May 24, 2006 to June 5, 2006 at 7:00 p.m. in the Council
Chambers. At 6:30 p.m., they will conduct a public hearing on
Marion County's Butteville Road issue.

0039 ANNOUNCEMENTS.
A) Budget Hearings on the City's 2006-07 budget and the Urban Renewal District 2006-
07 budget will be held before the Budget Committee in the City Hall Council Chambers
on Saturday, May 20, 2006, beginning at 9:00 a.m..
B) Ballot Drop site: City Hall is a designed drop site for the May 16, 2006 Primary
Election. Ballots can be dropped off during regular business hours, however, the City
Hall lobby will remain open until 8:00 p.m. on Election Day.
C) Marion County Board of Commissioners will continue their public hearing
regarding Legislative Amendment 06-2 (Woodburn Periodic Review) on June 5, 2006 at
6:30 pm in the City Hall Council Chambers. The Commissioners will also hold a hearing
on the Butteville Road issue at 6:00 p.m. on June 5, 2006 in the Council Chambers.
Marion County Commissioner Patti Milne also announced a worksession before the
Commission on May 15,2006, 1 :30 p.m., County Courthouse Square, to give the Board
an opportunity to ask more detailed questions with their staff and to go over information
pertaining to the proposed Urban Growth Boundary expansion. It was her understanding
that City staff has been invited to this workshop for the purpose of obtaining a balanced
approach to this proposal.
0129 PROCLAl\'IATION: POLICE MEl\-IORIAL WEEK- MAY 14-20.2006.
Mayor Figley read the proclamation declaring the week of May 14 - 20, 2006 as Police
Memorial Week and encouraged citizens to honor law enforcement officers who have
rendered a dedicated service to their communities and, on May 15, 2006, observe Peace
Officer's Memorial Day.

Mayor Figley thanked our Police Officers for all that they do on a daily basis year after
year.
0264 PRESENTATION: COUNTY STRATEGIC PLAN UPDATE.
Commissioner Patti Milne distributed the Marion County Strategic Plan to the Council
which details issues and goals that the County has been working on over the last 18
months. The process included public involvement by engaging citizens, local community
groups, county employees, and community leaders. She stated that the document before
the Council is the final product of what is important around Marion County and what the
County should spend their time and effort on in order to stay focused and to make good
use of their time, effort, and resources. She reviewed the plan's vision, mission, and
value statements. Those value statements included customer service, professionalism,
integrity, and stewardship. She stated that the goals listed in the Strategic Plan were in
no particular order but they represent the issues that continually arose throughout the
County during this process: (1) Growth and Infrastructure, (2) Public Safety, (3)
Economic Development, (4) Transportation, and (5) Health and Community Services.
She hoped that the Council would find the Strategic Plan as useful information as the
County works on issues that are of interest throughout the County. She also stated that
there are numerous Advisory Boards and Advisory Councils within the County and the
Strategic Plan coordinates with these groups and brings continuity to all of the issues that
are being worked on together.
Councilor McCallum requested that Commissioner Milne explain the Action Plans and
the plans for implementation that each department does since, in the case of the Public
Safety Coordinating Council he had recently received a 60-page document on plan
implementation.
Commissioner Milne stated that the Public Safety Coordinating Committee also has a
Strategic Plan and the County Plan before the Council coordinates with the strategic plan
from the Coordinating Committee. Plans developed by the Health Advisory Committee,
Solid Waste Advisory, or a variety of other groups also coordinate with the County plan
so that the County can stay focused on the needs of the community.
0680 CHAMBER OF COMMERCE REPORT.
Bob Pascalar, representing the Chamber, reported that the Hanging Basket Program is in
progress and baskets should be hung in the near future. He also stated that a joint
meeting of representatives from Food Services of America, SEDCOR, and the Chamber
resulted in a training program for truck drivers through Chemeketa Community College.
This type of program is focused on training drivers who have a route utilizing customer
service and management skills. Students within this program will receive a certificate of
completion which be recognized by multiple companies large and small as training that
adds value to the individual's skill level for a driving job.

0951 WOODBURN SCHOOL DISTRICT REPORT.
Walt Blomberg, Superintendent, corrected a misunderstanding within the community
regarding use of buses for transporting individuals to protest rallies in Salem and
Portland. He stated that the School District contracts with First Student Inc. for bus
services and this company leases and rents buses for purposes other than School
Transportation services. By law, First Student must put the name of the School District
for which the bus normally serves on the side of the bus, however, the lease company can
still serve other businesses and groups on the days or time periods in which the bus is not
being used to transport students to and from school. As a public entity, the School
District must remain neutral on issues and, for the record, he stated that he does not like
to see the students miss school. The district does have policies in place to deal with
students who miss school without parental permission. On May 11 lb, the School District
budget presentation will be made to the Committee and the balanced budget will maintain
class sizes of 23 or below in Kindergarten, 25 or below in primary grades, and targeted
class sizes of 28 or below in upper elementary and middle school, and 30 or below in
high school. Teacher appreciation week is May 8 - 12,2006 and he urged the public to
let the teachers know how much they are appreciated. Lastly, the new Head Football
Coach is Bill Michael who has been a teacher in the Woodburn School District for 10
years. He was an excellent football player many years ago for Linfield College and he
been a coach for many years. Last year was his first year at Woodburn as the Freshman
coach and their team had a good season.
1234 Brian Donaldson, 300 S Evergreen St., stated that he lives on the west side of Woodburn
but commutes to his place of work on the east side oftown (Food Services of America).
He requested that the City look at adding a bicycle lane on Young Street from Downtown
to Highway 99E since there is not much of a pathway on this roadway for bicycling.
1328 CONSENT AGENDA.
A) approve the Council meeting minutes of April 24, 2006;
B) accept the draft Planning Commission minutes of April 27, 2006;
C) receive the Planning Tracking Sheet dated May 4,2006;
D) receive the Building Activity report for April 2006; and
E) acknowledge receipt of the Intergovernmental Agreement for Interchange Funding
memo from Administrator Brown.
Mayor Figley requested an amendment to the Council Minutes under Chamber Report
(tape reading 2114) in that the correct name spelling of the Chamber representative is
Deb Yager.

