There will be a parade, family and cultural activities, mariachis,
food, games, and prizes. There will be activities both days from
10 a.m. to 9 p.m. with the main event, Celebration of Grito, at 5
p.m. on the 16th.
C. The Recreation and Parks Board meeting is moved to
September 18 at 7 p.m. in the Council Chambers.

Dear Mayor Figley:
Congratulations on your successful application for the above-referenced project! You will be receiving a grant for
$300,000 from the Community Development Block Grant program. This program, administered by the Oregon
Economic and Community Development Department (OECDD), provides grant funds to cities and counties to
upgrade public infrastructure, develop community facilities and provide essential services to the workforce and your
citizens.
Please note that the legal obligation for funding is subject to execution of a contract between your jurisdiction and the
state acting by and through the Oregon Economic and Community Development Department. Contract documents
will be sent to you shortly for your review and signature. For your convenience, we have enclosed the Grant
Management Handbook that explains how to manage the project in accordance with the requirements of the
Community Development Block Grant Program.
Project funds cannot be obligated or spent for any activity until a contract has been executed and the environmental
review process described in Chapter 3 of the Grant Management Handbook has been completed for each activity.
Once a contract has been executed, grant administration and engineering are exempt from environmental review and
can be started as soon as your Certifying Officer completes a Finding of Exemption for those two activities.
We encourage you to expand public awareness of your project's purposes and benefits through events and the media.
Please notify your Oregon Economic and Community Development Department Regional Coordinator of any event
celebrating your project.

0024 ANNOUNCEMENTS.
A) Music in the Park: Molly's Revenge will be performing on August 14,2007,
Golden Bough on August 21, 2007 and The Dukes of Juke will perform on August 28,
2007 in Library Park with performances beginning at 7:00 p.m..
B) North Front Street Playground Project: Community Services Department is
recruiting volunteers to help build a new playground at North Front Street Park on
Saturday, September 8, 2007. The project will begin at 8:00 a.m. and work should be
completed by mid-afternoon. Mayor Figley stated that the project is similar to the
KaBoom! project completed last year at Nelson Park and, as participant in last year's
project, she felt that it was very inspiring to see the project go from a pile of materials to a
playground within a few hours. Individuals interested in volunteering are asked to
register with the Community Services Department.
0053 CHAMBER OF COMMERCE REPORT.
Don Judson, Interim Executive Director, stated that the Chamber has experienced some
staff changes with the loss of Kim Geiger, Office Assistant, at the beginning of July, and
Nick Harville, Executive Director, at the end of July. He stated that he took over the
interim position since (l) he enjoys building an organization out of nothing or to take
something that is good and making it better, and (2) his wife had previously worked for
the Chamber for 5 years and she has decided to help him at the Chamber office. He felt
that the Chamber has some challenges ahead of them but they are having to look at
reorganization. During his interim, items to be focused on include:
1) return the Chamber to a sound financial footing;

2) focus on more member-driven activities such as business member net-working; and
3) the need for the Chamber to be a better partner on tourism.
He stated that Mr. Harville did a great job in making everyone aware that Woodburn is
becoming a tourist mecca with various tourist attractions in the surrounding area. The
City has provided grant funds over the past several years for tourism but not all costs are
easy to quantify for grant accounting. He stated that he would be suggesting that a
separate accounting entity be established which would employ people to work with
attractions and festivals to make the visitor's center more successful, run the center when
volunteers are not available, and pay for tourism memberships. This entity would also
apply for the City's tourism grant funds rather than the Chamber applying for the funds.
He stated that he would like to help the Chamber get a future plan and a two-year budget
in place while he is Interim Director.
Mr. Judson also stated that he has learned that a member ofthe Council has been
organizing the Chamber Forum for 20 years and, in recognition, he presented Councilor
Pete McCallum with a plaque in appreciation for his service to the Chamber.
Upcoming Chamber activities are as follows:
1) Ribbon cutting at Woodburn Pet Hospital on Friday, August 11\ at 4:30 p.m.;
2) Greeters beginning on September 7th at Woodburn Independent, and
3) Chamber Forum on September 19th.
Mayor Figley expressed her appreciation to the Chamber for the work they have done
which includes the Visitor Center at Woodburn Company Stores.
Councilor McCallum also thanked the Chamber for the recognition award.
0312 WOODBURN SCHOOL DISTRICT REPORT.
Walt Blomberg, School Superintendent, stated that he is a member of the Chamber Board
and was glad to have Mr. and Mrs. Judson in the Chamber office to keep it operational.
The School year will begin on September 4, 2007, however, during the summer months,
the district hired 50 new staff members a majority of which filled positions vacated by
staff members who have retired or elected not to return to Woodburn this year. He also
announced the selection of 3 Principals, 4 Assistant Principals, and 2 Directors (Student
Services and Bi-lingual Services) to fill vacant positions. It was noted that 7 out of these
9 positions were filled by individuals currently on staff at the School District. He stated
that the School District has a number of goals but over the last few years, one in
particular continues to be an on-going goal. The goal states "Every student to reader,
Every student to writer" which implies the District's continued efforts in the areas of
language arts and literacy in grades K-12. In regards to enrollment, he anticipated a 2%
increase over last year.

Councilor Cox stated that he was pleased to see electronic payment of utility bills as a bill
pay option to utility customers at a relatively low cost to the City. He questioned if the
City has been researching the possibility of implement paperless billing for those
customers who have signed up for the electronic payment process since paperless billing
will save the City in paper and mailing costs.
Finance Director Gillespie stated that he could see the advantage of paperless billing and
would look into this process.
MCCALLUM/NICHOLS... adopt the Consent Agenda as presented. The motion
passed unanimously.
0601 COUNCIL BILL NO. 2678 - ORDINANCE UPDATING AND REVISING THE
PROCEDURES RELATED TO TREES WITHIN THE CITY. REPEALING
ORDINANCE NO. 1908. AND SETTING AN EFFECTIVE DATE.
Councilor Sifuentez introduced Council Bill No. 2678. Recordcr Tcnnant rcad the two
reallings ofthe bill by title only.
Councilor Cox stated that he had reviewed the proposed bill which is basically what was
asked for by the Council, but there are a few grammatical changes, most of which are
grammatical, that he would like to discuss with staff before it is adopted. He was
prepared to go over the changes but felt that it might be more efficient ifhe were able to
talk to staff prior to the next meeting. He stated that he did want to discuss with the
Council under definition of street trees the following: (1) an editorial change in Section
1(1) by adding in the first sentence "...the trunk of which lies within the right-of-way...";
and (2) at the end of that same sentence, a policy issue that pertains to a dedicated public
easement. He felt that there are a lot of easements, such as utility easements, that are
located along the back or side of property line and are not adjacent to the street. He felt
that it is outside of the spirit of the ordinance to try and regulate trees within those areas
and focus should be on trees along the street rather than on other parts of the property.
He requested an opportunity to discuss with staff his proposed changes before final action
is taken by the Council.
Administrator Brown stated that continuation of this agenda item would be appropriate
and staff will work with Councilor Cox on his proposed changes.

Brown so those concerns can be addressed before the next meeting.
Administrator Brown stated that the effective date will also be extended as part of the
changes to the proposed ordinance.

