ORDINANCE No. 1873
AN ORDINANCE RECLASSIFYING CERTAIN PROPERTY LOCATED ADJACENT TO THE SOUTH-
WEST CORNER OF STATE HIGHWAY 214 AND CASCADE DRIVE ON THE CITY OF WOODBURN'S
COMPREHENSIVE PLAN AND ZONING MAP FROM RESIDENTIAL TO COMMERCIAL OFFICE.
WHEREAS, the Woodburn Comprehensive Plan and Zoning P1aps made pursuant
to said ordinance had heretofore established this property for Residential use
within the City of Woodburn, and
WHEREAS, proceedings have been had before the Woodburn Planning Com-
mission and the City Council to amend the plan, and zoning map to Commercial
Office in accordance with Chapter 3 of the Woodburn Zoning Ordinance, and
WHEREAS, the City Councii of the City of Woodburn deems this reclassi-
fication to be in keeping with the Comprehensive Plan eva]uation criteria, and
WHEREAS, the City Council finds that it would be in the public interest
to allow certain uses as permitted on the subject parcel, and
WHEREAS, the following Findings of Fact have been concluded:
1. The Comprehensive Plan (Volume 1, Page 25} identifies office
commercial uses as being compatible with residential uses if
care in architecture and site planning is exercised.
2. The Comprehensive Plan (Volume 1, Page 25} states that low
traffic generating uses such as commercial offices with
proper site planning are compatible with residential uses.
3. The petitioners proposal does not conflict with the housing
goals (Volume ], Page 24, #1-11}.
4. The lot configuration and limited access, only from Evergreen
Street, and size (230' x 220'} severely limit the use of the
property for single family residential development.
THE CITY OF WOODBURN ORDAINS AS FOLLOWS;
Section 1. The following described property within the City of Woodburn,
Marion County, State of Oregon, is hereby reclassified on the Woodburn Comprehen-
sive Plan and Zoning Map from Residential use to limited Commercial Office use,
said reclassification being based on the findings outlined above together with
the relevant findings contained in the staff report:

Beginning at the Northeast corner of the Andrew Dubois Donation
Land Claim in Township 5 South, Range 2 Jest of the Willamette
Meridian, Marion County, Oregon; thence running West along the
South line of the William Darst Donation Land Claim 230.0 feet;
thence South, parallel with the West boundary line of the Dona-
tion Land Claim of John B. Durcharme and G. Leasure, 230.0 feet;
thence East 230.0 feet to said West boundary line; thence North,
along said West boundary line, 230.0 feet to the pace of beginn-
ing.
SAVE AND EXCEPT that portion conveyed to the City of Woodburn by
instrument, recorded May 6, 1981, Reel 249, Page 68.
Section 2. The City Administrator is hereby directed to correct the
Woodburn Comprehensive Plan and Zoning ~1ap to the classification herein made.
