BACKGROUND: The City of Woodburn was awarded $470,412 in Community Development Block Grant (CDBG) funding from Business Oregon to prevent, prepare for, and respond to the impacts of the COVID-19 pandemic, and specifically, responding to the economic impact of the pandemic on low- and moderate- income (LMI) households. Under the Impact Assistance CDBG program, the City of Woodburn executed a Memorandum of Understanding (MOU) with Marion Polk Food Share (MPFS), the property owner and operator of the AWARE Food Bank located at 154 Arthur Street in Woodburn. Marion Polk Food Share is a community-based nonprofit organization dedicated to providing assistance and services to Mid-Willamette Valley families. The CDBG-CV award and MOU allowed MPFS to purchase food and health- related supplies to bridge the gap in services under the AWARE Food Bank service umbrella. It is assumed 100% of program beneficiaries are low to moderate income. Agenda Item Review: City Administrator_X City Attorney_X_ Finance_X_ 8 Honorable Mayor and City Council July 27, 2026 Page 2 DISCUSSION: As a condition of receiving CDBG funding, the City is required to hold a public hearing at the time of grant application and again prior to grant closeout. Staff has completed the remaining grant closeout requirements, and all grant funds have either been disbursed or are in the process of being passed through to Marion Polk Food Share (MPFS). At the time of CDBG grant closeout, Marion Polk Food Share (MPFS) estimated that the funding assistance allowed them to purchase an estimated 354,338 pounds of food which provided over 295,281 meals. In addition, the purchase of shelf-stable food and other supplies with the grant funding will enable MPFS to continue meeting increased community demand for many months beyond the grant period. FINANCIAL IMPACT: Municipalities are not eligible to use CDBG funding to cover program and/or staff time/costs, so all funding was passed through to Marion Polk Food Share for program administration. 9 ______ ,4 '2 WOODBURN 7....po7r 7 77 July 27, 2026 TO: Honorable Mayor and City Council through City Manager FROM: McKenzie Granum, City Attorney Curtis Stultz, Public Works Director SUBJECT: Resolution Declaring the Public Necessity and Purpose for Acquisition of Waterline Easement - Salud Medical Center Fire Control Utility Connection RECOMMENDATION: Adopt a Resolution declaring the public necessity and purpose for acquisition of a waterline easement and authorizing good faith negotiations and condemnation actions. BACKGROUND: In 2024, Yakima Valley Farm Workers Clinic ("YVFWC") submitted and received City approval of a consolidated land use application for the redevelopment of the Salud Medical Center facility located at 1175 Mt. Hood Avenue in Woodburn ("Salud Property")(Woodburn Planning File No. DR 23-09, SA 23-07, & VAR 23-07). As part of YVFWC's land use approval, the City conditioned the approval on the YVFWC meeting fire protection standards for the site that comply with current fire code and the Woodburn Fire District requirements. In order to meet these standards, a looped municipal waterline running from the Salud Property and connecting to the public waterline on the westerly adjacent property at 1055 Mt Hood Avenue, Woodburn, Oregon ("Adjacent Property"), still needs to be constructed to provide adequate flows for a new fire hydrant on the Salud Property ("Infrastructure Improvement"). Completing this improvement requires installation of an underground public waterline connection across a very small portion of the Adjacent Property. At this time, the owner of the Adjacent Property has not agreed to grant the public utility easement necessary for the waterline to be constructed and make the critical connection across their property. Agenda Item Review: City Manager X City Attorney X Finance X 10 Honorable Mayor and City Council July 27, 2026 Page 2 Failure to complete a looped waterline system in the vicinity of the Salud Property will further exacerbate the fire flow deficiencies identified for this area of the City, per Figure 4-1 of the City's Water System Master Plan. At your March 23, 206, meeting, Council authorized the City to undertake all steps necessary to complete the Salud Medical Center Fire Control Utility Connection, including entering into negotiations over the acquisition of necessary public easement rights and completing related construction work. DISCUSSION: Through the City Engineering department, staff has undertaken informal negotiations with the Adjacent Property owner in an attempt to acquire the necessary public easement rights. Unfortunately, the informal processes have failed to yield any agreement between the City and subject property owner. So, staff is requesting the City Council adopt a Resolution further authorizing the commencement of legal condemnation proceedings to acquire all necessary rights and privileges. The steps for a condemnation proceeding include the following: (i) The City must first declare by a resolution or ordinance the necessity and purpose for which the property is required; (ii) Just compensation must be determined for the property, which means the fair market value of the highest and best use for the property. To establish just compensation for the easement right, the City intends to hire an appraiser to render an opinion of the property's value; (iii) The City must then attempt to agree on the amount of just compensation with the adjacent property owner. Significantly, the City must make a written offer accompanied by an appraisal to acquire the