0791 COUNCIL BILL NO. 2679 - RESOLUTION ENTERING INTO LOCAL AGENCY
AGREEMENT NUMBER 23.291 WITH THE STATE OF OREGON (Hi~hway
214/ Settlemier AvenuelBoones Ferry Road Intersection Improvements).
Council Bill No. 2679 was introduced by Councilor Sifuentez. The bill was read by title
only since there were no objections from the Council.
Councilor Bjelland questioned when project construction will begin.
Public Works Manager Rohman stated that staff anticipates a construction start date in
late November 2007.
Administrator Brown stated that staff had considered delaying the construction until next
summer but a decision was made to move forward yet this year since ODOT was willing
to proceed and delaying could increase the project cost.
Councilor McCallum requested that staff work closely with the School District and
surrounding neighborhood since this is a very congestive traffic area during the week.
Manager Rohman stated that the work will most likely be done at night because of the
traffic volume and residents in the area will be provided with project information.
On roll call vote for final passage, the bill passed unanimously. Mayor Figley declared
Council Bill No. 2679 duly passed.
0912 COUNCIL BILL NO. 2680 - RESOLUTION ENTERING INTO GRANT
AGREEMENT NO. 24412 WITH THE STATE OF OREGON (Transit Operatin~
Assistance).
Council Bill No. 2680 was introduced by Councilor Sifuentez. The bill was read by title
only since there were no objections from the Council. On roll call vote for final passage,

0939 COUNCIL BILL NO. 2681 - RESOLUTION ENTERING INTO GRANT
AGREEMENT NO. 24413 WITH STATE OF OREGON (Public Transportation
Vehicle Preventative Maintenance Fundin~).

1109 OREGON ECONOMIC AND COMMUNITY DEVELOPMENT ENERGY
GRANT.
Staff recommended submittal of an application for an Energy Feasibility fund grant in the
amount of $24,750 to finance the second phase of a wood-to-energy study relating to the
use of the poplar trees to generate power at the wastewater treatment plant.
BJELLAND/SIFUENTEZ... authorize the Mayor to execute the attached grant
application signature page. The motion passed unanimously.
1125 ADDENDUM TO AGREEMENT WITH G.S. (FRANK) TIWARI RELATED TO
OREGON PUBLIC EMPLOYEE RETIREMENT SYSTEM (PERS)
INTEGRATION.
NICHOLS/SIFUENTEZ... authorize the City Administrator to execute the attached
addendum to the agreement related to PERS integration with G.S. Tiwari.
Councilor Cox stated that he was glad to see that this issue had been resolved.
Mayor Figley stated that Mr. Tiwari is retiring later this week after many years of City
service and she wished him well during his retirement years.
The motion passed unanimously.
1150 CANCELLATION OF AUGUST 27. 2007 COUNCIL MEETING.
NICHOLS/MCCALLUM... cancel the August 27, 2007 Council Meeting. The motion
passed unanimously.
1175 CITY ADMINISTRATOR'S REPORT.
1) Administrator Brown reminded the Council that the League of Oregon Cities
Conference will be held in Bend on September 27 - 29, 2007 and if interested in
attending, he requested that they contact his Executive Assistant J an Clay.
2) Administrator Brown informed the Council that the individual he had selected for the
Public Works Director position has decided not to take the position and it will be
necessary to re-advertise for the position. In the meantime, Public Works Manager Randy
Rohman has agreed to take over the leadership of the department for a limited period of
time. He discussed with the Council the possibility of having a narrowly focused
professional recruitment to try and get a larger pool of applicants to select from. As part
of the initial recruitment process, he had completed a salary survey to determine the pay
range, prepared a recruitment brochure, advertised in numerous publications and
websites, and by direct mailings. He felt that the work is still valid and the salary
competitive but what is lacking is the direct ability to call individuals who are currently
Public Works Directors or ready to make the move to that position. A professional
recruitment consulting firm would be able to assist the City in this aspect of the
recruitment process. He stated that he would like to send out Request for Proposals to a
number of these firms to see what they might do to assist the City and if the cost for this
service is between $9,000 - $12,500, he felt that it would be money well spent since this

is a very important staff position to the City.
It was the consensus of the Council for the City Administrator to move forward with the
Request for Proposal process.
3) Administrator Brown reminded the Council that Frank Tiwari is retiring on August 16,
2007 and an Open House is scheduled from 2:00 pm until 4:00 pm on that day in the
Council Chambers.
1333 MAYOR AND COUNCIL REPORTS.
Councilor Bjelland stated that an issue came up at the last MW ACT meeting by ODOT
staff informing MW ACT that project costs for the Highway 22 project
(StaytonlSublimitity interchange) came in significantly over budget by at least $4.7
million and they had asked for a consensus from MW ACT as to how to proceed by cither
(1) not moving forward with the project, (2) eliminating phases of the project, or (3) by
taking previously allocated money for future projects from the upcoming STIP. It appears
that the consensus ofMW ACT is that they did not want to stop the project nor did they
want to eliminate phases of the project. At the next MW ACT meeting, they will be asked
to make a recommendation as to which of the projects in the upcoming STIP should be
cut to fund the Highway 22 interchange project without any modifications. Projects
under consideration for taking allocated funds from are the Newberg / Dundee project and
the Woodburn 1-5 interchange projects. He strongly encouraged City staff and local
businesses to come to the next MW ACT meeting because, at the last meeting, members
of the Stayton and Sublimity arca werc prescnt to lobby for the complction of their project
without modifications. Woodburn should make its best case as to why funds should not
be taken away from the 1-5 interchange project. He expressed his opinion that the pullout
of the public/private partnership effort relating to the Newberg / Dundee project has
significantly reduced the chances of that project moving forward. He will be discussing
with other members ofMW ACT his opinion that money should be pulled from projects
that are a long way off into the future especially if currently allocated funds are to be used
for property acquisition rather than construction. He also mentioned that MW ACT and
Region II had recommended that the $2 million not used from the West Eugene Parkway
project be allocated to the Woodburn 1-5 interchange Park-N-Ride facility, however the
Oregon Transportation Commission (OTC) decided to hold back this money since they
are concerned with construction costs relating to the Perrydale project. He also received a
copy of a memo today addressed to MW ACT staff which provided information on the
delay of final approval of the 2008-2011 STIP by OTC since there is a potential shortfall
of anticipated project funds due to Oregon legislative actions and Federal Highway Trust
Fund allocations. Since MW ACT has a limited number of projects within the STIP, the
reduced amount of funds available for projects may also affect the Woodburn 1-5
interchange project and he felt that the City should do whatevt::r they can to keep the
interchange project moving forward. The ncxt MW ACT meeting is schcduled for

He recommended that staff and anyone else interested in this issue to attend this meeting
to lobby for the 1-5 interchange project.
Administrator Brown stated that he would work on getting a group of people together to
attend this meeting in addition assisting staff on preparing a presentation to MW ACT.
Councilor Cox stated that he gets frustrated on seeing projects throughout the State that
he knows are on there second and third upgrades while nothing has been done at the
Woodburn interchange.
1690 Councilor Sifuentez stated that she had enjoyed being in the Fiesta parade and, on
National Night Out, visiting a number oflocal neighborhoods with the Mayor and Sgt.
Tlusty. She was pleased with the positive comments made by residents regarding our
community and listened to residents who had expressed their concerns on various issues.
1724 Councilor McCallum thanked Councilor Sifuentez for bringing up at the last Council
meeting the need for some type of a traffic control device on Highway 214 at the Park
A venue intersection since that intersection is routinely used by pedestrians going to or
coming from the Salud Medical Center.
Councilor Cox questioned if ODOT would permit the City to install a traffic light if the
City had the funds to pay for the improvement.
Administrator Brown stated that he has had this discussion with ODOT but was told at
that time that the intersection did not meet their warrants so the City would not be
allowed to install a traffic light. ODOT did state that if the City wanted to do a traffic
warrant study, they will let the City proceed with the study rather than waiting for
ODOT's next study. However, staff feels that the City needs to wait until Salud is fully
operational with their expanded facility and the Police Facility is in full use so that there
is better cross street counts at that intersection. It is anticipated that the City will be
discussing the study with the Council in a year or so.
1830 EXECUTIVE SESSION.
Mayor Figley stated that an executive session was not needed regarding litigation,
however, she did entertain a motion to adjourn to executive session for the other
executive session items under the authority ofORS 192.660(2)(t), ORS 192.660 (2)( e),
and ORS 192.660 (2)( i).

cited by the Mayor.
City Attorney stated for the record that under ORS 192.660(2)(i) he has a right to an open
hearing but he is waiving that right and, secondly, he is unable to give legal advice on that
executive session item because of a conflict of interest.

