AN ORDINANCE AMENDING THE COMPRENENSIVE PLAN ~9AP AND RECLASSIFYING
CERTAIN PROPERTY LOCATED ADJACENT TO AND ON THE SOUTH SIDE OF STATE
HIHGWAY 214 FROP~i RM (MULTI-FAt4ILY RESIDENTIAL) AND "OPEN SPACE AND
PARKS" TO PC (PUBLIC USE - CEMETERY) AND "OPEN SPACE AND PARKS" AND
DECLARING AN EMERGENCY.
YIHEREAS, the Woodburn City Council has reviewed the record
in Comprehensive Plan and Zone Change Case No. 85-04, and considered
the public testimony previously presented; now, therefore
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. The involved real property designated as Lot A is
described by the map attached to this ordinance and labeled Exhibit "R".
Section 2. The Comprehensive Plan designations of said real
property are hereby amended from its present ~9ulti-Family and Open Space
and Parks to Public Use and Open Space and Parks designations.
Section 3. The Zoning designation of said real property is hereby
reclassified from its present designation of P,esidential Plultifamily to
PC (Public and Private Cemeteries).
Section 4. The Comprehensive Plan and Zone reclassification of
said real property are based upon the staff report related to this pro-
perty dated January 2, 1986 and specifically the findings and conclusions
contained in the staff report that is attached hereto as Exhibit "B" and
b,y this reference incorporated herein.
Section 5. The Comprehensive Plan Zoning amendments are subiect
to the conditions as contained in Exhibit "B", attached hereto and inr_or-
porated herein, that the Council has found reasonable.
Section 6. The City Administrator or his designee is hereby dir-
ected to correct the 6~Joodburn Comprehensive Plan and Zoning ~1ap to the
Classification herein made.

Section 7. This ordinance being necessary for the immediate
preservation of the public peace, health, and safety, an emergency is
declared to exist and this ordinance shall take effect immediately upon
passage by the City Council and approval by the Mayor.

Findings and conclusions from staff report for Comprehensive Plan and
done Change No. 85-04:
1) The subject property is an extension of an existing cemetery adjoin-
ing property zoned from Multi-Family Residential use. For this rea-
son, a rezone of the subject parcel would not create any different
juxtaposition.
2) The Woodburn Comprehensive Plan designates this parcel as both Open
Space and High Density Residential.
3) The plan amendment change from Residential to Public Use would remove
approximately .5 acres from the City's inventory of developable resi-
dential land. However, its potential for residential development can
be seriously doubted because the adjacent property owner, who most
logically would hold an interest in developing the half acre, voluntari-
ly donated the property for cemetery use.
4) The Northern most part of this parcel lies within the 100 year flood
plain; making it suitable for neither residential nor cemetery use.
Condition for approval as contained in staff report for Comprehensive Plan
and 7_one Change No. 85-04:
That no grave sites be established nor any
other material use be made of that portion
of the property lying within the flood plain
as sho~Nn on the Marion County Floodway Boun-
dry Map.

AN ORDINANCE PROPOSING A LEVY OF TAX OUTSIDE THE T,TMTTATION II~OSED BY
ARTICLE XI, SECTION 11, SUBSECTION (1) OF THE OREGON CONSTITUTION AGAINST THE
TAXABLE PROPERTY IN THE CITY OF WOODBURN IN THE AMOUNT OF $930,157 FOR THE
FISCAL YEAR 1986-87; AUTHORIZING THE EXPENDITURE OF MONIES DERIVED THEREFROM FOR
THE BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 1986; CALLING FOR A SPECIAL
ELECTION AT WHICH SUCH LEVY OF TAX SHALL BE SUBMITTED TO THE LEGAL ELECTORS OF
THE CITY OF WOODBURN; AND DECLARING AN EI~RGENCY.
THE CITY OF WOODBURN ORDAINS AS FOLSIJVJS
Section 1. That the City Council of the City of Woodburn hereby
propose a levy of tax outside the limitation imposed by Article XI, Section 11,
Subsection (1) of the Oregon Constitution in the amount of $930,157 for the
fiscal year 1986-87 for the purpose of applying said sum to the budget for the
fiscal year 1986-87.
Section 2. That the proposed levy of tax shall be submitted to the
legal electors of said City at a special election on March 25, 1986, which is
hereby called to be held therein in accordance with the laws of the State of
Oregon and the Charter of said City governing elections.
Section 3. That the form in which said questions shall be submitted
to the electors of said City on the official ballot at such special election
shall be as follows: (see attached Exhibit A).
Section 4. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emen~ency is declared to
exist and this ordinance shall take effect immediately upon passage by the
Council and approval by the Mayor.

Measure No. 51
AUTHORIZATION FOR ONE-YEAR OPERATING LEVY
QUESTION: Shall the City of Woodburn levy $930,157 outside the tax base to
finance city operations during 1986-87?
EXPLANATION: The City's tax base for fiscal year 1986-87 is $130,863, therefore,
it is necessary to request a one-year tax levy to provide for the continuation
of city services in the General Fund, Street Light Fund, and Transit Fund.
A sLmm~ary of taxes requested in this measure is as follows:
General Fund $792,569
Street Light Fund 82,478
Transit Fund 55,110
$930,157
The General Fund provides funding for Police and Emergency Dispatch services,
Senior Programs, Municipal Court, City Attorney's office, Administration, and
City Hall maintenance. The level of services within the General Fund, except
for the Finance Department which is budgeted for at a reduced level, are the
same as provided to the community during the current fiscal year.
This measure will also provide for street light operational costs and the
continuation of six-day bus service within the community.