property at least 40 days before filing an action for condemnation; (iv) If an agreement is unable to be reached and the minimum 40 days to accept or reject the offer passes, the City would subsequently file an action to condemn the property in Marion County Circuit Court; (v) After the court action is commenced, the City would deposit the amount estimated to be just compensation into a fund and obtain a court order seeking immediate possession of the property, which would allow the City to complete the underground waterline connection prior to any trial; and (vi) The final amount of just compensation will be reached either by a pre- trial negotiation or after the jury renders the verdict 11 Honorable Mayor and City Council July 27, 2026 Page 3 Throughout this process, City staff will continue to negotiate in good faith and in accordance with all applicable laws, rules, and regulations in an attempt to reach agreement as to the amount of Just Compensation owed to the affected property owner. WHEREAS, under ORS Chapter 35, a local government agency is authorized to declare by resolution or ordinance the necessity and the purpose for which it is initiating acquisition of certain property rights; and WHEREAS, the City has an adopted Comprehensive Plan with Water System Master Plan that includes a policy for the City to "develop a supply and [water] distribution system that provides for reliable fire protection"; and WHEREAS, the City is undertaking a project to complete a looped municipal waterline connection running from the Salud Medical Center property located at 1 175 Mt Hood Avenue, Woodburn, Oregon, to the westerly adjacent property at 1055 Mt Hood Avenue, Woodburn, Oregon, including the construction of a five- foot (5') waterline extension over the property at 1055 Mt Hood Avenue ("Infrastructure Improvement Project"); and WHEREAS, construction of the Infrastructure Improvement Project advances the City's goal of completing Project No. M-6 in the City's adopted Water System Master Plan and addresses and mitigates the fire flow deficiencies identified in this area of the City, per figure 4-1 of the Water System Master Plan; and WHEREAS, in order to complete construction of the Infrastructure Improvement Project, the City must acquire a permanent waterline easement over a portion of the property at 1055 Mt Hood Avenue, Woodburn, Oregon; and WHEREAS, the Infrastructure Improvement Project has been planned and located in a manner which is most compatible with the greatest public good and causes the least private injury; and WHEREAS, the City has authority under its Charter, ORS 225.020, and ORS Chapter 35 to acquire rights of way, easements, and fee property by good faith negotiation, agreement, and purchase or by exercise of the power of eminent domain with condemnation proceedings; and WHEREAS, after first declaring through this Resolution the necessity of the acquisition of real property and the purpose for which it is required, ORS 35.235 requires the City to attempt to agree with the owner of said real property the Page 1 - COUNCIL BILL NO. 3308 RESOLUTION NO. 2266 13 compensation to be paid therefor, and the damages, if any, for the taking thereof, NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. The construction of the Infrastructure Improvement Project is necessary for the public interest, and has been planned, designed, located and will be constructed in a manner that will be most compatible with the greatest public good and the least private injury. The City's staff are authorized to negotiate an agreement with the owner and other persons in interest as to the compensation to be paid for the acquisition and, in the event that no satisfactory agreement can be reached, the City's staff are authorized to commence and prosecute such condemnation proceedings as may be necessary to finally determine just compensation or any other issue appropriate to be determined by a court in connection with the acquisition. Agenda Item Review: City Manager X City Attorney X Finance X 20 INTERGOVERNMENTAL AGREEMENT This Intergovernmental Agreement is entered into under the authority granted under ORS § 190.010 between the City of Woodburn (City) and Woodburn School District (District) for the purpose of clarifying the duties and responsibilities of School Resource Officers (SRO) to be placed with the District and to define the responsibilities of each of the governmental bodies for the supervision, support, and financial obligation of that position. NOW,THEREFORE, THE PARTIES AGREE AS FOLLOWS: A. CITY'S RESPONSIBILITIES 1. The City will provide up to three sworn police officers for assignment to School Resource Officer positions during the term of this Agreement. The officer's primary duties will be assigned to any one of the Woodburn School District schools, or a variation of schools, while school is in session. The officers may, however, be used for other police duties outside of the school year.The City reserves the right to reassign these officers to other police duties, irrespective of school sessions, when an emergency exists and the officers are required elsewhere.The determination of an emergency is at the discretion of the Chief of Police. 2. Over the agreement period, the City will provide $593,530.00 toward the salary and fringe benefits of the School Resource Officers. 3. The City will be mutually involved with School Administrators in the selection of any officer assigned to this position. 