1392 COUNCIL BILL NO. 2625 - ORDINANCE ADOPTING MILL CREEK
GREENW A Y MASTER PLAN AND MAKING LEGISLATIVE FINDINGS.
Councilor Sifuentez introduced Council Bill No. 2625. Recorder Tennant read the two
readings of the bill by title only since there were no objections from the Council. On roll
call vote for final passage, the bill passed unanimously. Mayor Figley declared Council
Bill 2625 duly passed.
1462 OUSTIDE CITY LIMITS WATER SERVICE AT 280 S. PACIFIC HIGHWAY.
Administrator Brown stated that he had been contacted by the owners of this property late
Friday afternoon (May 5,2006) asking numerous questions about the annexation process.
At this time, the property owners seem to be in the process of thinking about seeking
annexation to the City. He stated that he did commit to them that the he would ask the
Council to wait two more weeks before making a decision. The biggest issue is the
extension of sewer service to this property and there are some cost estimates they need to
review before they commit to taking the next step.
It was the consensus ofthe Council to hold this matter over until the next regular
meeting.
1548 SETTLEMIER PARK LIGHTING UPGRADE - PHASE I.
BJELLAND/NICHOLS... authorize an additional expenditure not to exceed $18,287 on
the contract previously awarded to Kerr Contractors for the Settlemier Park Lighting
Upgrade.
Councilor Cox expressed disappointment in having to increase a contract award so soon
after it had been awarded and questioned ifthe staff should have known that the wiring
needed to be replaced and then included it in the original scope of work.
Administrator Brown stated that staff had been dealing with some unknowns on this
project. There was an irrigation line that had been installed and, as a consequence of
digging the trenching for the irrigation line, the electrical lines were hit in a number of
places since the City did not have effective drawings of where those electrical lines were
located.
Councilor Cox stated that it was his understanding within the report that the City would
have had to spend the money on this project within the near future anyway, however, this
additional work results in the expenditure being made sooner than expected.
Administrator Brown stated that the intent was not to do this particular work at this time
but to make the lighting upgrade work the new wiring needs to be installed.
Councilor McCallum questioned if the lighting was sunset to sunrise or will it be on a
timing device.
Public Works Director Tiwari stated that it is safety related so it will be from sunset to
sunrise and it is additional work which will light the park and not the ballfield.

INDUSTRIAL AVENUE.
A new outlet distillery liquor license application was submitted by Mihai L. Taivan,
DBA: Lil' Bit Distillery, me.. As noted in the staff report, no alcohol or tasting events
will be allowed at this location.
BJELLAND/LONERGAN... recommend to OLCC approval of the liquor license
application for Lil'Bit Distillery, Inc.. The motion passed 5-1 with Councilor Nichols
voting nay.
1880 LIQUOR LICENSE APPLICATION: EL ARMADILLO LOCO. 550 N. FIRST
STREET.
A change of ownership liquor license application was submitted by Pam D.
Yruretagoyena, DBA: EI Armadillo Loco.
BJELLAND/COX... recommend to OLCC approval of a change of ownership
application for El Armadillo Loco. The motion passed 5-1 with Councilor Nichols voting
nay.
1929 PLANNING COMMISSION OR ADMINISTRATIVE LAND USE ACTIONS.
A) Planning Commission's approval of Planned Unit Development 05-01 and
Variance 06-01 located on Lot No.1 of the Town Center at Woodburn Plat: a 7.94
acre parcel which provides for 39 single-family residential lots and 2 common area tracts
located at the southern terminus of Evergreen Road.
No action was taken by the Council to bring this decision up for review.
1972 MAYOR AND COUNCIL REPORTS.
Councilor Bjelland reported that MW ACT has forwarded a recommendation onto Region
II for the Connect Oregon projects that MW ACT hopes to see funding for in our region.
Of the two projects being submitted, one is the approval of the Willamette Valley
Railroad Company's application for a $2.34 million grant to upgrade the rail line between
W oodbum and Stayton in order to provide safety improvements and allow for higher load
freight on railcars. He stated that each Region has $15 million to allocate towards their
projects and, in addition, there is $25 million to be allocated state-wide. He has been
asked to serve on the Consensus Committee for the state projects and he hoped to secure
a portion of the $25 million for projects within MW ACT.

