ORDINANCE No. 1854
AN ORDINANCE ANNE~~TNG AND RECLASSIFYING CERTAIN PROPERTY LOCATED ADJACENT
TO AND ON THE EAST SIDE OF STATE HIGHWAY 99E FROM MARION COUNTY CR (COM-
MERCIAL RETAIL) AND RS (SINGLE FAMILY RESIDENTIAL) TO CITY CR (CC~RCIAL
RETAIL) AND RS (SINGLE FAMILY RESIDENTIAL).
WHEREAS, the Woodburn Comprehensive Plan and Map made pursuant to
said ordinance has heretofore established certain land uses within the City
of Woodburn's Urban Growth Boundary, and
WHEREAS, the Woodburn City Council has reviewed the record in Annex-
ation Case No. 83-03, and Zone Change Case No. 83-03 and considered the public
testimony previously presented; now, therefore
THE CITY OF WOODBURN ORDAINS AS FOLZ~OWS:
Section 1. The legal description of the involved real property is
as follows:
A tract of land described as Corrected Deed in Lieu of
Foreclosure recorded 29 July 1983 in Reel 317, Page 918,
Marion County Deed Records and located in a portion of
the E. C. Cooley Donation Land Claim No. 42 in the North-
west One-Quarter of Section 17, Township 5 South, Range
1 West of the Willamette Meridian, Marion County, Oregon
and more fully described based on an actual survey as
follows:
Beginning at the Northwest corner of WYNN'S ADDITION TO
WOODBURN, a subdivision recorded 28 November 1934 i.n
Marion County Book of Town Plats in Volume 13, Page 7,
said point being also on the easterly right-of way line
of Pacific Highway 99E; thence North 32° 21' 38" East
197.96 feet along the said easterly right-of way to a
one inch iron pipe on the south line of a tract of land
deeded to S. Hortsch and A. Hortsch by deed recorded 19
December 1932 in Volume 214, Page 532, Marion County
Deed Records; thence South 89° 07' 23" East 1047.17 feet
along the south line of said Hortsch tract to a one inch
iron pipe the Northwest corner of that tract of land con-
veyed to Mark D. Bergquist and Sherie M. Bergquist, hus-
band and wife by deed recorded 21 October 1981 in Reel
264, Page 1047, Marion County Deed Records; thence South
00° 46' 44" West 169.28 feet along the west line of said
Bergquist tract to a one inch iron pipe at the Southwest
corner of said Bergquist tract, said point being on the
north line of WYNN'S ADDITION TO THE CITY OF WOODBURN;

thence North 89° 06' 00" West along the North line of said
WYNN'S ADDITION 931.75 feet to a one inch iron pipe on the
North line of Lot 12, Block 1 of said WYNN'S ADDITION, said
point being also described as the intersection of the North
line of said Lot 12 with an extension of the East line of
Lot 10, Block 1 of said WYNN'S ADDITION; thence South 02° 47'
47" East 139.97 feet along the extension of the east line of
said Lot 10 to a one inch iron pipe at the Northeast corner
of said Lot 10; thence South 87° 00' 12" West 128.22 feet
along the North line of said Lot l0 to a one inch iron pipe
at the Northwest corner of said Lot 10, said point being also
on the East line of Lot 5, Block 1 of said WYNN'S ADDITION;
thence South 32° 22' 53" West 4.05 feet along the East line
of said Lot 5 to a one inch iron pipe; thence North 57° 40'
05" West 162.92 feet to a one inch iron pipe on the West line
of Lot 2, Block 1 of said WYNN'S ADDITION, said point being
also on the east right-of~aay line of said Pacific Highway
99E and being also described as a point North 32° 21' 38"
East 43.87 feet along the West line of said Lot 2 from the
Southwest corner of said Lot 2; thence North 32° 21' 38"
East 78.42 feet along the West line of said Lots 2 and 1 and
the East right-of--way line of said Pacific Highway right-of-
way to the point of beginning.
Said tract ~ntaining 4,9987 acres,
Section 2. The real property described in Section 1 of this ordinance
is hereby annexed to the City of Woodburn
Section 3. The Zoning designation of said real property is hereby re-
classified from its present designation of County Single Family Residential
and Ccx~nercial Retail to the new designation of City CR (Ccxranercial Retail)
and RS (Single Family Residential).
Section 4. The Annexation and Zoning reclassification are subject
to the conditions contained in Exhibit "A", attached hereto and incorporated
herein, that the Council finds reasonable.
Section 5. The Annexation, and Zoning reclassifications of said real
property are based upon the staff report and, specifically, the findings of
approval contained in the staff report which are attached hereto as Exhibit
"A" and by this reference incorporated herein.

Section 6. T'he City Administrator or his designee is hereby directed
to correct the Woodburn Comprehensive Plan and Zoning Map to the classification
herein made.
