Ord 1883COUNCIL BILL N0. $14 ORDINANCE N0. 1883 AN ORDINANCE RELATING TO THE IMPROVEMENT OF QUEEN CITY BOULEVARD FROM HARDCASTLE AVENUE INTO LEGION PARK APPROXIMATELY 550 FEET; PROVIDING FOR PRE-ASSESSMENT OF THE SUBJECT PROPERTIES AND CREATTNG AN ASSESSMENT DISTRICT; PROVIDING THE LENGTH OF TIME SATD IMPROVEMENT SHALL BE MAINTAINED BY THE CITY; ORDERING THE CITY RECORDER TO PROCEED WTTH THE ASSESSMENT PROCESS; AND DECLARTNG AN EMERGENCY. WHEREAS, Queen City Boulevard from Hardcastle Avenue into Legion Park approximately 550 feet is now an unimproved street within the City of Woodburn, and WHEREAS, Resolution No. 757 was passed to improve said street; and WHEREAS, a public hearing was duly noticed and held on August 13, 1984; and WHEREAS, remonstrances sufficient in number to prevent said improvement have not been received; NOW, THEREFORE, THE CITY OF WOODBURN ORDAT~S AS FOLLOWS: Section 1. That Queen City Boulevard from Hardcastle Avenue into Legion Park approximately 550 feet be improved pursuant to Resolution No. 757 proposing such improvement, and that this be done in accordance with plans, specifications, and estimates of the City Engineer. Section 2. That the cost of said improvement shall be at the expense of the property specially and peculiarly benefited by such improve- ment, all of which shall be in the assessment district established by Section 3 of this ordinance. Section 3. That the property specially and peculiarly benefited by such improvement and to be assessed therefore is hereby dee.l~ared to be all lots and parcels of land described in the Marion County Record PAGE 1 - COUNCIL BILL NO. That after utilizing the City resources for the storm drain work, the remaining portion of the street project including engineering, finance, administration and cul-de-sac improvement is estimated by the City Engineer as $81,328.00. The cost distribution to the benefited properties is outlined below: A. Distribution Method for Street Improvement Cost of $57,378.00. Seventy-five percent of the cost of street improvement ($57,378,00), including 50 foot Koffler right-of-way at Queen City Boulevard will be borne by the Queen City pro- perties and the remaining twenty-five percent will be distributed between Park property and the Koffler Avenue properties. The Koffler Avenue share being twenty-five PAGE 2 - COUNCTL BILL N0. 814 ORDINANCE N0. 1$$3 percent of the Queen City improvement cost from Hardcastle Avenue to Koffler Avenue and Park property share being twenty-five percent of the Queen City improvement cost from Koffler to Legion Park. The Queen City properties are estimated to pay $50.00 per front foot, the Koffler properties $9.00 per front foot and the Park properties share for the street improvement portion of the cost is estimated to be $5,130.00 B. Cost Allocation of $Z3 ,950.00 for Cul-de-Sac Improvement. The entire estimated cost of $23,950 which includes engineering, finance and administrative costs for the cul-de-sac improvement will be borne by the park property. However, the City will utilize $5,000.00 from federal funds to support the park share of the cost for the cul-de-sac improvement. Section 5. That the benefited property owners may pay their share of the remaining balance any time in a period not to exceed ten years. The yearly payments shall be 1/10th of the benefited share cost, plus interest, plus yearly handling charges. Section b. That the limit of time such improvement shall be maintained by the Gity of Woodburn is hereby fixed at fifteen years, Section 7. That the City Council finds that it is in the public interest to assess costs to the benefited property before the completion of the public improvement and, pursuant to Section 13, Ordinance No. 1879, a pre-assessment is hereby ordered in amounts based upon the estimate provided in Section 4 of this ordinance, Section 8, That the City Engineer is hereby authorized to call for and receive bids pursuant to 5ectzon 7, Ordinance No. 1$79. That the City Recorder is hereby ordered to mail notice of the pre-assessment amounts to the subject properties and schedule a public hearing pursuant to Section 9, Ordinance No, I8~9. Section lO. That the City Recorder is hereby ordered and authorized to proceed with the sale of bonds and/or the issuance of general improvement warrants to finance this project. Section 11.