3. Approval of Minutes from December 13, 2005.
Motion to accept the minutes by Herb Mittmann, the motion was seconded by
Joseph Nicoletti.
4. Business from the Audience: None
Department re-organization and Board priorities - John Brown
John provided documents identifying the department's and Direcotr's goals
for 2005-06 and the Capital Improvement Program for the 2005-2006 fiscal
year. John explained the reasoning behind consolidating both the Library and
Recreation and Parks departments. The new Community Services
Department Director will have managers in Recreation, Aquatic and Library.
The new director would be responsible for long-range planning, capital
improvement projects, grants writing, building expansion, forming a 501-3-c
Community Foundation and overall personnel and budget management
reorganizing the departments. Rosetta asked if the two existing Boards
would still function. John replied that both Boards would function and the new
director would be involved with both. The new department will move to City
Hall when the police move to their new facility, and the target date is October.
The Board asked about the playground replacement and John explained the
Capital Improvement process. Herb Mittmann asked if the departments
would have enough personnel, and John replied that the critical thing was to
hire a Library Manager before Linda Sprauer retires in June, then the new
director will answer staffing issues. The Board's priorities were to get the
Greenway started, and finish the Legion Park Master Plan process, and
playground equipment replacement.

7. Division Reports
Recreation and Leisure Services - Steve Patterson
Steve reported that there was a Mother's Day event scheduled on the Plaza,
May 14, 2006. He invited the Board to attend a Weed & Seed meeting on
May 25th at 6:30 p.m. This meeting was open to all agencies that would have
a vested interest in the 5-year grant program, and to start a strategic planning
board. A letter of intent for this million-dollar ~ant needs to be submitted in
June. Steve stated that the first meeting for 4 of July was May 10th at 1 :00
p.m. in the Recreation and Parks office. He has been working with the
Human Resource Department on summer staffing issues, and has schedule a
meeting with OSHA to review safety issues for department policy and future
staff training. Steve reported that Adult softball was starting next week; youth
baseball and softball have already started. He assured the board that Teen
Scene funding was a top priority and the department would know by January
if PAL were going to be a funding source. Rosetta asked why we wasn't
using Woodburn Together for a 501-3-c, and Steve explained that their
intended mission has changed and the volunteer staff is not enough to handle
grant paperwork.
Aquatics - Aquatics
Kathy reported that the big special event this month is Mother's Spa Day on
Sunday, May 21. The event is from 1-4 p.m., and is for women only. The
Woodburn Afterschool Clubs are coming to the pool every Friday this month,
and Gervais Afterschool Program is also coming 4 times this month.
Swimming lessons are offered four evenings per week, and most of the
classes are full for this session. We are currently taking registrations for
summer swim lessons. College students will start to return next week, and
I'm starting to put together the staffing schedule for summer. She also
reported that she would be on vacation from May 25 through June 2. Sharon
Shaver will be in charge while she is gone.
Parks and Facilities - Steve Patterson
Steve reported that the irrigation, soil surface and bleachers were all top
priorities at Centennial Park ballfield #3. He explained the problems with the
fence footings to the Board and said he was waiting on the engineers report
to see how they could get the ballfield open for the season, and have the
field safe and playable. He reported that the Community Center Pre-design
Award would be presented at the next City Council meeting.

ideas he wanted addressed in the future.

The subject property is located at 719 Corby Street. Identified as tax lot #11,300, Marion
County Tax Assessor Map Township 5.. South, Ran~~1 W, S~ction 7DC. There are no
wetlands located on the site and it is located outside the 500year FEMA flood plane.
The property is zoned Medium Density Residentjal (RM) and designated residential
greater than 12 units per acres on the compretJensive plan map.
Properties to the north and south are also zoned RM and in the location of existing
single-family homes and designated residential greater than 12 units per acre.
Parcel to the west is zoned light Industrial (lL) and designated industrial on the
comprehensive plan map and current locati<:>n of the Woodburn Fertilizer Plant.
The properties across the street to the east across Corby Street are zoned single-family
residential and are the location of single-family residences and zoned residential less
than 12 units per acre.

access, which is in the northeast corner of the property. The 24 foot wide shared access
easement with a turnaround does meet the fire district standards as well as with the

Corby Street is currently fully improved with an existing 52.8 footrightof way, 27 foot
improved road surface, 5 foot property line side"Y~lk, 8 foot parkway;' strips on both sides.
In addition, street trees are located abutting the subject property and meet the street tree
standards for the WOO. ;
Staff is in support of the applicant'S variance request to the boundary connecting street
improvement requirement for Corby Street becayse it does provide the minimum
standard of two 12 foot travel lanes. The only tping lacking are bike lanes.

In addition, there are existing older single family homes established along Corby Street.
The widening of the roadway to meet the 60 foo\right of way from the 52 foot existing
right of way would create a hardship on other properties by creating a non-conforming
setback where there is none now.
The current improvements of the street caJ1"accommodate the traffic from two additional
single-family homes and therefore brings the presentation to a close.
Based on the information in this report, information provided by the applicant and the
applicable review criteria, findings to approval partition 06-01 and variance 05-11 can be
made. Associate Planner RichlinQ concluded his presentation and made himself
available for questions.
Chairperson Lima asked if the Planning Commission had any questions for the staff.
Vice-Chairperson Bandelow commented that the condition of approval was the
requirement from the application to enter into an access agreement. She asked if the
condition would be met at the time when the lots would be sold or is it to be completed at
the time of the partitioning of the lot and had it been recorded.
Associate Planner RichlinQ stated that the condition states that it must be met prior to
final plat approval. It will be included in the plat and a maintenance agreement between
the three parcels. It had not been recorded yet on a plat.

applicant, but had a letter to read for the Planning Commission from the applicant,
William Coleman.