5. North Front Street Park Playground Restoration Project
Steve Patterson commented that the playground equipment has been delivered, and
the planning team has been formed. On August 9, Doug Buell of SiteLines Park &
Playground Equipment presented a community build playground video to the
planning team. According to Steve, we are in the midst of coordinating logistics and
site preparation. The playground representative will be in Woodburn on Monday,
August 20 to inventory and sort the individual pieces of equipment into logical
components for building. He will be back on Tuesday, September 4 to layout the new
playground at the Park. Steve reported that he still needs donations, sponsorships or
money for anticipated costs of services, materials, tools, and supplies that will add up
to $3,500.00 to $5,000.00. These include: rental fees for equipment used during the
site preparation, portable restrooms, storage unit and garbage dumpster. He also
stated that tools and materials were needed such as; 225 bags of concrete mix, tape,
tools and water for 150 volunteers. Steve has 25 committed volunteers, but still needs
125 more volunteers. He shared that there will be a variety of jobs, for all abilities.
He encouraged business, organizations, churches and service clubs to volunteer.
Steve stated that he wants to make the build day as fun as possible, so donations of
prizes, gift certificates, vouchers and coupons are all welcome. He also reported that
there will be 2 AmeriCorp volunteers needing a host family for a couple of nights
during the week of September 4, 2007.

Bruce Thomas stated he felt that a Dog Park would be important to the community
and encouraged interested people to get involved.
7. Business from the Department
Recreation - Steve Patterson
Steve reported that an adult basketball tournament is scheduled for September 29 &
30, and men's and women's leagues will start in October. An Active Adult Trip to
the Oktoberfest in Mt. Angel is planned for September 13. Adult Life Coaching
Classes will take place at the Library during fall term. These classes will be taught by
a contracted instructor. Summer Day Camp continues until August 24, 2007. After
School Club registrations are being accepted, and the spaces are filling up ~uickly.
Tackle Football and Cheerleading Programs are underway for grades 3r - 6th.
Special events at the Downtown Plaza this fall include Mexican Independence Day on
September 15 & 16 and the Mayor's Christmas Tree Lighting on Sunday, December
2.
Aquatics - Jim Row reported in absence of Debbie Wadleigh
Jim reported that we have seen a significant increase in swimming lesson this
summer. June numbers were similar to last year's, but July was up 58 %, and August
is up 43 % to date, even though we are still taking registrations. He stated that we
continue to experience difficulties finding and retaining qualified aquatic personnel
with proper certifications and training. We generally end up hiring people who have
a lack of employment experience; for many, this will be their first job. Often, we
invest a significant amount of time and money training folks that may end up leaving
after a short time on the job. The hiring process is continuous and the training is very
time consuming. Jim explained that part of the problem is the part time wages are
similar to other part time level entry jobs that required less training or commitment.
Jim reported that the new registration software system has now been implemented
department-wide. We now have all of the add-on modules running, including:
membership management, point of sale and internet registration. These features will
improve our financial accountability and registration convenience. Jim shared that
we are in the process of purchasing two web domain names: woodburnparks.org and
woodburnaquatics.org that will hyperlink to our existing parks and aquatic pages of
City's website. Jim was happy to report that he has previewed a prototype of the
City's new rebuilt website that will replace the website currently online. The new
designed website will be easier for people to navigate and City personnel to maintain.
Parks and Facilities - Jim Row
Jim encouraged people to enjoy Music in the Park with its last two performances;
Golden Bough on August 21 and Dukes of Juke on August 28. Jim reported that the
Fall Community Guide is back from the printer and will be mailed tomorrow. He
shared that the guide had been redesigned to clean up the look and make it easier for
people to find things (Thanks, Paulette). Jim thanked Bruce for the article he wrote
for the Guide. The Board was given a final copy of the Mill Creek Greenway Master
Plan. The National Park Service was a funding and planning partner in the process

and had a few revisions they wanted made. In addition, we decided to add colored
maps, photos and an appendix to the document. Jim reported that the Community
Services Department was awarded two State Local Government Grants; $30,000 for a
playground restoration at Burlingham Park and $210,000 to start work on a % mile
trail in the south section of the Mill Creek Greenway. Under the guidance of the Mill
Creek Master Plan, this segment will include amenities such as trailheads,
observation platforms at Hermanson Pond, benches and trash receptacles. If funding
holds, we will try to replace the play equipment at Hermanson Park I (Spider Park).
Jim stated that as soon as they receive the notice to proceed from the State, he would
begin a search for an architectural design team. Jim mentioned that we would like to
establish design standards, which will be used in the development of the entire
greenway system. Jim shared that he is excited about this project, which is
challenging due to the fact that construction will occur near water and other
significant natural resources. Care must also be taken to respect the concerns of the
numerous greenway neighbors. A discussion took place with regard to the RFP
process, project timeline and the need for public input. Jim reported on the Parks and
Recreation Master Plan update process. We received five proposals by the August 13
deadline. A six member committee will individually review and score the 5
proposals. The committee will then meet as a group to discuss the proposals, tally the
scores and consider the need for interviews. Rosetta and Joseph volunteered to be on
the review committee.

dimensional standard of 500 feet from Pacific Highway. The design review involves the
IP zoning district standards of Section 2.109, the Special Use Standards of Section
2.203 and development guidelines and standards of Section 3.1. Planning staff has
identified several characteristics of the parking lot configuration, landscaping and
signage that are not in conformance to the current standards. Fleetwood Homes uses

Tree Ordinance Amendments
RECOMMENDATION:
It is recommended the City Council adopt the attached ordinance, amending
Ordinance 1908, relating to trees located in the City of Woodburn.
BACKGROUND:
At its June 25, 2007 meeting, the City Council discussed amendments to
Ordinance 1908, which regulates the maintenance, removal, and placement of
street trees in Woodburn. A citizen's request to remove an otherwise healthy
street tree, the roots of which were raising the resident's driveway, prompted the
Council's consideration of the ordinance. Staff discussed current policy with
Council, and desirable amendments to the ordinance to address the immediate
issue and, due to its age, to update it for consistency with current practice and
other ordinances. On August 13, 2007, staff presented recommended
ordinance amendments for Council consideration. The matter was tabled, and
staff was given direction to make minor changes.
DISCUSSION:
The primary set of revisions to the Tree Ordinance, as outlined in the August 13,
2007 staff report:
. Dictate no street tree may be removed without written permission from
the City, authorize the Public Works Director to grant such permission, and
prohibit removal by anyone other than a certified, licensed, and bonded
tree professional;
. Require an arborist's report that supports removal before permission will be
granted, and place financial responsibility for that report on the land-
owner;

