ORDINANCE N0. 1943
AN ORDINANCE AMENDING ORDINANCE N0. 1616 (THE NUISANCE ORDINANCE) AND
DECLARING AN Eh1ERGENCY.
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Section 53, Ordinance No. 1616 is hereby amended to
read as follows:
Section 53. Separate Violations.
(1) Each day's violation of a provision of this
ordinance constitutes a separate offense.
(2) The abatement of a nuisance is not a penalty
for violating this ordinance, but is an additional remedy.
The imposition of an assessment does not relieve a person
of the duty to abate the nuisance; however, abatement
of a nuisance within three working days of the date
of notice to abate, or if a written protest has been
filed, then abatement within 72 hours of the court's
determination that a nuisance exists, will relieve the
person responsible from the imposition of a penalty
under Section 47 of this ordinance.
Section 2. This ordinance being necessary for the immediate
preservation of the public peace, health, and safety, an emergency is declared
to exist and this ordinance shall take effect immediately upon passage by
the Council and approval by the Mayor.