Dear Members of the Woodburn Planning Commission:
While it was my intention to be present at all official proceedings concerning my
application for partition, the date of this meeting unfortunately falls upon a time when my
wife and myself are working out of town. So I wish to let the record show that I am being
represented this evening by my good friend PastqrDavid Fitch. It,will probably be
necessary for Pastor Fitch to defer detailed questions from commissions to Mr. Jason
Richling of the Woodburn Planning Commission staff. Mr. Ricpnng has assisted me in
nearly every step of the process to ensure that all Woodbul1) Ordinances and
requirements have been met or exceeded prior to tonighfs meeting.

This application process began nearly a year ago. I purposely moved slowly and
deliberately in order to ensure that any development would be benefiqf81 to the
neighborhood and city, while at the scame time make the best use of the property in
question. Consequently I have made an effort to consult neighbors and planning
commission staff on a regular basis~, After due consideration W~ propose to develop the
two flag lots, parcels 2 and 3, with the construction of single-fcU"hily units.
In closing I wish to thank the commission for its consideration of this matter. I also wish
to offer my gratitude to the Woodburn Planning Commission staff, the Woodburn Public
Works Department and the Woodburn Fire District for their patience and assistance in
making this partition possible.

Commissioner Jenninqs stated that he had some personal observations about the
property and that the application would not build anything that would be a determent to
the neighborhood.
Commissioner Hutchison stated that if the lots in that area were to subdivide, there
would be 10 additional houses on that street with traffic flow. There are many lots being
subdivided and across the street are single-family residential homes. If those eventually
became sub-dividable, the increase in traffic would make an impact.

the zoning area it is permitted, so having single-family homes is much improved for the

another item will be on the Butteville Road conditions.

President Mary Chadwick called the meeting to order at
7:00 pm.
SECRETARY'S REPORT:
The minutes of February 8, 2006 were read aloud and
approved.

PUBLIC COMMENT:

DIRECTOR'S REPORT:
Monthlv Statistics: Circulation is up at 12,075, in
comparison with the same month last year (10,642). The
March People Count stands at 21,315, due in part to the
recent Portland Blazer reading, which drew 2,079 people.
All the other statistics remain stable.
New Board Members: The Woodburn Library Board
welcomes Willis Grafe as a new member of the Library
Board.
Activities: There were 31 children's programs in March,
with 523 total in attendance. Regular Library activities
are ongoing. They include Infant-Toddler Time on
Tuesday mornings at 10:30 am, and Spanish Story time,
which is held at 4:30 pm on Tuesday afternoons, in the
Children's Room. Library story time will continue to be

held at 10:30 am on Wednesdays, and Third Thursday
Teens meets as usual in the Multi-Purpose Room at 6:30 on
the third Thursday of each month. The second Adult
Spring Concert was held on Sunday, April 2, at City Hall,
and featured Glenda McLean, accordionist. AARP has
finished their tax aid to the public, and are now
completing their paperwork and filing tax forms. Tax
Night, held on April 6, was very successful. There will be a
party here at the Library on Sunday, April 23, from 2- 4 pm
to celebrate both National Poetry month and Woodburn
Library's 100th birthday. Cake and punch will be served,
and everyone is invited.
PC Reservation System: A PC Reservation system was
installed on the Reference computers on March 15th. This
is a program that will manage reservation times on the
public computers with only minimal staff intervention, so
that the librarians can be utilized in more productive
ways. Other libraries have used this system successfully.
After some tweaking, the system is working well. Patrons
need to bring their library cards in order to use the system
correctly. As of Wednesday, April 19, all Library patrons
are required to bring their cards to check out materials as
well as to sign onto the computers. Librarians will assist
patrons who live outside of Woodburn and do not have
Woodburn Library cards. Patrons are responsible to keep
track of their library cards. If someone else finds their lost
card, and uses it, the patron will be responsible.
The Staff: The Library Page position applications have
been submitted, and the position should be filled in 8-10
days. Ann Albright, Library Assistant, has tendered her
resignation as of May 15, 2006. She will be moving to
Prineville.
John Brown, Woodburn City Administrator, plans to
advertise for the position of Library Director soon. Linda
spoke with John Brown about proposed changes in the
Library Director's title and duties. The City Council has
approved a proposal to combine the Library and the
Parks and Recreation Department into one overall
Community Services Department. It is proposed that the
Library be placed under the supervision of a Leisure
Services Director, who would also be responsible for the
Recreation and Parks Department. A Library Manager