. Add damage to private driveway aprons and walkways located with City
rights-of-way to the justification for removing a street tree, provided such
damage cannot be remedied by less drastic alternatives;
. Incorporate the cost sharing provisions of Resolution No. 1514 related to
tree removal into the ordinance, but do not extend subsidy when
removals are initiated by owners for reasons other than failing tree health;
. Establish 2 inches as the minimum acceptable caliper size for
replacement trees;
. Eliminate references to the defunct Street Tree Committee, and to the
Recreation and Parks Director;
. Eliminate references to a list of approved street trees, referring instead to
guidelines provided in the Woodburn Development Ordinance;
. Create guidelines to regulate tree planting, spacing and clear vision
requirements that will be consistent with the Woodburn Development
Ordinance;
. Increase to current City standards the insurance coverage that must be
maintained by arborculturalists doing business in the City, and require
them to obtain a City business license;
. Establish due process provisions related to City enforcement of the
ordinance; and
. Update penalty provisions to reflect current City policy.
In addition to these, staff has addressed the concerns raised at the August 13,
2007 meeting. Additional amendments:
. Expand the definitions section to include "real property owner," and
"certified arborist." "Real Property Owner" eliminates the formerly
confusing terminology "adjacent property owner." A number of sections
in the ordinance are also amended to reflect this change in terminology.
"Certified Arborist" establishes a standard to which those doing work on
street trees will be held, and means a person who meets the criteria for
certification from the International Society of Arboriculture or American
Society of Consulting Arborists, and maintains his or her accreditation.
. Further modify the definition of "infrastructure, which was expanded to
include private infrastructure, to indicate that private walkways must be
improved; either concrete or asphalt.
. More clearly delineate the location of trees considered "street trees"
. Revise the section regarding "arborculturalist" standards, to require that
work done on street trees will be by, or under the direct supervision of a
certified arborist. This language provides for quality control, and is more

objective than previous language that suggested the City would make
findings of qualification for those allowed to work on street trees.
. Establish a more objective standard for the size of replacement trees,
indicating a two inch caliper measurement at four (4) feet from the
ground, rather than at "chest height"; and
. Correct typographical errors.
Recommended amendments would, with your approval, take effect November
1, 2007. This will allow City Public Works and Community Development staff
adequate time to develop a set of guidelines related to spacing and clear
vision requirements that are consistent with the Woodburn Development
Ordinance.
FINANCIAL IMPACT:
The recommended action is not expected to have a material impact on the
current cost of enforcing the tree ordinance.

AN ORDINANCE UPDATING AND REVISING THE PROCEDURES RELATED TO TREES
WITHIN THE CITY OF WOODBURN; REPEALING ORDINANCE 1908; AND SETIING AN
EFFECTIVE DATE.
WHEREAS, the City Council recently considered an issue regarding the
removal of a street tree; and
WHEREAS, in the course of considering this specific issue, the Council
requested a report on the administration of the City tree ordinance; and
WHEREAS, the Council received the report from City staff and discussed
the relevant policy issues; and
WHEREAS, the Council directed that certain revisions be made to the City
tree ordinance; and
WHEREAS, these revisions are extensive enough in nature that they should
be contained in a new revised ordinance; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Definitions.
A. "Certified Arborist" means a person who has met the criteria for
certification from the International Society of Arboriculture or American Society
of Consulting Arborists, and maintains his or her accreditation.
B. "Park tree" means a tree, shrub, bush, or other woody vegetation in
public parks or areas to which the public has free access.
C. "Person" means an individual or legal entity.
D. "Private infrastructure" means a driveway apron or paved or
concrete private walkway located within the City right-of-way.
E. "Private tree" means a tree, shrub, bush, or other woody vegetation
located on private property other than a dedicated right-of-way or public
easement, or public parks and grounds.

F. "Public infrastructure" means public water and sewer lines, electric
lines, gas lines, telephone or cable television lines, curbs, and sidewalks located
within the public right-of-way, and other public improvements.
G. "Public Works Director" means the Woodburn Public Works Director
or designee.
H. "Real Property Owner" means the person holding legal title to the
real property or properties upon which a street tree is located.
I. "Remove" or "Removal" means to cut down a tree, or remove 50%
or more of the crown, trunk, or root system of a tree; or to damage a tree so as
to cause the tree to decline and/or die. Remove or removal includes topping.
Remove or removal includes but is not limited to damage inflicted upon a root
system by application of toxic substances, operation of equipment and
vehicles, storage of materials, change of natural grade due to unapproved
excavation or filling, or unapproved alteration of natural physical conditions. It
does not include normal trimming or pruning.
J. "Street tree" means a tree, shrub, or other woody vegetation on
land, the trunk of which is located wholly or partially within the right-of-way
along either side of a street, avenue or other way or within a dedicated side of
a street, avenue or other way.
K. "Topping" means the severe cutting back of a tree's limbs to stubs
three inches or larger in diameter within the tree's crown to such a degree so as
to remove the natural canopy and disfigure the tree.
Section 2. Permit to Remove Trees Reauired.
A. No person shall remove a street tree without obtaining a permit
from the Public Works Director. Permits to remove street trees will be granted
only if one of the following conditions exist:
(1 ) The tree is dangerous and may be made safe only by its removal.
(2) The tree is dead or dying, and its condition cannot be reversed.
(3) The tree is diseased and presents a potential threat to other trees
within the City, unless it is removed.
(4) The tree is causing damage, which cannot be corrected through
normal tree maintenance, to public infrastructure as defined by this Ordinance.

(5) The tree is causing damage, which cannot be corrected through
normal tree maintenance, to private infrastructure as defined by this Ordinance.
B. Any application for a permit to remove a street tree shall be
supported by a report prepared by an Arborist as defined by this Ordinance
and paid for by the applicant for the permit.
C. Street Tree Removal Applications and Street Tree Permits shall be
prepared by the Public Works Director in a form approved by the City Attorney.
D. Street tree removal permits shall remain valid for a period of 180
days from the date of issuance. Permits that have lapsed are void. Trees
removed after a tree removal permit has expired shall be considered a violation
of this Ordinance.
E. Misrepresentation of any fact necessary for the City's determination
for granting a tree removal permit shall invalidate the permit. The City may at
any time, including after a removal has occurred, independently verify facts
related to a tree removal request and, if found to be false, or misleading, may
invalidate the permit and process the removal as a violation. Such
misrepresentation may be related to matters including, without limitation, tree
size, location, health or hazard condition, justification for issuance of permit, or
owner's authorized signature.
Section 3. Reaulrement for Certified Arborlst. Pruning, treating, or
removing street or park trees shall be performed by or under the direct
supervision of a Certified Arborist. Before a permit is granted by the Public Works
Director, the arborist shall provide proof of current City business license and
evidence of possession of liability insurance in the minimum amounts provided
by ORS 30.270. Permits shall not be required of a City employee doing work on
behalf of the City. Permits shall not be required of franchisees or other public
service companies doing work in pursuit of their public service endeavors,
provided that all such work is completed in conformance with any applicable
franchise requirements and by or under the direct supervision of a Certified
Arborist.
Section 4. City Cost Sharina for Street Tree Removal. Subject to the
availability of funds in the City's budget, the Public Works Director is authorized
to expend City funds to share in the cost of removal of street trees according to
the following formula:

