WITHIN THE CITY OF WOODBURN, AND REPEALING ORDINANCE N0~ 1079
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN;
Section le All trees and bushes located on street rights-of -way and on
utility easements be and hereby are declared to be the responsibility of the abutting
landoUrners insofar as the trimming, maintenance, possession and control of said trees,
subject to the limitations contained herein
Section ?_E In consideration of the benfits derived from the enjoyment of
said trees and bushes, property owners shall inspect and remove defective conditions
found in said trees and bushes, trim and maintain them, not at the cost of the City,
but at the cost of said abutting landowner,
Section 3, vision Clearance Area. In an "R" or "P" district the vision
clearance area for corner lots at street intersections shall have a minimum of
30 foot legs along each street and for alley-street intersections in said districts
the vision clearance area shall have legs of a minimum of ten feet along both alley
and street. vision clearance area at street intersections and alley-street inter-
sections in all other districts sha11 have legs of a minimum of ten feet along both
alleys and streets The vision clearance area shall not contain any plantings,
walls, structures, or temporary or permanent obstructions to vision exceeding
30 inches in height above the curb level, or street shoulder where there is no
curb, except a supporting pillar or post not greater than 12 inches in diameter or
12 inches on the diagonal of a rectangular pillar or post; and further, excepting
those posts or supporting members of street signs, street lights, and traffic

control signs installed as directed by the Building Inspector, or any other sign
erected for public safety
Section 4, Prior to the removal of any tree by the owner of abutting
land, permission shall be obtained from the Common Council of the City of Woodburn
When authorized by motion, the Common Council may delegate decisions regarding the
removal of trees and bushes to the City Administrator or his designated deputy.
Permission to remove may be granted or withheld at the discretion of the Common
Council, or the City Administrator, where so delegated,
Section 5. The replacement of an existing tree or bush shall conform
to the provisions of this ordinance,
Section 6! It shall be unlawful for any person to plant any fruit or
nut bearing tree, poplar, cottonwood, willow, common horse chestnut, box elder,
lilac, locusts laburnum, broad leaf or silver maple, holly, ailanthus! or any
coniferious (needle bearing} species of tree within street rights-of-way and upon
utility easements,
Section 7, It shall be within the discretion of the Common Council to
require the replacement by the landowner, at the landowner's expense, of a new tree
after permission has been granted for removal of an existing tree.
Section 8, The Common Council may, in its unrestricted discretion, direct
the trimming or removal of any tree or bush, at the expense of the landowner or at
the expense of the City, when such trimming or removal shall be deemed by the
Common Council to be in the public interest.
Section 9, It shall be unlawful for any person to place or maintain
any bush or tree or allow any bush or tree to obstruct or conceal City fire
hydrants, water meters, or manhole covers,

Section 10, City Infraction Assessment. A violation of any provisions
of this ordinance constitutes a Class 2 City Infraction and shall be dealt with
according to the prodecures established by Ordinance ~Jo~ 1610.

I, BARNEY 0. BURRIS, Recorder of the City of Woodburn, do hereby certify
that I caused to be posted three copies of Ordinance No. 1768, one of
which said copies posted in the City Na11 on the bulletin board adjacent
to the entrance of the Recorder's Office, in full view of the traveling
public; a second one of said copies posted on the Woodburn Public Library
bulletin board at 280 Garfield Street, in full view of the traveling
public; a third one of said copies posted on the Community Center bulletin
board at 491 N, Third St., in full view of the traveling public; that
all of said places are public places- within the corporate limits of the
City of ~~~oadburn and all of said copies were posted on the 14th day
October ~ 1981.