would be hired to combine some of the duties of the
present Library Director and Assistant Director. The
Manager would directly oversee two positions in Library
Public Services and Technical Services, tentatively titled
"Head Librarian" and "Librarian 2". Linda is supportive of
this change, since it shouldn't have a major impact on
Library staff, and will facilitate the grant writing process for
the Library expansion.
Linda will be retiring on June 30, 2006.
Volunteers of the Month: AS we celebrate the centennial
anniversary of the Library, as well as National Volunteer
month, it is appropriate to honor the current library
volunteer who has been here the longest. Paul Smith
began as a library volunteer in 1990, and has continued
to this day. Quiet and faithful, he comes each week to
work in Technical Processing, preparing new books for
circulation. The Woodburn Library honors him this month
for his dedication and hard work over the years.
Friends of the Librarv: Neal Hawes, Friends of the Library
President, gave an update on Friends business. The
upcoming Book Sale will be held on Friday, April 28 and
Saturday, April 29th. from 10-4 pm. On Monday, April 27-
Wednesday, April 29, Neal and other Friends will be
holding a work party to get the books ready for the Sale.
On Monday, April 24, a volunteer church group will be
working on sorting the sale books. On Tuesday, April 24th,
home schoolers are coming to assist under the direction
of Sandy Kinney. Lori and Neal Hawes started the sorting
process yesterday. In the past months, librarians have
been systematically weeding books throughout the
library, and donating them to the Friends' Book Sale. The
Friends have brought two 8 foot tables into the Carnegie
Room to assist in the sorting process. Music in the Park is
gearing up for the summer season. Renaissance Homes is
a major sponsor this year, donating $2,500. WAASP
(Woodburn Area Association of Senior Programs) has
donated $2,000. Sandy has1/2-3/4 of the band contracts
signed already. The 2006 season of Music in the Park is
fully funded now.

attended OLA this year on Thursday, April 6 and Friday
April 7. Library Board members Mary Chadwick and
Nancy Kirksey went to OLA on Friday. They attended
several classes, one titled Money the Internet Way, and
reported the conference was very informative and
worthwhile.
OLD BUSINESS:
None.
NEW BUSINESS:
Budget: The City's budget process for 2006-07 has
begun. The second Budget Committee Workshop was
held last Saturday. Budget Committee meetings are open
to the public. The process of deciding the budget has
been streamlined, so it does not take as long to allocate
funds. Department heads are given baseline budgets,
identical to what they worked with the previous fiscal
year. Any extra funds needed are requested on a
separate form and processed through the City
Administrator, who brings the request before the City
Council. They then meet in a series of workshops, refining
and deciding how best to use available monies. The
baseline budget is used as the general operating budget.
Linda requested some staff changes for the upcoming
fiscal year. She is asking for one part-time Reference
position to be made full-time, and for the creation of a
part time Security Monitor. She would also to expand the
present 30 hour/week Administrative Secretary position
to full-time. These requests are pending.
At the December meeting of the Library Board, it was
proposed that the Library Board be reduced from 7
members to S. The proposal was passed unanimously by
the Board. So far, the Council has approved a request
for the Library Board's student member's term to be
reduced from two years to one, since their senior year is
so busy.
Nancy Kirksey asked for an update on the dead tree, still
standing, in the Library Park. Linda has forwarded a
request to City Maintenance, asking that they take care
of it.

SUBJECT: Engineering Report for Country Club Road
RECOMMENDATION:
Approve the engineering report for Country Club Road Improvement from
Boones Ferry Road to Astor Way, and direct staff to prepare a resolution of intent
to improve.
(Note: A public hearing date will be set by the resolution of intent to improve
Country Club Road by Council action in the future.)
INFORMATION
The City Council may choose one of the options outlined below for their
decision making.
1. Approve the report as presented
2. Require certain modifications to the report prior to approval
3. Reject the report
BACKGROUND & DISCUSSION:
Country Club Road is identified in the capital improvement program of the City.
The Council, by Resolution 1530, directed the City Engineer to prepare an
engineering report for the improvement of Country Club Road. Staff review
indicates that Country Club Road is designated as an "Access Street" in the
Woodburn Transportation System Plan. The street cross section will be improved
to include two travel lanes, bikelanes and sidewalks on both sides of the street.
The funding sources are outlined in the Engineering Report to support the
construction of the street. These funding sources include the special assessment
funds, the city support and the developer contribution.

The attached report for Country Club Road Improvement outlines the need to
improve the street, the properties in the proposed Local Improvement District
boundary, the cost estimate, the proposed distribution of assessment cost and a
payment plan that allows property owners to pay their obligation in a period of
ten years.
I will be available to answer questions from the council during my presentation
at the meeting.
FINANCIAL IMP ACT:
The recommended action has no financial impact other than staff time.
However. project costs are outlined in the attached engineering report that will
be brought to Council's attention for future actions.

