Res 1943 - Deferring SDC charges for Single Family ResCOUNCIL BILL NO. 2793 RESOLUTION NO. 1943 A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO IMPLEMENT A PROGRAM TO PROMOTE ECONOMIC DEVELOPMENT BY DEFERRING THE COLLECTION OF SYSTEM DEVELOPMENT CHARGES FOR SINGLE FAMILY RESIDENTIAL DWELLINGS WHEREAS, there has been a significant economic downturn in the economy and the building industry has been greatly impacted by this downturn and by the difficulty of obtaining loans for construction; and WHEREAS, City ordinances have always required that Systems Development Charges ("SDC's") be collected at the time of the issuance of a building permit; and WHEREAS, in order to help offset costs associated with construction, the City Council wants to establish a program to promote economic development by deferring the collection of SDC's for the construction of single-family residential dwellings until the time that an occupancy permit is issued by the City; and WHEREAS, the City Council has amended the applicable City ordinances to allow for the payment of SDC's pursuant to a City approved installment or deferral program; and WHEREAS, the City Council has the policy making authority to create this program; and WHEREAS, the City Administrator has the administrative authority to implement said program, NOW, THEREFORE THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. The City Council hereby establishes a program to promote economic development by deferring the collection of SDC's for the construction of single-family residential dwellings until the time that an occupancy permit is issued. Section 2. The City Administrator shall cause necessary forms to be created for the implementation of this program. Section 3. The City Administrator shall further cause safeguards to be implemented to insure that the deferred SDC's are paid to the City before building occupancy. Such safeguards shall include the provision for property liens, penalties, and the provision utility shut-off as provided by law.
