Ord 1804AMENDED COUNCIL BILL No. 699 ORDINANCE No. 1$04 AN ORDINANCE PRESCRIBING RATES TO BE CHARGED FOR L1SE OF CITY WATER, REPEAL- ING ORDINANCE 1749 AND SECTIONS 5, 10, ];l AND 1~2 OF ORDINANCE N0. X622. THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Secta.on 1. That the rates and c~~arges for the supply and use of water from the water system s.nd mains of the City of Woodburn shall be as f o1loc~rs: a. Water Consumed above minimum quantity allowed per month - $0.50 per 100 cubic feet. c-i. Single Residential: As per subsections "a" and "b" above. c-ii. Nlultiple Residential: $4.25 per unit per month in establishing the mini- mum for each service. Quantity allowed shall be the number of units times 400 cubic feet, or the above-established quantity allowed far size of service, whichever is greater. Unless water service to premises is disconnected entirely the minimum charge will apply to all units whether occupied or not. However an adjustment may be made for the unoccupied units of a newly constructed multiple structure for a period of 6 months from the date of first occupancy. The owner is responsible for providing written information and facilitating City's inspection. Page 1 - COUNCIL BILL No. 699 ORDINANCE ivo. 1804 c-iii. Commercial and Industrial: rate shall be based on the size of the service line and quantity used as established i~n Section "a" and "b" oi: this ordinance. d. Flat Rate: residential accounts existing at the date of this ordinance shall be $6.50 per month. e. Fire sprinkler connections - $3.00 per diameter-inch of service line per month. This chare~e shall be effective beginning with the service-month beginning December 1983. f-(i} The charges for turn-off and/or turn-on far non payment of water bi1~ shall be $10.00 during B:AM to 4 PM and $25.00 during 4 PM to 8 AM on a regular workday. On any holiday, Saturday or Sunday a simi~az charge of $25.00 wi~.1 be made for the turn-off and/or turn-on service. Account ba~.arice must be paid in full prior to turn-on service. (ii}. The charges for turn-off and/or turn-on for reasons other than non pay- ment of water bill shall be $10.00. No charge shall be made for turn- off and/or turn-on service necessitated by an emergency such as water- line/equipment breakage. g. Minimum Monthly Charge [flat rate, minimum metered, or fire] for each account shall accrue for each and every month, regardless of turn-off of the water to the premises for non-payment. h. Otherwise, deposit will be retained to cover cost of testing. Page 2 - COUNCIL BILL No. 69~ ORDINANCE No. 180 i. Outside city limits: A factor of 1.5 shall be applied to ail rates and charges for services outside the City. j. Hardship Relief: Hardship cases may apply for and be granted a monthly charge reduction of 40~ to the bill. Hardship may be established by submitting proof of $4,000.00 or less yearly income. To remain eligible for reduction the water consumption must not exceed the average, and the City may at its option install a meter for this monitoring. Section 2. In case of leakage, an adjustment of billings may be provided if the leak has been promptly repaired. Such adjustment shall not exceed 100 of the estimated excess flow attributable to the leak. Section 3. That the monies collected pursuant to the provisions of this ordinance shall be used to pay the costs of operation, maintenance and expansion of the water supply and distribution systems, and related facilities and services, including administrative and engineering costs. Section 4. Interpretation and administration of this ordinance and its provisions shall be the responsibility of the City Engineer. Section 5. All rates and charges in Section 1-a, b, and c shall be automatically increased by approximately 5.5~ every 12 months, effective with billings for service beginning during the month of December 1983. It is also intended that there be an additional 3g rate increase in a fiscal year whenever the inflation rate exceeds 9~ based on Portland C.P.I.. The provisions of this ordinance may be reviewed annually by the City Council. Section 6. If any clause, sentence, paragraph, section or portion of this ordinance for any reason shall be adjudged invalid by a court of competent jurisdiction, such judgement shall not affect, impair, or invalidate any of the remainder of this ordinance.
