Ord 1859COUNCIL BILL N0. 777 ORDINANCE N0. 1859 AN ORDINANCE RELATING TO THE VACATION OF A RIGHT-OF-WAY WITHIN THE CITY OF WOODBURN AND DECLARTNG AN EMERGENCY. WHEREAS, the Woodburn City Council held a public hearing on January 23, 1984, pursuant to ORS Chapter Z71, relating to the proposed vacation of the right-of-way described herein below, and WHEREAS, Donald D. Hayes and Hazel W. Hayes have agreed, as set out in their petition to vacate the right-of-way dated November 16, 1983, to grant to the City of Woodburn a 20 foot utility easement in that right-of-way described herein below, and WHEREAS, the Council has determined that the public interest will not be prejudiced by the vacation of said property, NOW, THEREFORE, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. The legal description of the right-of-way is as follows: A parcel of land located in Section 12, Township 5 South, Range 2 West of the Willamette h1eridian, Marion County, Oregon, described as follows: Beginning at the Northwest corner of Lot 50, Halls Home Tracts; thence East 464.91 feet along the North line of Lot 50; thence North 20 feet to the Southeast corner of a parcel conveyed to Woodburn Investment Associates, Ltd., a Tennessee limited partnership, by deed recorded October 4, 1982, as Reel 292, Page 130, Marion County Deed Records; thence West along the South line of said Woodburn Investment Associates, Ltd. parcel to its Southwest corner; thence South to the point of beginning. Section 2. That said right-of-way is no longer required for public use, that the public interest will be served by vacating said right-of-way, and that said right-of-way is hereby vacated pursuant to ORS Chapter 271 with Donald D. Hayes and Hazel W. Hayes granting said 20 foot utility easement to the City of Woodburn. PAGE 1 - COUNCIL BILL N0. 777 ORDTNANCE N0. 1859 Section 3.
