AN ORDINANCE RELATING TO THE IMPROVEMENT OF BRADLEY STREET FROM BROWN STREET
TO OGLE STREET; PROVIDING FOR PRE-ASSESSMENT OF THE SUBJECT PROPERTIES AND
CREATING AN ASSESSMENT DISTRICT; PROVIDING THE LENGTH OF TIME SAID IMPROVE-
MENT SHALL BE MAINTAINED BY THE CITY; ORDERING THE CITY RECORDER TO PROCEED
WITH THE ASSESSMENT PROCESS; AND DECLARING AN EMERGENCY.
WHEREAS, Bradley Street from Brown Street to Ogle Street is now
an unimproved street in the City of Woodburn; and
WHEREAS, Resolution No 756 was passed to improve said street; and
WHEREAS, a public hearing was duly noticed and held on August 13,
1984; and
WHEREAS, remonstrances sufficient in number to prevent said improve-
ment have not been received; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. That Bradley Street from Brawn Street to Ogle Street
be improved pursuant to Resolution No. 756 proposing such improvement, and
that this be done in accordance with plans, specifications, and estimates
of the City Engineer.
Section 2. That the cost of said improvement shall be at the
expense of the properties specially and peculiarly benefited by such improve-
ment, all of which shall be in the assessment district established by Section 3
of this ordinance.
Section 3. That ,the properties specially and peculiarly benefited
by such improvement and to be assessed therefore is hereby declared to be
all lots and parcels of land described in the Marion County Record of Deeds
as follows and having the following owners of record:

Section 4. That the City Engineer's cost. estimate including
engineering, finance, legal, administrative, and partl.ally completed Strom
drain is $.158,933,00. After the City has utilized resources from federal
revenue sharing and rehabilitation grant in the amounts of approximately
$24,500.00 from each source, the benefited cost of each property is estimated
to be $50.00 per Eton foot or a total of $11.3,790.00.
Section 5. That the benefited property owners znay pay their share
of the remaining balance at any time in a period not to exceed ten years.
The yearly payments shall be 1/10th of the benefited share cost, plus interest,
plus yearly handl~.ng charges.

Section 6. That the limit of time such improvement sha11 be
maintained by the City of Woodburn is hereby fixed at fifteen years,
Section 7. That the City Council finds that it is the public
interest to assess costs to the benefited property before the completion
of the public improvement and, pursuant to Section 13, Ordinance No. 1879,
a pre-assessment is hereby ordered in amounts based upon the estimate pro-
vided in Section 4 of this ordinance.
Section 8. That the City Engineer is hereby authorized to call
for and receive bids pursuant to Section 7, Ordinance No. 1$79.
Section 9. That the City Recorder is hereby ordered to mail notice
of the pre-assessment amounts to the subject properties and schedule a public
hearing pursuant to Section 9, Ordinance No. 1879.
Section 10. That the City Retarder is hereby ordered and authorized
to proceed with the sale of bonds andjor the issuance of general improvement
warrants to finance the project. '
Section 11. This ordinance being necessary for the immediate
preservation of the public peace, health, and safety, an emergency is
declared to exist and this ordinance shall take effect immediately upon
passage by the Council and approval by the Mayor.
