Ord 1772COUNCIL BILL N0. 661 ORDINANCE N0. 1772 AN ORDINANCE PROPOSING A LEVY OF TAX OUTSIDE THE LIMITATION IMPOSED BY ARTICLE XI, SECTION 11, SUBSECTION (1) OF THE OREGON CONSTITUTION AGAINST THE TAXABLE PROPERTY IN THE CITY OF WOODBURN IN THE AMOUNT OF $831,068.00 FOR THE FISCAL YEAR 1982-83; AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR THE BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 1982; CALLING FOR A SPECIAL ELECTION AT WHICH SUCH LEVY OF TAX SHALL BE SUBMITTED TO THE LEGAL ELECTORS OF THE CITY OF WOODBURN; AND DECLARING AN EMERGENCY. THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. That the Common Council of the City of Woodburn hereby proposes a levy of tax outside the limitation imposed by Article XI, Section 11, Subsection (1) of the Oregon Constitution in the amount of $831,068.00 for the fiscal year 1982-83 for the purpose of applying said sum to the budget for the fiscal year 1982-83. Section 2. That the proposed levy of tax shall be submitted to the legal electors of said City at a special election, which is hereby called to be held therein in accordance with the laws of the State of Oregon and the Charter and ordinances of said City governing elections, May 18, 1982. The City Recorder shall post a typewritten notice in each of the election precincts of the City of Woodburn and shall cause notice of said election to be published in the city's official newspaper or in a newspaper of general circulation at least 10 days prior to said election. Section 3. That the form in which said questions shall be submitted to the electors of said City on the official ballot at such special election shall be as follows: (See attached Exhibit A) Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety, in order to meet the deadline requirement to get the measure on the official ballot, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the Council and approval by the Mayor. Page 1 -COUNCIL BILL N0. 661 ORDINANCE N0. 1772 Exhibit A SPECIAL MUNICIPAL ELECTION CITY OF WOODBURN Marion County, Oregon May 18, 1982 Submitted to the Voters by the Common Council Measure No. 51 AUTHORIZATION FOR TAX LEVY FOR CITY OF WOODBURN QUESTION: Shall City of Woodburn be authorized to levy $ 831,068.00 outside the tax base to finance city services during 1982-83? EXPLANATION: The money in this measure will provide for the continuation of city services within the General Fund, Transit Fund, and Street Light Fund. Services provided by the General Fund incline Police, Fire, R.S.V.P., Dial-a-Ride, Municipal Court, administration, and city hall maintenance. Even though the General Fund includes the addition of 4 police officers, 1 firefighter, and increased court expenditures, the property taxes required in the general fund budget for 1982-83 will be $24,690.00 less than the current fiscal year. The city bus program requires $9,934.00 less property taxes than the current fiscal year to maintain current level of service to the community. If this measure is approved, the total of all Funds financed by local taxes for 1982-83 will be $82,369.00 less than 1981-82 and the estimated tax rate is $6.57 per $1,000 assessed valuation. If this measure is approved, $533,572.00 of the taxes levied in the 1982 fiscal year are eligible for partial state funding. However, $297,496.00 of the taxes levied will be totally financed by local taxpayers without any partial state payment.
