AN ORDINANCE ANNEXING AND RECLASSIFYING CERTAIN REAL PROPERTY LOCATED
WEST OF NORTHWOOD PLAZA FROM MARION COUNTY EFU (EXCLUSIVE FARM USE} TO
WOODBURN CITY CR COMMERCIAL RETAIL}.
WHEREAS, The Woodburn Comprehensive Plan and Zoning Ordinance
have established certain uses within the City of Woodburn's Urban Growth
Boundary; and
WHEREAS, annexation and zone change proceedings have been held
before the Woodburn Planning Commission and City Council in accordance
with applicable Oregon law; NOW THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1, The involved real property is described as follows;
Beginning at the Southwest corner of Lot 6, Block 2, Northwood
Plaza addition No. 1 in Section 7, Township 5 South, Range 1
West of ohe Willamette Meridian in Plarion County, Oregon; thence
North 76 35 13 West 194..64 feet to an Iran rod: thence North
210 25' 41" East 265.51 feet to an iron rod; thence South 88°
30' 00" East 161.40 feet to an iron rod in the West line of said
Lot 6; thence South 13° 28' 21" Jest 296.23 feet to the place
of beginning ,and containing 1.12 acres.
SUBJECT TO: A ten foot easement adjoining the best line of the
above described Parcel 2 for the purpose of maintaining the
existing shrubery seperating the herein described Parcel 1 and
Parcel 2.
Section 2. The above described real property is hereby annexed
into the City of Woodburn pursuant to ORS 222.120 ~2) ~b}, notice having
been duly given and the consent of the requisite number of land owners
having been obtained, such consent which is attached hereto as Exhibit "A"
and by this reference incorporated herein. Said annexation was completed
without the calling of an election.
Section 3. The above described real property is hereby re-
classified from Marion County EFU (Exclusive Farm Use} to Woodburn City
CR Commercial Retail}.
Section 4. The City Council hereby finds this reclassification
and annexation to be in the public interest, to satisfy a public need, and
to be in accord with the Woodburn Comprehensive Plan.

Section 5. The Woodburn City Council bases this annexation
and reclassification upon findings of fact as follows:
(A) The applicant is the sole applicant and owner of the
property owner requesting annexation the City is not
ob]igated to seek approval from the registered voters
of the City of Woodburn.
~B} The proposed annexation lies within the Urban. Growth
Boundary as identified in the City's adopted Comprehensive
P]an Map. Therefore a request for annexation is feasible.
(C} Adequate land presently exists to accomodate Commercial
development within the existing City Limits.
(D} The Annexation would reflect the land use designation
identified in the Comprehensive Plan Map for Commercial
use.
(E} The proposed site is contiguous in part to the existing
City Limits.
(F} The City has the capability to hand]e the water, sewer and
storm drain demands of the proposed uses as lone as specific
conditions are met by a potential developer.
Section 6. The City Administrator, or his designee, is hereby
directed to correct the Woodburn Zoning A1ap and City Limit boundary to the
classification and boundary change herein made.

At this time the City of Woodburn is processing your request for Annex-
ation a portion (Lot 2) of your property to the City of Woodburn. This
action would result in the conversion of Lot 2 from its existing Land
Use designation of EFV Exclusive Farm Usej by Marion County to a City
designation CR Commercial Retail) District. Enclosed is a map that
identifies, that property the City Council will consider for incorporation
into the City.
However, prior to the City carrying out this action, your response as a
property owner is required. This will assist the City in making a
determination as to whether or not to annex your property. Please answer
