ORDINANCE NO. 1951
AN ORDINANCE LEVYING THE FINAL ASSESSMENT FOR THE IMPROVEMENT OF
QUEEN CITY BOULEVARD FROM HARDCASTLE AVENUE INTO LEGION PARK
APPROXIMATELY 550 FEET AND DECLARING AN EMERGENCY.
WHEREAS, Ordinance No. 1891 and 1896 levied pre-assessment
costs to each benefited property within the assessment district created
for the improvement of Queen City Boulevard; and
WHEREAS, the project has been completed and final project
costs have been determined to be less than the original engineering
estimates; and
WHEREAS, Section 15 of Ordinance 1879 provides that
assessment rebates shall be declared by ordinance and entered on the
lien docket as a credit. If an assessment has been paid, the person
who made the payment or that person's legal representative shall be
entitled to payment of the rebate credit; now, therefore,
THE CITY OF WOODBU.RN ORDAINS AS FOLLOWS:
Section 1. That the final assessment costs levied against
the fallowing property, being representative of the special and
peculiar benefit derived from the improvement, are determined to be
less than the pre-assessments levied on said property based upon front
footage:

Section 2. That the rebate credit for each parcel of
property listed in Section 1 of this ordinance be entered into the
City lien docket. If an assessment account has been paid in full, the
person who made the payment or that person's legal representative will
receive the rebate credit payment.
Section 3. That the City Recorder be directed to
recalculate each assessment account to determine revised principal and
interest allocations based on payments made to each account. If an
account has been paid in full, interest earnings at the rate of five
and one-half percent (5.5%) shall be calculated from the date of final
payment on the assessment account to the date of passage of this
ordinance and will be in addition to the payment of the rebate credit.

Section 4. This ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist and this ordinance shall take effect
immediately upon passage by the Council and approval by the Mayor.