The maximum City subsidy for one property shall not exceed $500, except in
cases where the street tree removal is done exclusively for the protection of
public infrastructure where the Public Works Director is authorized to have the
City pay the entire cost. No subsidy shall be provided for trees removed at a
Real Property Owner's request in order to protect private infrastructure.
Additional guidelines for cost sharing of tree removal may be established, and
amended from time to time as needed, by resolution of the City Council.
Section 5. Tree ReDlacement. The City may require the replacement by
the Real Property Owner, at the Real Property Owner's expense, of a new tree
after permission has been granted by the Public Works Director for the removal
of an existing street tree. Replacement trees must have a minimum caliper of 2
inches at 4-foot height, be of a species that reaches the same height at
maturity as surrounding street trees, and may not be a prohibited species under
the Woodburn Development Ordinance.
Section 6. Woodburn Street Tree Plantina Reaulations. All street trees shall
be planted in conformance with the Woodburn Street Tree Planting Regulations
which shall be adopted, enforced, and administered by the Public Works
Director consistent with the terms of this Ordinance. Copies of the Woodburn
Street Tree Planting Regulations shall be on file in the City Recorder's office,
Public Works Department, Community Development, and the Woodburn Public
Library .
Section 7. Street Tree SDecles to be Planted. No person shall plant a street
tree of any species that is prohibited by the Woodburn Development Ordinance
without the written permission of the Public Works Director.
Section 8. Tree Maintenance by City. The City shall have the right to
plant, prune, maintain, and remove trees located within the public right-of-way
as may be necessary to protect public safety or to preserve or enhance the
appearance of public property. The City may remove, or order to be removed
at the expense of the Real Property Owner, any tree or part thereof which is in
an unsafe condition or which by reason of its nature is injurious to sewers,
electrical power lines, telephone or cable television lines, natural gas lines, water
lines, or other public improvements, or is affected with any injurious fungus,
insect, or other pest.

Section 9. Street Tree Maintenance by Owner.
A. In consideration of the value and benefits derived from the beauty
and enjoyment of a street tree, the Real Property Owner shall have the
responsibility, control, and shall bear the cost of maintenance and care of the
street tree, and shall regularly inspect and remove defective conditions as
necessary .
B. The Real Property Owner shall prune the branches of a street tree so
that the branches do not obstruct the light from a street light or obstruct the
view of any street intersection. The Real Property Owner shall maintain a clear
space of 15 feet above the surface of the street and 10 feet above the surface
of any sidewalk. The Real Property Owner shall remove all dead, diseased, or
dangerous, or broken or decayed limbs which constitute a danger to the safety
of the public.
C. The Real Property Owner shall be liable for injury, damage, or loss to
persons or property caused by the Real Property Owner's failure to comply with
subsection A or B of this section.
D. The City of Woodburn shall not be liable for injury, damage, or loss
to person or property caused in whole Of part by the defective or dangerous
condition of any tree located in or upon a right-of-way. The Real Property
Ownef shall defend and hold harmless the City from all claims for loss and
damage arising from the Real Property Owner's failure to comply with
subsection A or B of this section.
Section 10. Mutilation and TODDina of Trees.
A. Mutilation. Unless specifically authorized in writing by the Public
Works Director, no person shall intentionally damage, cut, carve, transplant, or
remove any park tree or street tree; attach or place any rope or wire (other
than one used to support the tree itself), sign, poster, handbill, or other thing to it;
allow any gaseous liquid or solid substance which is harmful to such trees to
come in contact with it; or set fire or permit any fire to burn when such fire or the
heat thereof will injure any portion of any such tree.
B. Tree ToooinQ. No person shall top any park tree or street tree,
except as authorized by the Public Works Director.
Section 11. Removal of StumDs. All stumps of street and park trees shall
be removed below the surface of the ground so that the top of the stump shall
not project above the surface of the ground. The costs of removing stumps shall
be borne by the Real Property Owner.

Section 12. Summary Powers for Removal of Danaerous or Nuisance Trees.
A. The City may prune a private tree when it interferes with the spread
of light along the street from a street light, or interferes with the visibility of any
traffic control device or sign.
B. The City may require or initiate removal of all or part of any dead,
dangerous or diseased park, private or street tree when the tree constitutes a
hazard to life, property, or harbors insects or disease which constitutes a
potential threat to other trees within the City.
C. The City may remove or trim a tree described in this section or may
require the property owner to remove or trim any such tree on private property,
or in a dedicated right-of-way or utility easement abutting upon the owner's
property. Failure of the property owner to remove or trim the tree within 30 days
after receiving notice by the City Administrator is a violation of this Ordinance,
and the Public Works Department may then remove or trim and tree and assess
the costs as a lien against the property.
Section 13. Nuisance Abatement. All street trees that the Public Works
Director requires to be removed pursuant to this Ordinance, constitute nuisances
and are subject to the abatement and lien procedure contained in Ordinance
2338, the City of Woodburn Nuisance Ordinance.
Section 14. Enforcement.
A. Civil Infraction. In addition to, and not in lieu of any other
enforcement mechanisms, a violation of any provision of this Ordinance
constitutes a Class I Civil Infraction which shall be processed according to the
procedures contained in the Woodburn Civil Infraction Ordinance.
B. Civil Proceedina Initiated by City Attorney. The City Attorney, after
obtaining authorization from the City Council, may initiate a civil proceeding on
behalf of the city to enforce the provisions of this Ordinance. This civil
proceeding may include, but is not limited to, injunction, mandamus,
abatement, or other appropriate proceedings to prevent, temporarily or
permanently enjoin or abate any violations of this Ordinance.
Section 15. SeDarate Offenses. Each day during which a violation of this
Ordinance continues shall constitute a separate offense for which a separate
penalty may be imposed.

Councilor McCallum questioned if the paratransit van is used to travel outside of the city
limits.
Public Works Manager Rohman stated that grant funds will pay about 90% of the
purchase price and the van is used to transport between 6 and 8 passengers elderly and
disabled passengers primarily within the city limits. This new vehicle will replace an
existing paratransit van that is about 9 years olds which is in fair condition and the this
vehicles will be used as a back-up van. Once the van is ordered, it will take about six
months before it is delivered to the City.

Section 16. ADDeal. If the Public Works Director refuses to issue any permit
under this Ordinance, or requires the removal of a tree, the Public Works Director
shall provide written notification to the applicant who may appeal to the City
Council in writing within ten calendar days after the date of the written
notification from the Public Works Director. The City Council shall proceed to
hear and determine the appeal, based upon information submitted by the
permit applicant and the Public Works Director. Any review of the City Council's
final decision shall be to the Marion County Circuit Court pursuant to ORS
Chapter 34.
Section 17. Severability. The sections and subsections of this Ordinance
are severable. The invalidity of any section or subsection shall not affect the
validity of the remaining sections and subsections.
Section 18. ReDeal. Ordinance 1908 is hereby repealed.
Section 19. Savina Clause. Notwithstanding the repeal of Ordinance 1908,
Ordinance 1908 shall remain in force for the purpose of authorizing the
prosecution of a person who violated Ordinance 1908 prior to the effective date
of this Ordinance.
Section 20. Effective Date. This Ordinance shall take effect on November
1, 2007.

