ORDINANCE No. 1186
AN ORDINANCE RELATING TO THE VACATION OF THE NORTHERLY END OF KING WAY
FR~ONI NEWPORT WAY TO THE NORZ~RLY CITY LIMIT.
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN;
Section 1. That all of that portion of King Way Northerly of
Newport Way as described on the plat of a resubdivision of a portion
of Woodburn Senior Estates No. 5 together with that portion of Lot 17,
Block 62, Woodburn Senior Estates No. 5 former Tax Account No. 93000-210,
deleted by the Marion County Assessor at the request of the Marion County
Property Management Department. The right-of way to be vacated shall be
described thus;
Beginning at the Northwest corner of a resubdivision of a
portion of Woodburn Senior Estates No. 5, Section 6, Town-
ship 5 South, Range 2 West, W.M., thence S 35° 57' W.
28.56 along the Westerly right-of way of King Way; thence
South 54° 03' East 60 feet to the Southeast corner of Lot
17, Block 62; thence Southeasterly along the arc of a
128.63 foot radius curve, to the left, the long chord
bears South 86° 68' 30" E., a distance of 11.98 feet; thence
North 41° 48' 16" East 84.15 feet to a point on the North
line of Lot 17, 12.99 feet West of the North East corner;
thence North 88° 41' West 97.92 feet to the point of beginn-
ing.
Attached hereto is a drawing, for greater certainty, indicating by the words
"to be vacated", and hereby made apart of this ordinance by, and the same
is, no longer required for public use and the public interest will be served
by such vacation.
Section 2. An easement for utility purposes are expressly reserved
by the City, through over and across that portion of the vacated area, that
is contained in a strip of land 20 feet wide which is the Southerly exten-
sion of the Easterly 20 feet of that 50 foot wide tract defined in the
relinquishment of title as recorded in Volume 634, Page 547, Marion County
Deed Records.

All conditions imposed by the plat of the resubdivision of a portion
of Woodburn Senior Estates No. 5 and all covenants pertaining to owner-
ship shall apply. No structure may be placed on the easement, or within
a 45° projection upward from the bottom of any buried pipes. The City
shall, upon each and every occasion that any facilities are constructed,
maintained, replaced, reconstructed or removed on or under the ground,
restore the premises to grade and replace grass by seeding. Bushes,
shrubs, trees or other landscaping will not be replaced if removed or
damaged.
Section 3. All asphalt paving and concrete curbs in the vacated
area will become the property of the petitioners. The City shall not be
required to patch, repair, replace, rerr~ve, or install any asphalt pav-
ing or concrete curbs in the vacated area.
Section 4. This ordinance shall take effect and be in force from
and after its passage subject to all the conditions subsequent as set forth
in Section 2 being completed within 12 months after passage of this ordi-
nance.

Ordinance ado. 1780, one of which said copies posted in City 11a11
on the bulletin board adjacent to the entrance to the Recorder's
Office, in full view of the traveling public; a second one of said
copies posted on the !~oodburn Public Library bulletin board at
280 Garfield Street, in full view of the traveling public; a third
one of said copies posted on the Woodburn Community Center bulletin
board at 491 N. Third St., in full view of the traveling public;