PROCESS FOR
LOCAL IMPROVEMENT DISTRICT (LID)
I. PROJECT INITIATION: Project is initiated by petition or by action of the City
Council
2. RESOLUTION AUTHORIZING AN ENGINEERING REPORT: City
Council, by approval of a resolution, directs staff to prepare an engineers report
for the improvement
WE ARE HERE
3. ENGINEERING REPORT APPROVAL: Engineers report contains, project.:
need, method of assessment, cost estimate based on preliminary engineering,
Local Improvement District (LID) boundary. The City Council may at this stage
direct staff to prepare a "Resolution of Intent to Improve".
4. RESOLUTION OF INTENT TO IMPROVE: LID boundary and assessments
are defined for public process. Public hearing date set with council approval of
resolution.
5. ADVERTISEMENT OF PUBLIC HEARING: The City Recorder gives notice
meeting legal requirements of advertising for public hearing.
6. PUBLIC HEARING: City Council holds a public hearing on the project and
receives input from the affected property owners. If, at the time of hearing,
written remonstrances are received from the owners of majority ofland within the
LID, consideration of the LID must be suspended for six months.
7. CITY COUNCIL DECISION:
a. Direct staff to prepare an assessment ordinance
b. Direct staff make modifications to the LID
c. Abandon or postponement of the LID
8. ADOPTION OF THE ASSESSEMENT ORDINANCE: Funding defined.
9. COMPLETION OF FINAL ENGINEERING: Final engineering plans,
specifications and contract documents are completed.
10. ADVERTISEMENT FOR BIDS AND BID A WARD: The project is advertiscd
and bids are rcceived. The City Council reviews staff recommendation and
awards the contract for construction to the lowest rcsponsible bidder. (Notc: City
may rcceive bids carlicr but contract award can not take place until assessment
ordinance has been adopted)
I I. CONSTRUCTION ACTIVITIES: Construction takes place under the
supervision of the City Engineer. (Note: This is the time when the public sees
project action)
12. FINAL ASSESSMENT ORDINANCE: Upon complction of the improvements
the final assessment process is followed. The process rcquires another public
hearing and explanation of payment plan time lines.

Engineering Report
For
Country Club Road Improvement
1. DESCRIPTION OF IMPROVEMENTS:
A. EXISTING CONDITIONS
Country Club Road between Astor Way and Boones Ferry Road is currently not
improved to city standards. The existing street surface provides only two travel
lanes and a paved shoulder in some areas. There are no curbs and the pedestrian
safety is compromised because there are no sidewalks along the street pavement.
The portion of the street adjacent to the property owned by Qwest was recently
improved to city standards.
B. PROPOSED IMPROVEMENTS
Country Club Road is proposed to be improved in accordance with the W oodbum
Transportation Plan (TSP) as a Access Street with Bike Lanes both sides. This
cross section as identified in the TSP provides two travel lanes, no on-street
parking, Bike Lanes and sidewalks both sides. The improvement will be complete
with curbs, drainage improvements, street lighting and undergrounding the
existing overhead utilities. Attached is Exhibit 1, which depicts the proposed
typical street cross-section.
2. PROPOSED METHOD OF FUNDING:
The funding mechanism to accomplish this project includes the following:
A. CITY SUPPORT:
Budgeted approved funds for the improvement of Country Club Road.
B. ASSESSMENT AGAINST BENEFITING PROPERTIES:
Limited to the cost associated with the improvement allocated to the
benefited properties utilizing city ordinance for Local Improvement
District.
C. OTHER SUPPORT:
Remaining balance of the funds contributed for the improvement of

The Finance Director is authorized to develop a schedule and charge an interest
rate, which does not exceed one-half (112) percent above the estimated net
effective rate of bond sale. Currently this interest rate is estimated at 6.0 percent.

RECOMMENDATION:
Accept the public utility easement granted on May 18, 2006 by Woodburn
School District No. 103.
BACKGROUND:
A connection is needed to supply irrigation water for landscape plantings along
Highway 214 in the vicinity of Woodburn High School. The connection will be
made from an existing city watermain on school property along the west side of
the driveway to a point north of the highway median.
DISCUSSION:
A request for granting a public utilities easement was submitted to the School
District for consideration by their board May 18, 2006. The easement is expected
to be approved.
A draft copy of the easement is attached. The final document will be presented
at the May 22 council meeting. Following recommended action by the council,
the document will be recorded at Marion County.
FINANCIAL IMPACT:
The easement was provided at no cost to the city.

Director on May 12, 2006. The easement was reviewed and approved in
concept by the Board of Directors of Nuevo Amanecer, according to the
Executive Director. The Director was authorized to execute the easement after
review by the attomey of the organization. Delivery of the executed document
was on May 18, 2006. Following recommended action by the council, the
document will be recorded at Marion County.
FINANCIAL IMPACT:
The easement was provided at no cost to the city.

DISCUSSION:
Work on this project will begin within two weeks of award by Council. The term
of the contract is sixty days measured from Notice to Proceed. In anticipation
that contractor payments will be made in the current year and in the next fiscal
year, the project is listed in the current Public Works CIP budget request.

RECOMMENDATION:
Award the Architectural Pre-Design contract to Carleton/Hart Architecture P .C.,
for the amount of $34,135.00, plus related reimbursable expenses not-to-exceed
$1 ,800.00.
BACKGROUND:
The Woodburn Community Center Task Force submitted a "Community/ Cultural
Center Report" in January, 2004. As a result of these preliminary studies, the City
arrived at a consensus regarding future needs for community center facilities in
Woodburn. This direction proposes expanding the Woodburn Memorial Aquatic
Center by adding recreation and fitness facilities to that facility and constructing
social and cultural facilities at a second location.
A Request for Proposals titled "Community Center Pre-Design Services" solicited
firms to design and plan potential future construction of two community center
facilities. The City received eight (8) proposals from professional design and
consulting firms to provide needed professional services. The contract results
from this RFP process.
DISCUSSION:
The Request for Proposals was made available on March 3, 2006. Proposals
were received by the Recreation and Parks Department on or before April 7,
2006. Staff reviewed eight proposals from different architectural firms on the
following criteria: The Project Team and the Firm's Capability to complete this
project, The Firm's Understanding and Approach to this Project, and Project
Examples. Price quotes were also scored using formulary basis for the price
quote as presented in the Request for Proposals. Following this scoring, the

