Ordinance 2030COUNCIL BILL N0. 1175 ORDINANCE N0. 2030 AN ORDINANCE VACATING APJ EXISTING PUBLIC RIGHT-OF-WAY FOR STACY ALLISON WAY IN EXCHANGE FOR THE DEDICATION OF A PUBLIC RIGHT-OF-WAY FURTHER SOUTH ON THE SAf~IE REAL PROPERTY AND THE ACCEPTANCE OF A DRAINAGE EASEMENT AfdD DECLARIPJG AN Ef~iERGENCY. WHEREAS, the Woodburn City Council held a public hearing on September 11, 1989, and 4JHEREAS, the Deputy City Recorder has issued a certificate stating that all City liens and taxes have been paid on the easement, right-of-way to be vacated, and right-of-way to be dedicated, and WHEREAS, the Woodburn City Council found that the proposed right-of-way for Stacy Allison Way is more appropriately located than the present right-of-tivay and that the dedication of the proposed right-of-vray would eliminate the need for the present right-of-way, and WHEREAS, the acceptance of the easement for drainage would benefit the City, NOW, THEREFORE, THE CITY OF WOODBURP! ORDAINS AS FOLLOWS: Section 1. The City of toodburn hereby accepts the dedication of the following described right-of-way for Stacy Allison 4Jay: beginning at a point which is 1679.10 feet South 88°52'10" East and 595.00 feet South Ol°07'50" West from the Northwest corner of the Andrew Dubois Donation Land Claim No. 98, in Section 12, Totivnship 5 South, Range 2 West of the Willamette f1eridian, P1arion County, Oregon; point of beginning is on the West right-of-way line of Lawson Street; thence South O1°07'50" West 185.10 feet; thence South 88°52'10" East 450.02 feet to the West right-of-way line of Evergreen Road; thence along the Westerly line of said Evergreen Road, North 00°52'50" East 60.00 feet; thence North 88°52'10" West 389.75 feet to the easterly extension of Lawson Street; thence North O1°07'50" East along extension line, 125.10 feet; thence North 88°52'10" West 60.00 feet to the place of beginning. The City of Woodburn hereby accepts the dedication of the following described drainage easement: An easement for utility purposes described as follows: beginning at a point which is 1679.10 feet South 88°52'10" East and 780.10 feet South O1°07'50" West from the Northwest corner of the Andrew Dubois Land Claim No. 98, in Section 12, Township 5 South, Range 2 West of the Willamette Meridian, ~1arion County, Oregon; thence North 88°52'10" Jest 1121.00 feet to the Easterly right-of-way line of Frontage Road; thence North 35° 50'00" East 72.98 feet; thence South 88°52'10" East 1079.45 feet to the West line of Lawson Way extended; thence South Ol°07'50" West 60 feet to the point of beginning. Section 3. The City of Woodburn vacates the follo~ving right-of-way effective upon receipt by the City of 4oodburn of fully executed deed for the right-of-way dedicated to the City as described in Section 1 above, and the drainage easement dedicated to the City as described in Section 2 above. Beginning at a point which is 1739.10 feet South 88°52'10" East and 535.00 feet South 01°07'50" West from the Northwest corner of the Andrew Dubois Donation Land Claim No. 98, in Section 12, Township 5 South, Range 2 West of the Willamette Meridian, P9arion County, Oregon; point of beginning is on the East right-of-way of Lawson Street; thence South 88°51'28" East 389.93 feet to a point on the 4Jesterly right-of-way line of Evergreen Road; thence South 0°51'41" West 60 feet; thence North 88°51'28" West 488.43 feet to the East right-of-vray of Lawson Street; thence North 01°07'50" East 60 feet to the point of beginning. Above description is a portion of right- of-way conveyed to the City of Woodburn by deeds recorded in Reel 592 page 237; and Reel 592 page 238, Marion County Deed Records. Section 4. The Deputy City Recorder is hereby directed to file the deeds with the County Clerk and a certified copy of the ordinance along with a map, plat or related record with the County Clerk, County Assessor and County Surveyor. Section 5.
