Ord 1878COUNCIL BILL N0. 807 ORDINANCE N0. 1878 AN ORDINANCE ANNEXING AND RECLASSIFYING CERTAIN REAL PROPERTY LOCATED WEST OF STATE HIGHWAY 99E AND COMMONLY KNOWN AS SHALIMAR MOBILE PLAZA FROM MARION COUNTY RM (MULTI-FAMILY RESIDENTIAL) AND EFU (EXCLUSIVE FARM USE) TO WOODBURN CITY RM (MULTI-FAMILY RESIDENTIAL AND RS (SINGLE FAMILY RESIDENTIAL). WHEREAS, the Woodburn Comprehensive Plan and Zoning Ordinance have established certain uses within the City of Woodburn's Urban Growth Boundary; and WHEREAS, annexation and zone change proceedings have been held before the Woodburn Planning Commission and City Council in accordance with applicable Oregon law; NOW, THEREFORE, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: follows: Section 1. The involved real property is described as Beginning at the Southwest corner of the B. S. Bonney Donation Land Claim No. 47, in Township 5 South, Range 1 West of the Willamette Meridian in Marion County, Oregon; thence North 10°52' East 901.56 feet; thence North 87°40' East 333.30 feet; thence South 10°52' West 426.38 feet; thence South 89°07' East 1498.56 feet more or less to an iron pipe set on the Westerly right of way line of the Pacific Highway 99E; thence South 32~°32' West along said Westerly right of way 140.72 feet, thence South 32°24'30" West along said Westerly right of way 149.80 feet; thence South 32°32' West along said Westerly right of way 179.21 feet to the South Boundary line of said Bonney Donation Land Claim; thence South 87°40' West 1542.01 feet to the place of beginning and containing 21 acres of land more or less. Section 2. The above-described real property is hereby annexed into the City of Woodburn pursuant to ORS 222.120(2}(b), notice having been duly given and the consent of the requisite number of land owners having been obtained, such consent which is attached hereto as Exhibit "A" and by this reference incorporated herein. Said annexation was completed without the calling of an election. PAGE 1 - COUNCIL BILL N0.807 ORDINANCE N0. 1878 Section 3. The above-described real property is hereby reclassified from Marion County EFU (Exclusive Farm Use) and RM (Multi-Family Residential) to Woodburn City RM (Multi-Family Residential) and RS (Single Family Residential). Section 4. The City Council hereby finds this reclassification and annexation to be in the public interest, to satisfy a public need, and to be in accord with the Woodburn Comprehensive Plan. Section 5. The Woodburn City Council bases this annexation and reclassification upon findings of fact as follows: 1. The applicant is the sole applicant and the owner of the property. As such, the City is not obligated to seek approval from registered voters of the City of Woodburn. 2. The proposed annexation lies within the Urban Growth Boundary as identified in the City's adopted Comprehensive Plan Map. 3. The proposed site is contiguous to the existing City limits of the City of Woodburn. The City has the capability of handling the water, the sewer and storm drainage, and the demands of the proposed uses, as long as the conditions which would be required by the City prior to development are met. 4. The requested zone designation to RM is in compliance with the adopted Comprehensive Plan of the City of Woodburn and the provisions of Section 4.110 of the Woodburn Zoning Ordinance requiring newly annexed properties to be classified within that Comprehensive Plan designation. 5. There exists, within the City of Woodburn, a need for additional mobile home park spaces There further exists a need within the subject parcel of property for City services to protect the public health, safety, and general welfare of the residents of the park. 6. The designation of this parcel of property as RM (Multi-Family Residential} will permit, subject to the granting of the conditional use, the expansion of the existing mobile home park into additional areas which will meet this need. The City Administrator, or his designee, is hereby directed to correct the Woodburn Zoning Map and city limit boundary to the classification and boundary change herein made.