selection team interviewed the top four scoring firms, and a reference check
was conducted.
As a result of the process, the selection team decided on Carleton/Hart
Architecture as their choice for awarding the pre-design contract.
A "Notice of Intent to Award" was mailed to all firms that submitted proposals on
May 15, 2006.
FINANCIAL IMPACT:
Carleton/Hart Architecture proposed a pre-design services fee of $34,135.00 plus
$1,800.00 of anticipated reimbursable expenses, for a total of $35,935.00. The
pre-design services will be funded using approved Capital Improvement Project
funds that were budgeted for this purpose.

BACKGROUND:
On April 24, 2006, the City Council considered terminating water service at 280 S.
Pacific Highway. The Council deferred their decision for two weeks, to allow the
property owner to confer with their legal counsel regarding annexation and to
coordinate with City staff. On May 5, 2006, the owners discussed with me
questions related to annexation and the costs of connecting to City services.
They asked that the Council postpone its decision to allow them more time to
evaluate these matters. On May 8, 2006, Council agreed to extend its
deliberations on the matter for another two weeks. Additional background
information on this matter is provided as Attachments 1 through 3 to this report.
DISCUSSION:
As of the writing of this report (5-18-06) no further communication was received
from the property owner or their legal counsel. Accordingly, it is recommended
the water service at 280 S. Pacific Highway be disconnected immediately.
As you were previously advised, the City may legally terminate service to this
property. Consistent with your policy direction, water service can be restored to
this property if an annexation agreement is executed with the owner.
FINANCIAL IMPACT:
There is currently no calculable financial impact associated with the
recommended action.

It is recommended the City Council:
1) Authorize disconnection of water service to 280 S Pacific Highway; and
2) Adopt the policy that water services outside city limits, will be terminated
upon a change of ownership or use, or lapse in use of greater than six
months.
BACKGROUND:
Due to historical development, the City provides wastewater and/or water
service to a limited number of properties outside city boundaries. There are
currently 17 such properties receiving only water service. Of those, nine (9) are
residential users, mainly located just east of Pacific Highway. The remaining
eight (8) are all commercial properties, located directly on Pacific Highway.
280 S. Pacific Highway is located outside, but immediately adjacent to, city
limits. The property is shown on the attached drawing. It was formerly the site of .
the Miles Chevrolet dealership, and was subsequently a manufactured home
dealership. Except for a nightclub that opened and then closed when the
current owner purchased the property in 2002, no commercial activity has been
conducted on the site since the manufactured home dealership closed.
The property is served by a 3,4 inch meter (standard residential size) connection.
This provided water to the showroom restrooms, but is not sufficient for fire-flow.
The property was served by a septic system, which was sized in proportion to
residential water use. Although water use at the property has been minimal, or
none, the account remains active and minimum meter charges have been
made. Water use occurred in 2005 due to a developing leak, which became

significant in December 2005 and for which a leak adjustment was processed in
February 2006. There has been no water use since the leak was repaired.
A search of city documents uncovered no record of any historical "will-serve"
agreements for the property, and no agreement exists between the City and
the current owner to provide water service to the property.
DISCUSSION:
The owner contacted the City recently, asking that additional water be made
available to the property for fire-flow. The owner indicated he intends to use the
property as an activity center where parties and similar events can be held. The
owner was advised that city policy required the property to annex before
additional service would be provided. Staff also advised him that city sewer
service would also be required, as the on-site septic system is presumably
inadequate for the use, and contrary to the City's wastewater ordinance.
The owner contacted the City through an attorney, to indicate he will not annex
to the City and to demand the additional water. The City Attorney reiterated
the City's position to the attorney, and legal authority for that position.
It is City Council policy not to serve new customers located outside city limits
without an annexation agreement. Staff has applied this policy to service
upgrades; no upgrade will be made to services currently outside city limits unless
the property is annexed. The City Attorney has determined, and long-
established case law supports, any utility service provided outside of city limits is
at the discretion of the Council, regardless of previous service or length of time
that service existed.
Concerns arose almost immediately when the nightclub use opened on this
property, none of which were within the City's jurisdiction to address because it
is outside city limits. Among these were development code, law enforcement,
and wastewater disposal concerns. Although the owner now indicates a
different proposed use, there is still strong reason for the City to have regulatory
jurisdiction over the property. Some of these concerns may still be relevant, as
are issues related to demand on the water system and application of sufficient
systems development charges. Annexation provides that jurisdiction.
There has been no significant use made of, or water use at, the property since
2002. Staff advises that in this situation, the service has been functionally
abandoned. Accordingly, and to strengthen the City's position with respect to

annexation as a condition to providing additional services, it is recommended
the water service at 280 S. Pacific Highway should be disconnected at this time.
In addition to the foregoing approval, staff seeks broader policy direction from
the Council for dealing with properties outside city limits that have historically
been provided water service. Staff proposes to terminate water service at those
locations upon a change of ownership or use, or lapse of use for a six-month
period.

property into the City. The Rodriguez family indicated they understood the Council's annexation
and utilities service policies, and the time frame allowed by the Council for resolving this matter. As
of today, we have had no contact from your office or your clients.
Unless substantial progress has been reached on an annexation agreement with your client, it will be
the City Administrator's recommendation on May 8,2006 to terminate all water service at 280 S.
Pacific Highway. The City Administrator and I will be are available to meet with you next week.

