ORDINANCE NO. 1927
AN ORDINANCE ANNEXING AND RECLASSIFYING CERTAIN PROPERTIES LOCATED
WEST OF AND ADJACENT TO NORTH FRONT STREET AND EAST OF THE WOODBURN
HIGH SCHOOL PROPERTY FROM MARION COUNTY RESIDENTIAL AGRICULTURE USE
TO WOODBURN IL (LIGHT INDUSTRIAL) CLASSIFICATION.
WHEREAS, The Woodburn Comprehensive Plan Map has established
certian use zones within the City of Woodburn's Urban Growth Boundary;
and
WHEREAS, annexation and zone change proceedings have been
held before the Woodburn Planning Commission and City Council in accor-
dance with ORS 222,120, 222.170 and 222.180 and Chapters 7 and 15 of
the Woodburn Zoning Ordinance; and
WHEREAS, notice was duly given and the consent of the requi-
site number of land owners obtained so that annexation could be completed
without the calling of an election; and
WHEREAS, the City Council deems the classification IL (Light
Industrial District) to be in the public interest, in satisfaction
of a general public need, and is in accord with the Comprehensive Plan,
NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. The following described property ~vithin the City
of Woodburn's Urban Growth Boundary, ~1arion County, State of Oregon,
is hereby annexed into the City of Woodburn and reclassified from Marion
County Residential Agriculture Use to City of Woodburn IL (Light
Industrial):

Beginning at the Northeast corner of the Benjamin
F. Hall Donation Land Claim in Township 5 South,
Range 1 West of the Willamette Meridian, P~larion
County, Oregon; and running thence South 69° 56'
East 387.30 feet to a point i n the center of Market
Road No. 70; thence North 41° 15' East, along said
centerline 169.00 feet to a point; thence North
49° 05' West 505.50 feet to a point in the West
line of the Jackson Cooley Donation Land Claim
in said township and Range; thence South 16° 00'
West, along said West line 338.36 feet to the point
of beginning.
SAVE AND EXCEPT that portion deeded to the City
of 6Joodburn for road~vay by instrument recorded
in Book 715, Page 506, and Fee No. 38891.
Section 2. This action is taken based upon the staff report
which is attached hereto and, by this reference, incorporated herein.
Section 3. The City Administrator is hereby directed to
correct the 4Joodburn Zoning Map and City Limit Boundary to the classifi-
cation and boundary change herein made.

STAFF REPORT
ANNEXATION #85-01
1. INTRODUCTION: ~II
The applicant, United Disposal Service, is requesting annexation of - - ')J
2..48 acres of property located adjacent to North Front Street, adjacent
to and generally Northeast of the Woodburn Senior High School property.
2. GENERAL INFORMATION:
(A) State Statutes
When initiating annexation of property, the City must follow specific
state statutes throughout the hearings process as required. Specifi-
cally, the annexation requires a public vote unless a majority of the
landowners own more than half of the land and their property represents
more than half of the assessed value. Because the applicant in this
case is the only owner, and because that owner is requesting annexa-
tion, the annexation need not go before the registered voters. How-
ever, it must be reviewed and approved through the City's hearings
procedures.
(B) The property•is located within the current city limits and has
existed as an•unincorporateri "island" surrounded by incorporated
property. See attached Exhibit A.
(C) The annexation and attendent rezone would reflect the land use
designation identified in the Comprehensive Plan Map.
3. RECOMMENDATIONS:
Staff recommends approval of the applicant's request for annexation
based on the following:
(A) Because the parcel is completely surrounded by incorporated
property, annexation will improve the boundary configuration and pro-
vide more consistency for jurisdiction over this area.
(B) Annexation and the attendent rezoning from Residential to Light
Industrial will bring the parcel into compliance with the City of
Woodburn's Comprehensive Plan.
(C) Annexation will provide an additional 2.48 acres of Light In-
dustrial property in a location favorable to the overallyeconomic de-
velopment of this section of the City.
STAFF REPORT
ZONE CHANGE #85-02
1. INTRODUCTION:
The applicant requests a-zone change from Marion County's designation of
"residential use"to the City of Woodburn's "Light Industrial" zoning classi-
fication. This zone change is in conjunction with and contingent upon the
city's annexation of this property. See attached Exhibit A.
2. GENERAL INFORMATION:
A. The applicant's property consisting of 2.48 acres is being con-
sidered for annexation. Annexation and rezoning will add 2.48
acres of industrial property to the City's current inventory of
Light Industrial land.
B. One single family house belonging to the applicant currently occupies
this property. The applicant has informally proposed to expand his
waste disposal operation to this site with provision for recycling
services.
C. The City is capable of meeting the water, sewer, and storm drain
demands of the proposed uses as long as the developer meets the
conditions to be specified through the site plan approval process.
3. RECOMMENDATIONS:
Staff recommends approval of this application based on the following:
A. Rezoning will provide an additional 2.48 acres of Light Industrial
property in a location favorable to the overall economic develop-
ment of this section of the City.
B. The applicant has requested annexation and rezoning in order to
expand an existing local recycling and refuse business, the United
Disposal Service. This use is appropriate to the area and consis-
tent with the permitted uses for a light industrial zone.
C. The rezone would reflect the land use designation identified in the
Woodburn Comprehensive Plan Map.
