CONVENED The meeting convened at 7:00 p.m. with Council President McCallum. presiding. The motion passed unanimously. 99E Corridor Citizen Advisory Committee: Rob Corney and Bruce Crane (replacement for Heidi Bishop who is unable to serve) for the duration of the committee. Lonergan /Cox....approve the appointments. The motion passed unanimously. 0:00 COMMUNITY /GOVERNMENT REPORTS A. Chamber of Commerce — Don Judson, Executive Director of the Woodburn Area Chamber of Commerce updated the Council on upcoming Chamber events. B. Woodburn School District — David Bautista, Superintendent of the Woodburn School District provided an update on School District events and achievements. C. Ian Niktab provided an update on the Woodburn Community Garden. 0:14 PRESENTATIONS A. Aquatic Center — JP Moss of Swim Essentials provided an update on the Aquatic Center project. B. Gurcharah Singh of 4520 SW Anderegg Loop, Portland expressed concern about a police traffic stop in Woodburn. Chief Russell will investigate and follow up with Mr. Singh 0:57 CONSENT AGENDA A. Approve the Woodburn City Council minutes of February 14, 2011, B. accept the Woodburn Recreation and Parks Board minutes of February 8, 2011, C. accept the Crime Statistics report for January 2011, D. recommend that OLCC approve a Liquor License Change of Ownership application for Chu's Eatery II, E. recommend that OLCC approve a Liquor License Application - Off - Premises Sales for Walgreens #12095, and F. recommend that OLCC renew Liquor Licenses for listed businesses for 2011. Cox/Lonergan... adopt the Consent Agenda. The motion passed unanimously. 1:05 COUNCIL BILL NO. 2857 — AN ORDINANCE ENTERING INTO AN AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT FOR THE REGIONAL AUTOMATED INFORMATION NETWORK; AUTHORIZING THE CITY ADMINISTRATOR TO SIGN SAID AGREEMENT; AND DECLARING AN EMERGENCY Lonergan introduced Council Bill 2857. Recorder Shearer read the two readings of the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Council President McCallum declared Council Bill No. 2857 duly passed. 1:06 COUNCIL BILL NO. 2858 — A RESOLUTION APPROVING A CONTINGENCY TRANSFER AND ADOPTING A SUPPLEMENTAL BUDGET FOR THE GENERAL FUND AND GENERAL FUND CAPITAL IMPROVEMENT FUND FOR FY' 2010 -11 Lonergan introduced Council Bill 2858. Recorder Shearer read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Council President McCallum declared Council Bill No. 2858 duly passed. 1:09 AWARD OF CONSTRUCTION CONTRACT FOR THE FIFTH STREET IMPROVEMENTS PROJECT Cox /Pugh... City Council, acting as the Local Contract Review Board, award a construction contract for the Fifth Street Improvements project to M.L Houck Construction Co. in the amount of $957,093.86. Councilor Schmidt asked several clarifying questions regarding the design specifications. Councilor Lonergan pointed out that the contract represents a significant savings over the engineer's estimate. Councilor Lonergan also asked about the contract delivery schedule. Motion passed 5 -1 with Councilor Schmidt voting no. Councilor Morris inquired whether this additional workload is feasible with our existing staff. The motion passed unanimously. 1:23 GRANT OF PUBLIC ACCESS AND UTILITY EASEMENT OVER "BLOCK A, 1' STRIP" AT LANDAU ESTATES SUBDIVISION, WOODBURN Cox/Pugh... authorize the City Administrator to sign a public access and utility easement or other such other documents that may be required over the City owned parcel described as BLOCK "A" 1' Strip as shown on Landau Estates Plat, City of Woodburn, OR (Tax Lot 051 W 17BD02500). The motion passed unanimously. 1:27 CITY ADMINISTRATOR'S REPORT A. City Administrator Derickson reported on City staff legislative contacts. B.