RECOMMENDATION:
Authorize the City Administrator to enter into a Local Government Grant
Agreement from the Oregon Parks and Recreation Department. The $210,000
grant was awarded for the Mill Creek Greenway Phase I Project.
BACKGROUND:
In April 2007, the Community Services Department submitted a Local
Government Grant application to the state of Oregon, requesting funding
assistance for the Mill Creek Greenway Phase I Project. The City's grant
application was approved in July 2007. This will be the first Greenway project
completed since the Mill Creek Greenway Master Plan was adopted in May
2006.
The Recreation and Park Board considers implementation of the Mill Creek
Greenway to be their third highest priority development project, following the
playground replacement initiative and the Aquatic Center Expansion. This
project has been in the planning stages for the past couple of years, including
the recent completion of a preliminary design and cost estimate.
DISCUSSION:
This project involves constructing a trail system, complete with asphalt pathways,
bridges, trailheads, benches, and trashcans. The first phase runs from Cleveland
Street at the north to Hermanson Pond at the south. The project also includes
the replacement of the playground at Hermanson Park I, which is . also a high
priority to the Recreation and Park Board. In fact, the Board recently created
the playgrour i replacement initiative, and considers it their highest priority

GRANT AGREEMENT
THIS AGREEMENT is made and entered into on the date of final signature of this agreement by and between
the State of Oregon, acting by and through the Oregon Parks and Recreation Department, hereinafter referred to as
the "State," and the City of Woodburn, or designated representative, hereinafter referred to as the "Sponsor."
The parties agree to the following:
WHEREAS, under ORS 390.180, the State and Sponsor may enter into an agreement concerning acquisition,
development, and or rehabilitation of public outdoor recreation areas and facilities, hereinafter called "Project,"
and the State may make grants of money to assist the Sponsor in such projects.
WHEREAS, under OAR Chapter 736, Division 6, the Sponsor agrees to comply with the Local Government
Grant Program administrative rules.
The purpose of this agreement is to set forth the obligation of both parties in the acquisition, development and/or
rehabilitation of public outdoor recreation areas and facilities. The State and the Sponsor desire to achieve
improvements in park and recreation areas and facilities as hereinafter described in the project application and to
that end, the Sponsor proposes to perform work and/or acquire land as set out and described in the
Description/Scope of Work section of this agreement and the Sponsor's application.
The State has sufficient Local Government Grant Program funds available within its current biennial budget and
has authorized the expenditure on the Sponsor's project as defined below.
The Project has been reviewed and based on the Sponsor's application and representations, is found to be feasible
and appropriate for funding.

The total cost of the project covered by this Agreement is $437,893.
The value of the Sponsor contributions for this project is $227,993, which is the difference between the total cost
and the State grant.
The State agrees to pay $210,000, or 47.96 percent of the total project costs, whichever amount is less, from
monies available through the Local Government Grant Program.
NOW, THEREFORE, the State and the Sponsor agree to the following:
Upon approval by the Oregon Parks and Recreation Commission, the State shall provide Local Government Grant
Program funds to the Sponsor to supplement the funding of the authorized Project.
Sponsor may begin work upon receipt of signed Agreements and a Notice to Proceed from the State. Any
expenses incurred prior to the agreement date will not be eligible for reimbursement.

PROJECT TERM AND AMENDMENTS:
Proiect Term: The Sponsor shall have one year from the date of authorization of this agreement to commence
substantial work (Le., for sponsor to award contracts for work or show at least 25% of work is complete if the
work is performed by force account). Projects not in compliance with this schedule may be cancelled unless
substantial justification for an extension is warranted.
This Agreement shall become effective after both parties have signed this Agreement and shall become effective
on the final date of signature of this agreement. Unless otherwise terminated or extended this Project shall be
completed and this Agreement shall expire on August 31, 2009.
Amendments:
This Agreement may only be amended if requested in writing, approved by the State, and signed by the parties.
An extension for a six-month period may be granted for the project agreement if requested in writing at least 30
days prior to expiration date of this agreement, allowing enough time to prevent a lapse in the agreement. The
request for extension must show a compelling need for the extension.
PROGRESS REPORTS AND PAYMENTS
Progress Reports: Once work has begun, Sponsor shall report to the State on work completed on a quarterly basis
as follows:
By April 30 for the quarter beginning January 1 and ending March 31;
By July 31 for the quarter beginning April 1 and ending June 30;
By October 31 for the quarter beginning July 1 and ending September 30;
By January 31 for the quarter beginning October 1 and ending December 31.
A progress report giving an accounting of the work accomplished is also required whenever project
reimbursements are requested. A copy of the progress report form to be used is attached.
Sponsor must submit a final report and final reimbursement within 60 days of the project completion date or the
expiration date of the agreement. The final report shall include full and final accounting of all expenditures and
description of the work accomplished.
Reimbursements will be given only for those items identitied in the grant agreement. Substitutions of the elements
of the projects or deletion of elements will not receive reimbursement. Example, if the Sponsor stated in the grant
agreement that a walkway will be paved but instead used cinder wood or purchased a storage shed. those dollars

that were to be allocated towards the paving will be reduced from the Sponsor's project costs and will not be
reimbursed.
PROJECT BILLING AND REIMBURSEMENT
Sponsor may bill for reimbursable expenditures quarterly or at anytime during the agreement period with proper
documentation. To request a reimbursement, Sponsor will complete Agency Billing Fonn, along with the progress

Partial reimbursements up to 90% of the grant amount may be billed to the state during the project period for work
completed. In all partial reimbursements, State will retain 10% of total grant allocation amount until final
approval and acceptance by the State. The final 10% will be reimbursed after the project is completed, full
documentation is received, and there is final approval and acceptance by State.
Partial reimbursements and quarterly reports shall contain a reasonable and accountable request. At no time will
the State reimburse Sponsor for more than the maximum percentage allowed under this agreement.
The State shall not be obligated to make a final payment to the Sponsor until all documentation and required
reports are received. Projects may be inspected by the State prior to final acceptance and final reimbursement of
the work completed.
SPONSOR COVENANTS
Match: The sponsor shall contribute matching funds or the equivalent in labor, materials or services, which are
shown as eligible match in the rules, policies and guidelines for the Local Govemment Grant Program.
Publicity: Sponsors shall make every effort to acknowledge and publicize the State's participation and assistance
with the project. Prior to the completion of the project, the Sponsor agrees to place signage acknowledging the
State's grant program support. Sponsor also agrees to maintain the signage throughout the life of the project.
State may withhold final reimbursement payment until signage has been placed.
Public Access to the Proiect: The Sponsor shall allow open and unencumbered public access to the Project to all
persons without regard to race, color, religious or political beliefs, sex, national origin or place of primary
residence.
Compliance with Workers Compensation Law: The Sponsor shall require that its contractors or any
subcontractors and all employers performing work on the Proj ect be subject employers under the Oregon Workers
Compensation Law and shall comply with ORS 656.017, which requires subject employers to provide
compensation coverage for all subject workers.
Record Maintenance: The Sponsor shall retain a project tile including accounting records for three (3) tiscal years
after the completion of the project and allow the State, or its authorized representative, to inspect and review all
fund related records, to the level of detail prescribed by the reviewing entity, whenever so requested by the State or
its authorized representative.

