Agreement. The previous UGB agreement was mutually approved and adopted by both jurisdictions in 1979 (See Attachment I). Since adoption, State laws, dissolution of the Boundary Commission and exper- ience in working with the existing agreement have resulted in proposals to amend the existing ordinance to meet the current changes. Attach- ment II is the program proposed by the County. 2) URBAN GROWTH BOUNDARY: At this time goals and policies relating to the UGB are not incorporated in the City's Comprehensive Plan. However, they are found in the current UGB City/County Ordinance Agreement. Basically the UGB represents the land area outside the Woodburn city limits that is expected to be annexed over a period of approximately 15 years. This being the objective it is advantageous for the City to have some control over the development, in this area, to insure those uses do not conflict with existing and future City land uses. 3) APPLICABLE STATE LAWS: When amending a Comprehensive Plan or one of its imple menting ordinances, specific State-wide land use goals must be observed. In the case of this request those goals and guidelines identified in Goal 14 (Urbanization) must be followed. The joint City/County Agreement, in staff's opinion, meets those standards. Oregon Rbyised.Statutes 197 identifies the goals to be observed when amending Comprehensive Plans and implementing ordinances specifically Goal I (Citizen Involvement) and Goal 2 (Land Use Planning). Both of these are addressed in the City's public hearing and citizen participation p.rdcedures. 4) FINDINGS: Based on the text of the proposed Agreement (Attachment II) A) Marion County is requesting the City of Woodburn in cooperation with the County amend the existing Urban Growth Policy Agreement (Ordinance No. 1687). 6) Oregon State Statutes (ORS) 197 requires that a UGB be established around each incorporated city. C) QRS 197 provides the authority to carry out governmental agreements of mutual cooperation. D) To be consistant with State Law there must be mutual agreement between both the City and County. - 1 - CBI ~ ..B.. E) As Woodburn experiences growth in terms of population and land utilization, growth must be regulated to insure orderly develop- ment. F) Regulation of the Urban Growth Boundary is found to be necessary to preserve the desirability of Woodburn as an attractive place to live. 5) RECOF~IENDATION: It is recommended the Planning Commission/City Council approve the proposed agreement. CONDITION OF APPROVAL: It is recommended the Urbanization Policies 1-8 identified in Attach- ment II, Pg. 2 & 3 be incorporated into Volume I policies section of the City's Comprehensive Plan. - 2 - ~IIBIT "B'•
