ORDINANCE NO, 1858
AN ORDINANCE SUBP~ITTING TO THE VOTERS OF THE CITY OF WOODBURN THE QUESTION
OF WHETHER OR NOT THE CITY SHOULD AMEND ITS CHARTER TO ELIMINATE THE
POSITION OF FIRE CHIEF IF THE VOTERS APPROVE THE ANNEXATION OF THE CITY
INTO THE RURAL FIRE PROTECTION DISTRICT AND DECLARING AN EMERGENCY,
WHEREAS, the City of Woodburn, by Resolution Igo, 743, initiated
annexation of the City to the Woodburn Rural Fire Protection District and
directed that an agreement be prepared between the City and the District,
and
WHEREAS, the City of Woodburn, by Resolution hlo, 746, called an
election to be held within the City at the polling places designated by
the Marion County Election Clerk on the 27th day of March, 1984 for the
purpose of submitting to the qua]ified voters of said City the question of
whether all the territory located within the corporate limits of the City
of Woodburn shall be annexed to the Woodburn Rural Fire Protection District,
and
WHEREAS, in order to accomplish the annexation of the City into
the Woodburn Rural Fire Protection District it is necessary to eliminate
from the Woodburn City Charter the requirement that a fire chief position
exist, NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. That the question of whether the Woodburn City Charter
should be amended to eliminate the position of fire chief if the voters
approve the annexation of the City into the Woodburn Rural Fire Protection
District shall be submitted to the voters at a special election to be held

on the 27th day of March, 1984, between the hours of 8:OO~a:m, and 8:OO~p,m,~
Pacific Time, within the City at polling places to be designated by the
Marion County Election Clerk.
Section 2, That Chapter V, Section 21, (3~ of the Woodburn City
Charter be amended to read as follows:
(3} He or she shalt appoint and may remove a City
Recorder, Police Chief, Director of Finance, Director
of Public Works, Library Director, and Director of
Recreation and Parks. Such appointment or removal
shall be with the consent of the council. The admin-
istrator shall appoint and may remove all other city
afficers and employees except as this charter other-
wise provides, and shall have general supervision and
control over them and their work with power to transfer
an employee from one department to another. He or she
shall supervise the departments to the end of obtaining
the utmost efficiency in each of them. He or she shall have
no control, however, over the mayor, the council, or
the judicial activities of the municipal judge.
Section~3. That form in which said quest-ion shalt be submitted
to the electors of the City on the official ballot at such special election
shall be as follows: (see attached Exhibit "A")
Section 4. This ordinance being necessary for the immediate
preservation of the public peace, health, and safety, an emergency is
declared to exist and this ordinance shall take effect immediately upon
passage by the Council and approval by the Mayor.

CHARTER AMENDMENT IF VOTERS APPROVE CITY ANNEXATION INTO FIRE DISTRICT
QUESTION: Shall Woodburn City Charter be amended to eliminate fire chief
position if voters approve annexation of City into District?
EXPLANATION: The present Woodburn City Charter provides that the City
Administrator, with the consent of the City Council, shall appoint and may
remove afire chief.
If the voters approve the annexation of the City into the Woodburn Rural
Fire Protection District, this measure would eliminate the City Charter
requirement of afire chief position.
This proposed Charter amendment shall be effective only if the voters
approve annexation of the City into the District.
