Ordinance 2007COUNCIL BILL N0. 1116 ORDINANCE N0. 2007 AN ORDINANCE AMENDING ORDINANCE 1998 (THE CIVIL INFRACTION ORDINANCE) AND DECLARING AN EMERGENCY. WHEREAS, violations of city nuisance, building, mechanical, plumbing, and zoning codes affect the livability of the 6oodburn community; and WHEREAS, the Woodburn City Council has publicly stated that the city should take a more vigorous approach to enforcement of these codes; and WHEREAS, the Woodburn City Council passed Ordinance 1998, a streamlined civil infraction procedure to enforce city ordinance violations; and WHEREAS, experience with Ordinance 1998 has demonstrated that several minor amendments are needed to improve this procedure; NOW, THEREFORE, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. Section 2(A)(4) of Ordinance 1998 is amended to read as follows: The complaint shall contain a form of certification that the person signing the complaint states that the person has reasonable grounds to believe, and does believe that the person cited committed, or permitted to be committed, the infraction. follows: Section 2. Section 5 of Ordinance 1998 is amended to read as Schedule of Forfeitures. A Infractions as classified for the purpose of determining forfeitures in the following categories: (1) Class 1 civil infractions. (2) Class 2 civil infractions. (3) Class 3 civil infractions. (4) Class 4 civil infractions. (5) Class 5 civil infractions. (B) An assessment of a forfeiture for an infraction shall be an assessment to pay an amount not exceeding: (1) $500.00 fora class 1 civil infraction. (2) $250.00 fora class 2 civil infraction. (3) $100.00 fora class 3 civil infraction. Page 1 - COUNCIL BILL N0. 1116 ORDINANCE N0. 2007 (4) $50.00 for a class 4 civil infraction. (5) $25.00 for a class 5 civil infraction. (C) Infraction of specific Woodburn ordinances are classified as follows: Ordinance PJo. Section 3. This ordinance being necessary of the public peace, health and safety, an emergency and this ordinance shall take effect immediately upon and approval by the h1ayor.
