ORDINANCE N0. 1984
AN ORDINANCE LEVYING PRE-ASSESSMENTS FOR THE IMPROVEMENT OF WATER AND SEWER
SERVICES TO NORTH FRONT STREET PROPERTIES, AND DECLARING AN EMERGENCY.
WHEREAS, a petition received from property owners of the affected
area requesting water and sewer improvements resulted in the City Council's
intiation of a Local Improvement District process and adoption of the method of
assessment as declared in Resolution No. 818 and Resolution No. 825; and
WFIEREAS, a public hearing was held on September 22, 1986 to receive
input from affected property owners and in receiving an insufficient number of
remonstrances to prevent the improvement, Ordinance No. 1961 was passed
creating an assessment district and authorizing pre-assessments; and
WHEREAS, the proposed pre-assessment to each benefited property has
been based on its special and peculiar benefit from the said improvement
utilizing a combination of front foot and area method as outlined in Ordinance
No. 1961; and
WHEREAS, notice of each proposed pre-assessment was mailed to the
owner of each lot proposed to be assessed at the address shown on the Marion
County Tax Assessor's rolls; and
WHEREAS, the notice stated the amount of the pre-assessment proposed
and set July 27, 1987, 7:30 p.m., as the date and time set for a public hearing
at which the Council would hear objections to the pre-assessment amounts; NOW,
THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. That pre-assessments are hereby levied against the
following property in the amounts listed, those amounts being representative of

the special and peculiar benefit which will be derived from the improvement to
each specific property, the pre-assessment being based upon:
(A) Water: Fifty percent of the cost shall be assessed using the front
foot method and the other fifty percent of the cost shall be assessed
using the area method of assessement. The area below the flood plain
contour elevation 154 will not be considered as being benefited
property. The total assessable cost will be the summation of front
foot cost plus the area method cost. With the modified alignment,
the property located on the north side of Country Club and west of
Mill Creek is considered to receive similar benefit as the south side
property.
(B) Sewer: The entire cost of the project will be assessed using the
area i.e. acreage above the flood plain contour elevation 154 feet.

Section 2. That the City Council finds that an interest rate not to
exceed one percent (1%) above the estimated net effective rate of the bond
sale, with the rate to be determined at the time the bonding applications are
signed.
Section 3. The City Recorder is hereby ordered to send notices of
the pre-assessments levied by this ordinance pursuant to Ordinance No. 1879.

Section 4. This ordinance being necessary for the immediate
preservation of the public peace, health, and safety, an emergency is declared
to exist and this ordinance shall take effect immediately upon passage by the
Council and approval by the Mayor.
