ORDINANCE N0. 1841
AN ORDINANCE PERMITTING THE USE OF GOLF CARTS IN DESIGNATED AREAS; REGULATING
SUCH USE; 'REPEALING ORDINANCE N0. 1756; AND DECLARING AN EMERGENCY.
WHEREAS, The City of Woodburn is in the process of analyzing and
compiling its city ordinances, and
WHEREAS, the Council has recently considered Ordinance No. 1756 and
finds that it is appropriate except that it contains a typographical error,
now, therefore,
THE CITY OF WOODBURPd ORDAINS AS FOLLOWS:
Section 1.
(1) "Golf cart", also known as a "golf car", means a motor vehicle
having not less than three wheels in contact with the ground, having an unladen
weight less than 1,300 pounds, which is designed to be and is operated at not
more than 15 miles per hour and designed to carry golf equipment and not more
than two persons, including the driver.
(2) "Senior Estates", the areas platted as Woodburn Senior Estates,
Woodburn Senior Estates Nos. 1, 2, 3, 4, 5, 6, 7, 7~a) and 8 as filed with
Marion County,
(3) "Fairway Plaza", the shopping center on the commercial properties
located to the northwest of the intersection of Highway 214 and Country Club
Road, city of Woodburn, and lying immediately adjacent to the Senior Estates.
Section 2. Golf carts are hereby permitted to use all of the streets
in the area known as Senior Estates as described in Section 1 and also the area
known as Fairway Plaza as described in Section 1. No such permission is
intended or implied for any public way other than those within the boundaries
described.

Section 3. The operation of golf carts shall be confined to the
daylight hours, and shall at all times be operated in a prudent manner, obeying
the rules of traffic and keeping well to the right in the regular traffic pattern
as a slow moving i~ehi c] e.
Section 4. The operation of golf carts shall not be allowed on any
portion of the public highway known as Oregon Highway 214.
Section 5. Golf carts operated pursuant to this ordinance shall be
exempt from registration and licensing as provided in ORS 481.075(g}.
Section 6. Ordinance No. 1756 is hereby specifically repealed.
Section 7. This ordinance being necessary for the immediate preser-
vation of the public peace, health, and safety, an emergency is declared to
exist and this ordinance shall take effect immediately upon passage by the
Council and approval by the Mayor.