Inspection and Audit: The Sponsor shall permit all fund-assisted sites to be inspected by the State and/or its
authorized representative(s) at reasonable times. Projects may be inspected by the State prior to final acceptance.
Liability: The Sponsor shall be liable for injury or loss of property, personal injury, or death caused by the
negligent or wrongful act or omission of any employee of the sponsor, while acting within the scope of his office
or employment as permitted under the Oregon Tort Claims Act, where the State of Oregon, if a private person,
would be liable to the claimant in accordance with the law of the State where the act or omission occurred.
Indemnity: Subject to the limits and conditions for the State of Oregon Tort Claims Act, the Sponsor shall defend,
save, hold harmless, and indemnify the State of Oregon and the Department and their agencies, subdivisions,
officers, directors, agents, employees, and members from any and all claims, suits, actions, losses, liabilities, costs,
expenses, and damages of whatsoever nature resulting from, arising out of, or relating to the activities of Sponsor
or its officers, employees, contractors, or agents under this agreement.
CONVERSION
Sponsor further warrants that the land within the project boundary shall be dedicated and used for a period of no
less than 25 years from the completion of the Sponsor's project for park or recreation purposes. Sponsor must
insure that the land within the project boundary will be used only for park and recreation purposes, Sponsor
controls or will have control the land, and that the Sponsor will not change the use of, sell, or otherwise dispose of
the land within the project boundary, except upon written approval by the State. Leases for federally owned
property must be at least 25 years. If the current lease is within 5 years oftermination, a letter of intent to renew
the lease will be required from the federal agency.
If the Sponsor converts lands within the project boundary to a use other than park and recreation purposes, or
disposes of such land by sale or any other means, the Sponsor must provide replacement property within 24
months of either the conversion or the discovery of the conversion.
If replacement property cannot be obtained within the 24 months, the Sponsor will provide payment of the grant
program's prorated share of the current fair market value to the State. The prorated share is that percentage of the
original grant (plus any amendments) as compared to the original project cost(s). The replacement property must
be equal to the current fair market value of the converted property, as determined by an appraisal. The recreation
utility of the replacement property must also be equal to that of the lands converted or disposed.
If conversion should occur through processes outside of the Sponsor's control such as condemnation or road
replacement or realignment, the Sponsor will be required to pass through to the State that prorated share of
whatever consideration is provided to the Sponsor by the entity that caused the conversion. The monetary value of
whatever consideration provided by the taking will normally consist of the fair market value of the property
established by an appraisal.
TERMINA TION
The State reserves the right to cancel this agreement ifno progress on the Project is made within one year of the
effective date of this agreement.
The State, upon thirty (30) days written notice to the Sponsor, may modify or terminate this agreement if the State
fails to receive funding or appropriations, limitations, or other expenditure authority at levels sufficient to pay the
allowable costs of the Project to be funded hereunder, or should state law, regulation or guidelines be moditied,
changed or interpreted in such a way that the Project, or any portion of the Project is no longer eligible for Local
Government Grant Program funding.

REMEDIES
THE State shall have any and all rights and remedies available by law or in equity.
GENERAL PROVISIONS
Participation in Similar Activities: This agreement in no way restricts the Sponsor or the State from participating
in similar activities with other public or private agencies, organizations or individuals.
Duplicate Payment: The Sponsor shall not be compensated for or receive any fonn of duplicate, overlapping or
multiple payments for the same work perfonned under this agreement from any agency of the State of Oregon or
the United States of America or any other party, organization or individual. All Sponsor matching contributions to
this agreement must be used and expended for this project only and within the project period.
No Third Partv Beneficiaries: The State and the Sponsor are the only parties to this agreement and are the only
parties entitled to enforce its tenns. Nothing in this agreement gives, is intended to give, or shall be construed to
give or provide any benefit or right, whether directly or indirectly, to a third person unless such a third person is
individually identified by name herein and expressly described as intended beneficiary of the tenns of this
agreement.
Freedom of Infonnation Act: Any infonnation furnished under this agreement is subject to the Freedom of
Information Act (5 U. S. C. 552).
N on-Discrimination: The parties agree not to discriminate on the basis of race, religion, sex, color, national origin,
family status, marital status, sexual orientation, age, and source of income or mental or physical disability in the
performance of this contract.
Notices: All written communications, which are to be given to the State under this Agreement, will be mailed and

WAIVER CLAUSE
THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES. NO
WAIVER, CONSENT, MODIFICATION OR CHANGE OF TERMS OF THIS AGREEMENT SHALL BIND
EITHER PARTY UNLESS IN WRITING AND SIGNED BY BOTH PARTIES. SUCH WAIVER, CONSENT,

RECOMMENDATION:
It is being recommended that the City Council accept the attached Public
Rights of Way as described on Attachment "A" and liB".
BACKGROUND:
Attachment "An; The Public Right of Way being conveyed is 1 foot in width. The
applicant, Industrial Welding Supply Inc. through Marion County Oregon,
acquired the 1-foot strip. The strip of land was platted in 1984 as one-foot
reserve strip and was foreclosed on by Marion County for tax purposes.
Attachment liB"; The Public Right of Way being conveyed is 10 feet in width and
is being dedicated to provide a full 60 feet in width adjacent to the south
boundary of the Industrial Welding Supply, Inc. property.
DISCUSSION:
The eleven foot wide Public Right of Way is being conveyed to city by Industrial
Welding Supply Inc., as a condition of land use approval in conjunction with
Community Development Design Review case file 05-14. The subject property is
located at 610 North Pacific Highway and 1475 Aztec Drive. This dedication will
provide the 60 of width adjacent to the subject site on Aztec Drive as required
by the Woodburn Transportation System Plan.

Removal of Two Trees at 217 N. Second Street
RECOMMENDATION: Uphold the denial of the request to remove two poplar
trees located at 217 N. Second Street.
BACKGROUND: The City has received a request from Mr. Tom Ashland to
remove two large Poplar trees adjacent to property he owns at 217 N. Second
st. The two trees are in the Montgomery Street right of way and are shown on
the attached photo. Mr. Ashland was issued a removal permit through the
Community Development on the premise that the trees were on private
property. On July 5, 2007 a report was made to the Maintenance Division that
two large poplar trees in the Montgomery Street right of way were being
removed. Maintenance Division investigated and since the trees were
significant street trees and not located on private property the work was halted.
Since Mr. Ashland had requested that the trees be removed Maintenance
Division requested a professional risk assessment on the two trees. The
assessment was done on August 5, 2007 by certified arborist Gary Syphus of
"Arbor Answers" and that report is attached.
The report placed the two poplar trees in a moderate risk category for failure
due to the type of tree and the size of the trees. The major factor that
determined this risk factor is that approximately 50% of the root zone is covered
by sidewalk and street surface. Due to the location relative to high value
targets, street traffic, pedestrians, and buildings, that portion of the arborist's risk
assessment received a moderate to severe overall risk factor.
The two trees however are healthy and show no signs of disease. There have
been reports of minor scaffold branch failures in the past with no problems
noted with major structural elements of the trees. The sidewalk adjacent to the

trees has been impacted by the trees in the past but was repaired
approximately 10 years ago and does not shown any additional damage at this
time. There are no impacts at this time on any City infrastructure.
DISCUSSION: The two poplar trees are mature trees and appear to be in good
health consistent with their age. Approximately half of the tree's root systems
are covered by street and sidewalk but this has not caused any apparent
damage. The roots have apparently caused sidewalk damage in the past but
that damage was repaired approximately 10 years ago and there is no evident
additional damage at this time.
The previous property owner had requested that the City evaluate the trees in
April 2007. A letter sent to the previous owner at that time indicated that a City
inspection found the trees to be healthy and removal was not needed.
There is always some inherent risk of failure of mature trees in high wind
conditions that are associated with saturated soil conditions. The two trees in
question are aided somewhat in that approximately half of the root mass is
under the street and not subject to the degree of saturation that may occur in
trees in the middle of a park or yard. The trees are healthy and have not shown
any signs of disease or decay. Staff has determined that the two poplar trees
do not warrant removal at this time.
Staff is recommending that Council uphold the denial of permission to remove
these two trees.
FINANCIAL IMPACT: There is no financial impact as a result of this action.