DISCUSSION:

during the week of April 24, 2006. On April 28th the City Attorney wrote owner's
counsel, to remind him of the May 8, 2006 deadline, to provide him with forms
necessary for an annexation application, and to offer staff's assistance, as
needed (Attachment 2). The Attorney also advised that if substantial progress
was not made toward initiating an annexation request staff would, on May 8th,
recommend termination of water service at 280 S. Pacific Highway.
As of the writing of this report (5-04-06) no communication was received from
the property owner or their legal counsel. Accordingly it is recommended the
water service at 280 S. Pacific Highway be disconnected immediately.
As indicated in the attached report, the City may legally terminate service to
this property. Consistent with your policy direction, water service can be
restored to this property if an annexation agreement is executed with the owner.

BACKGROUND:
On May 11, 2006, the Planning Commission adopted a final order approving
Partition 06-01 and Variance 05-11 to partition an existing 0.81-acre property into
three (3) single-family residential lots in the Medium-Density Residential (RM)
zone and variance to the street improvement requirement for Corby Street.
The subject property is addressed as 715 Corby street. It is further identified on
Marion County Assessor Maps as Township 5 South, Range 1 West, Section 7DC,
Tax Lot 11300. The property is currently developed with a single-family residence
and detached garage/accessory structure. The applicant proposes to divide
the subject lot into 3 parcels. Proposed Parcell is 10,616 square feet (excluding
the 24-foot wide access easement), proposed Parcel 2 is 9,164 square feet
(excluding the 24-foot wide access easement) and proposed Parcel 3 is 9,298
square feet (excluding the 24-foot wide access easement). Parcels 2 and 3 are
flag lots to be accessed via a 24-foot wide shared access easement.
The subject property is zoned Medium-Density Residential (RM) and designated
Residential Greater than 12 Units Per Acre on the Woodburn Comprehensive
Plan Map. The properties to the north and south of the site are zoned RM,
designated Residential Greater than 12 Units Per Acre on the Woodburn
Comprehensive Plan Map and developed with single-family residences. The

BACKGROUND:
On May 17, 2006, the Woodburn Community Development Director approved
the request for Design Review approval to construct a 160 square foot drive-
through coffee and espresso kiosk on a 28,564 square foot parcel located at
2285 National Way in the Commercial General (CG) zone. The subject site can
be identified specifically on Marion County Assessor Map T5S, R1W, Section 8A,
Tax lot #s 1600 and 1701.
The subject property is currently divided into two lease areas. The western 12,586
square feet of the site is leased to the Foursome Golf Car manufacturing facility
and Purina Distribution Center and is improved with a paved vehicle
maneuvering area, loading spaces and site landscaping. The eastern 15,978
square feet of the site is currently vacant and is improved with a paved vehicle
maneuvering area, curbs along the north and south property lines, three off
street parking spaces, and site landscaping. A 186-foot long unimproved grass
area separates improvements on the east and west portions of the site and
precludes through access from National Way and North Pacific Highway. The
applicant proposes a 160 square foot drive-through coffee and espresso kiosk,
landscaping, and off street parking on the eastern portion of the site.
The subject property is zoned Commercial General (CG) and designated
Commercial on the Woodburn Comprehensive Plan Map. The properties to the
north and west (across National Way) are zoned Industrial Park (IP) and
designated Industrial on the Comprehensive Plan Map. The property to the

currently developed as the Foursome Golf Car and Purina distribution facility (to
the northwest) and Goodwill Industries (to the northeast). The industrial property
to the west (across National Way) is currently vacant. The commercial property
to the south is the location of Fastenallndustrial Building Supply and a Unocal 76
gas station. The commercial properties to the east (across North Pacific
Highway) are currently developed as Kilroy's Self Storage and a vacant
commercial structure. No wetlands are located on the subject site and it is
located outside of the 500-year floodplain.
Previous land use decisions exist on the subject site. The northern 15,680 square
feet of the subject property was created in Minor Partition Case File No. 85-04.
On April 28, 2006 the Woodburn City Council adopted Council Ordinance No.
1949 to change the Comprehensive Plan Map and Zoning designation of the
subject property from Industrial Park and Industrial Sales to Commercial and
Commercial General. On July 26,2001 the Woodburn Community Development
Director approved Lot Line Adjustment Case File no. 01-03 to increase the
dimensions of the subject property from 15,680 square feet with 32 feet of street
frontage to 28,564 square feet with 58 feet of street frontage. Prior to the current
proposal, the subject site was developed as excess parking and vehicle
circulation for the Woodburn Community Market, a retail use formerly located
on the property to the south.
The applicant is Brandi Graff and the property owner is Halter Oil Co., Inc.
DISCUSSION:
