ORDINANCE N0. 1852
AN ORDINANCE CLARIFYING ORDINANCE N0, 1846 WHICH ANNEXED CERTAIN REAL PROPERTY
LOCATED ADJACENT TO AND SOUTH OF COUNTRY CLUB ROAD AND APPROXIMATELY 400 FEET
EAST OF ASTOR WAY AND DECLARING AN EMERGENCY.
WHEREAS, the Woodburn City Council acted on October 24, 1983 by
Ordinance No. 1846 to annex certain property located adjacent to and south of
Country Club Road and approximately 400 feet east of Astor Way, said property
being more specifically described in said ordinance;
WHEREAS, annexation proceedings have been held and concluded in
accordance with the applicable Oregon law;
WHEREAS, it is unclear from the face of Ordinance No, 1846 as to
exactly what type of annexation has occurred, now, therefore,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. The annexation of the property described more specifically
by Ordinance No, 1846 was completed pursuant to O.R.S. 222.120(2}(b}.
Section 2, Notice having been duly given and the consent of the
requisite number of land owners having been obtained, such consent which is
attached hereto as Exhibit "A" and by this reference incorporated herein, said
annexation was completed without the calling of an election.
Section 3, This ordinance being necessary for the immediate preserva-
tion of the public peace, health and safety, an emergency is declared to exist
and this ordinance shall take effect ir~nediately upon passage by the Council and
approval by the Mayor,