Dear Matt,
Enclosed are the tree hazard evaluation sheets for the trees in question. As you can see, I have
rated them potential hazards that should be removed. My reasons are detailed below. Tree
hazard assessment includes three components: a tree with the potential to fail, an environment
that may contribute to that failure and a person or object that would be injured or damaged (a
target).
Large old trees tend to fail more frequently than smaller trees in similar circumstances. Trees
over 30" in diameter are also more likely to fail than smaller trees.
These two trees in particular have very severely restricted root systems for their size and age.
The soil in the root zone area is compacted which is causing roots to come to the surface and
buckle the sidewalk. The root zone area is 50% covered with pavement which restricts root
gro~ water and nutrient absorption. There has been some minor failure in the past with small
scaffold branches, etc. but I believe the greatest potential for failure with these trees is the root
system due to the lack of available growth area.
The environment that might contribute to this failure would of course be our saturated soils with
high winds. These trees 'are very heavy and with the equation of saturated SQils from rain fall,
restricted root systems and high winds, there would be a moderate chance for failure.
Targets would include pedestrians on the sidewalk, cars parked nearby, the residence itself and
power lines above. I took into consideration the close proximity to city hall which means
increased traffic from foot and vehicle over a normal neighborhood setting.
In my opinio~ these trees have outgrown the area in which they were planted. This species is
more prone to failure than most due to the structure of the wood, overall size and weight.

Oregon LNG pipeline - Response to Environmental Impact Statement

Authorize Mayor Figley to sign a letter to respond to the Federal Energy Regulatory
Commission regarding the potential impacts of locating a 30- to 36-inch diameter
natural gas pipeline within the Woodburn Urban Growth Boundary.
BACKGROUND:
The Federal Regulatory Energy Commission (FERC) is preparing an Environmental
Impact Statement that will address the environmental impacts of the project that is
proposed to include a terminal at Warrenton, Oregon and a 117-mile long natural
gas pipeline from Warrenton, to the existing Williams Northwest Pipeline system near
Molalla. The current alignment is near the southwest and southern portions of the
Woodburn Urban Growth Boundary, including areas designated as the Southwest
Industrial Reserve (SWIR). The industries chosen to be included in the SWIR area
would typically create family-wage jobs that would increase the incomes and living
conditions of the residents of the City of Woodburn.
DISCUSSION:
If located in the Woodburn Urban Growth Boundary, and specifically in the SWIR
area, there could be impacts to the livability of the residents, and industries might
choose not to locate here as a result of not having adequate lands available that
are not burdened by such a pipeline.
FINANCIAL IMPACT:
No immediate and direct impact to City budget. Indirect impacts to residents and
continued socioeconomic impacts could result if the pipeline were to locate in the
Urban Growth Boundary and inhibit development of family-wage jobs.

City of Woodburn Urban Growth Boundary (UGB) Impacts
Attention:
Dear Ms. Bose:
This letter serves as the official position of the City of Woodburn regarding the Oregon LNG Terminal
and Pipeline Project and request for continued notification of the status of the project. The City of
Woodburn is receptive to the task of providing alternative energy sources to the residents and
businesses of the region that is proposed by LNG Development Company, LLC and Oregon Pipeline
Company. However~ the City has significant concerns about the location of the pipeline facility in the
immediate vicinity of the City of Woodburn and impacts that would occur as a result of the pipeline
being located within the City Urban Growth Boundary.
For some background, the City of Woodburn (City) recently adopted amended plans for the future
growth of the City to the year 2020. The City completed this planning process as a result of statutory
provisions that require the City to provide for expected growth and demands for an adequate supply of
industrial, residential, and commercial lands within the City Urban Growth Boundary. The City spent 8
years and over $1.5 million on studies and consideration of alternatives to determine the appropriate
locations, amounts, and types of lands to be included in the urban growth boundary. Part of the project
was an Economic Opportunities Analysis that identified possible industrial uses that would create
family-wage jobs and were likely to locate in Woodburn, based on the unique qualities that Woodburn
has to offer. Part of the analysis also identified the needs of such industries, including topography,
natural features, parcel sizes, and access to transportation systems.
This background is important in that the proposed pipeline is depicted to bisect the southwestern
portion of the City Urban Growth Boundary, where the industrial lands are located. The development
of industrial users in the southwestern portion of the City is also critical to establish transportation
improvements that will complete connections that are critical to the success of the industries and
residents of the City and surrounding rural areas. Attached for reference is the City of Woodburn
Comprehensive Plan Map that identifies the Woodburn Urban Growth Boundary.

The City staff has previously had discussions with Oregon LNC regarding the location of the pipeline
and impacts related to the needs of projected industrial users. Specifically, the location of the pipeline
through an industrial property would limit the ability of a large industrial building to be located on the
property just by virtue of the physical location of the pipeline. This would have an extraordinarily
damaging impact on the economic future of the residents of the City if the contemplated industrial users
that would provide family-wage jobs could not locate in the City.
For these reasons, the City of Woodburn officially requests that the Oregon LNG pipeline be located in
a manner that bypasses the City of Woodburn Urban Growth Boundary. In the scope of a project that is
117 miles long, the relocation approximately 2,000 feet to the south would be a minor change that
would retain the planned facilities and uses associated with the City of Woodburn growth expectations
to the year 2020. The location outside the Urban Growth Boundary would also minimize the land use
impacts, costs to transportation systems that would not be improved if industry does not locate in the
designated areas, and the socioeconomic impacts that would occur if industries that create family-wage
jobs did not locate in the City.
In summary, locating the Oregon LNG pipeline outside the City of Woodburn Urban Growth Boundary
would eliminate the cumulative impacts associated with the pipeline bisecting properties and
transportation systems. I thank you for the opportunity to participate and comment on this matter and
will be interested in working with Oregon LNG and the Federal Energy Regulatory Commission in
reviewing this project to ensure that impacts to local residents, land use, transportation systems, and
socioeconomics of the area are minimized.
Please find enclosed a copy of the Woodburn Comprehensive Plan Map (2005), which depicts the area

RECOMMENDATION:
It is recommended the City Council appoint Councilor Sifuentez as the voting
delegate to represent Woodburn at the League of Oregon Cities annual
business meeting.
BACKGROUND:
As a member of the League of Oregon Cities, Woodburn has voting rights at the
annual business meeting, which is held during the League's annual conference.
Business meeting items include League policies, activities, organization, and
operations, and positions regarding pending or proposed legislation.
DISCUSSION:
The League has requested the City to assign a representative to vote at the
business meeting on Saturday. Elida Sifuentez is the only City Councilor
registered for the conference, therefore, it is recommended you appoint her as
the City's voting delegate.
FINANCIAL IMPACT:
There is no additional cost to attend the Saturday business meeting.

RECOMMENDATION:
No action is recommended. This item is placed before the City Council for
information purposes in compliance with the Woodburn Development
Ordinance. The City Council may call up this item for review if it desires.
BACKGROUND:
Fleetwood Homes owns a facility in the industrial park, where it builds
manufactured homes. Fleetwood desires to display and sell manufactured
homes on a portion of the property. The Woodburn Development Ordinance
classifies this use as industrial sales. Fleetwood requested a variance from
Section 2.203.14.B of the Woodburn Development Ordinance, which limits
industrial sales to within 500 feet of Pacific Highway 99E. The industrial sales
component would be conducted in a currently unused office space. The
parking lot would be reconfigured to provide a display area for model
manufactured homes. Concurrent with the variance, Fleetwood applied for a
design review for a structure greater than 1,000 square feet (the existing unused
office space) and an exception to street right-of-way and improvement
requirements for Progress Way.
On August 30r 2007 the Woodburn Planning Commission held a public hearing
on the cases and approved all three unanimously.
