COUNCIL BILL No. 797 ORDINANCE No. 1871 AN ORDINANCE RELATING TO THE VACATION OF A PORTION OF QUEEN CITY RIGHT-OF- WAY WITHIN THE CITY OF WOODBURN AND DECLARING AN EMERGENCY, WHEREAS, the Woodburn City Council held a public hearing on May 14, 1984, pursuant to ORS Chapter 271, relating to the proposed vacation of the right-of-way described herein below, and WHEREAS, the Council has determined that the public interest wil] not be prejudiced by the vacation of said property, now, therefore, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. The legal description of the right-of-way is as follows: That portion of Queen City Boulevard according to the p]at of Woodburn Walilale Home Tracts, Vol. 7, Page 65 described thus; Beginning at a point 168.91 feet, S. 86° 36' E, from the South- west corner of Lot 4, Block 6, said point being the intersection of the South line of tot 4, Block G and the Westerly line of Queen City Boulevard; thence Northeasterly along the arc of a 343 foot radius curve left 276.90 feet to a point, the chord of said arc bears N. 49° 07` 3l" E. 269.44 feet; thence continuing Northeasterly along said Westerly right-of-way 4.38 feet to a point; thence S. 2° 07' 30" W. 81.99 feet to a point on the Easterly right-of-way line of Queen City Boulevard; thence Southwesterly along the Easterly right-of-way, a 383 foot radius curve right 155.14 feet, the chord of which curve bears S. 48° 2G' 17" W. 154.08 feet; thence N. 86° 3G' W. along the South line of Lot 4, Block G, 86.85 feet to the point of beginn- ing, situated in the S.W. 1/4 of the S.W. 1/4 of Section 8, Township 5 South, Range 1 West, Willamette hleridian, Tiarion County, Oregon. Section 2. That said right-of-way is no longer required for public use, that the public interest will be served by vacating said right-of-way and that said right-of-way is hereby vacated pursuant to ORS 271. An independent survey which is marked Exhibit "A" and by this reference is incorporated herein has been done of said right-of-way by Trapp and Associ- ates. The vacation of said riaht-of-way is conditioned explicitly on the benefitted property owners accepting the correctness of said survey. Page 1 - COUNCIL BILL No. 797 OP,D I NANCE No .1871 Section 3. This Ordinance being necessary for the immediate preser- vation of the public peace, health and safety, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the City Council and approval by the Mayor.
