Ord 1890COUNCIL BILL No. 824 ORDI~JANCE No. 1890 AN ORDI~JANCE RECLASSIFYING CERTAIN PROPERTY LOCATED WEST OF THE "OLD" SEWAGE TREATMENT FACILITY ON THE CITY of WOODBURN'S COMPREHENSIVE PLAN MAP FROM A PUBLIC USE DESIGNATION TO INDUSTRIAL. WHEREAS, the Woodburn Comprehensive Plan Map made pursuant to said ordinance and heretofore established this property for Public Use within the City of Woodburn, and WHEREAS, the Woodburn Zoning Ordinance Map made pursuant to said ordinance and heretofore established this property for Industria] Use, and WHEREAS, a conflict of land use designation exists between the Comprehensive Plan and Zoning Ordinance Maps, and WHEREAS, proceedings have been had before the ~Joodburn Planning Commission and the City Council to amend the Comprehensive Plan Map to Industrial in accordance with Chapter 3 of the Woodburn Zoning Ordinance, and WHEREAS, the City Council of the City of Woodburn deems this re- classification to be in keeping with the Comprehensive Plan evaluation criteria, and WHEREAS, the City Council finds that it would be in the public inter. st to allow certain uses as permitted on the subject parcel, and WHEREAS, the following findings of fact have been concluded: The applicants property has rail and highway access, a necessity for many Industrial uses. The proposed amendment would be in keeping with the Indus- trial Goals and Policies of the Comprehensive Pian. Page 1 - COUNCIL BILL No. 824 ORDINANCE No. 1890 The Recreation and Parks acquisition priorities have been revised by pursuing the purchase of other Park- land sites. Historically the City's Zoning Maps have identified the applicants property for Industrial use. No evidence is available that would conclude the Plann- ing Commission or City Council amended the Zoning from Light Industrial to Parks and Open Space. The Comprehensive Plan Map amendment would result in additional lands being added to contiguous Industrial designated properties in the Downtown area. By excluding the applicants property from the Parkland inventory there still exists sufficient land X22 acres) to realize expansion if funds are available. The Recreation and Parks Board has recommended the Open Space and Parks designation be removed from the appli- cants property. THE CITY OF WoODBURN ORDAINS AS F0ILOWS: Section 1. The following described property within the City of Woodburn, Marion County, State of Oregon, is hereby reclassified on the Woodburn Comprehensive Plan Map from Public Use to Industrial use, said classification being based on the findings outlined above together with the relevant findings contained in the staff report: Lots Four (4) and Five ~5), Ocobock's Addition to Wood- burn, in Marion County, State of Oregon. SAVE AND ExCEPT: That portion ,conveyed to the City of Woodburn by deed recorded January 28, 1963 in Volume 568, Page 217, Deed Records for Marion County, Oregon. ALSO SAVE AND EXCEPT: That portion conveyed to the City of Woodburn by deed recorded August 15, 1952 in Volume 442, Page 525, Deed Records for Marion County, Oregon. ALSO SAVE AND EXCEPT: That portion conveyed to J. L. Shinn and P. A. Shinn by deed recorded August 29, 1975 in Reel 23, Page 1432, Marion County Records. ALSO SAVE AND EXCEPT: That portion conveyed to Louis C. Berninq and Elsie Berning recorded June 10, 1977 in Reel 84, Page 975, Marion County Records. Page 2 - COUNCIL BILL No. 824 ORDINANCE No.1890 Section 2. The City Administrator is hereby directed to correct the Woodburn Comprehensive Plan Map to the classification herein made.