4. The Chief of Police will be solely responsible for the supervision and performance evaluation of the School Resource Officers, but the City agrees that the Chief will seek and utilize information provided by school administrative personnel in the performance of those duties and the officers' suitability to continue in that position. The City will cooperate in any investigation being conducted by the District, law enforcement, OHS, ODE and/or TSPC to the extent allowed by law, policy or memorandum of understanding. At the direction of the District, the City will immediately remove any SRO from all District premises where the Superintendent of the District determines, in the Superintendent's sole discretion, that removal of the SRO would be in the best interests of the District. Page 1 of 7 21 B. DISTRICT'S RESPONSIBILITIES 1. During the term of the agreement, District will contribute $105,000.00 toward the salary and fringe benefits of the School Resource Officers. The City will invoice the District quarterly. 2. The District agrees to allow the SRO to participate in appropriate in-service training, or other training deemed necessary by the police department, to be included in general staff activities, and to provide facility office space for the officers to work from. 3. The District will review and approve any curriculum to be presented to students, staff, or parents by any officer. 4. The District agrees to assist the Chief of Police in establishing annual goals for the School Resource Officer positions. C. SCHOOL RESOURCE OFFICER'S DUTIES The day-to-day operational and administrative control of the SRO will be the responsibility of the City. However, the SRO will collaborate with the building administrators (principal and assistant principal) to address situations as they arise in the building and to determine the most effective use of the SRO's time and expertise. The following list of duties is not intended to be all-inclusive but to describe the principal activities in which the officers may be involved. These activities will not be performed each day, but as the need dictates. 1. Be physically available at appropriate times for personal interaction with youth at school, including informal discussions with students, staff, or parents during breaks, lunch, and before and after school activities. 2. Identify youths at risk of becoming delinquent through referrals to the School Resource Officer from school personnel, student advisors, parents, and via interaction with students themselves. 3. Assist in the diversion of youths identified as at risk of becoming delinquent from entry into the juvenile justice system through crisis intervention and referral to other resources and outside agencies. 4. Provide prevention education on vandalism, shoplifting, social media crimes, substance abuse, child and sexual abuse, and issues of personal safety. Page 2 of 7 22 5. Perform as a resource center for youth needing referrals to the appropriate government or private service agency. 6. Act as an information source for District personnel on issues or criminal trends involving youth. 7. Participate and support youth organizations designed to promote responsible behavior(i.e., Natural Helpers, Oregon Student Safety on the Move, Oregon Teen Leadership Institute, etc.). 8. Take appropriate corrective enforcement or referral action in the schools on behavior coming to the officer's attention which is criminal. 9. Promote a positive attitude of youth toward community, school, and local government, including police. 10. Develop and teach classes relevant to youth and crime issues which are germane to this community. 11. Develop and teach classes regarding civic competence, rights and obligations of youth according to law, rights and responsibilities of citizenship, and the role of citizenship in society. 12. Develop and provide programs which produce peer conflict mediation. 13. Maintain records of calls for service and share to the extent allowed by law, to the District by the officer, and the number of hours worked during the year relative to school issues. 14. Attend and participate in the North Marion County Youth Service Team (YST) meetings in an effort to provide a coordinated community-based delivery system of crisis intervention, counseling, consultation and referral, and training to youth, their family and community, and to promote cooperation and understanding between the different agencies. (3 meetings a year) 15. Attend and participate in safety-related meetings, such as Risk assessment screenings and site safety meetings, as needed. D. DESCRIPTION OF PARTNER ROLES AND RESPONSIBILITIES Page 3 of 7 23 Each party agrees SRO's will not respond to or be responsible for requests to resolve routine discipline problems involving students.The administration of student discipline, including violations of the student code of conduct and instances of student misbehavior, is the responsibility of school administrators, unless the violation or misbehavior involves criminal activity. E. INFORMATION SHARING The District has given rights to City officers serving as SRO's to view educational records for all District students per Woodburn School District Policy JO/IGBAB (AR). For the purposes of FERPA, the District considers the SRO position as that of a school official and a contractor who assists in performing necessary institutional services on behalf of the District. It therefore has legitimate educational interests in student records. Pursuant to District policy, all District staff with rights to view educational records, including SRO's, will abide by said policy and receive appropriate training and guidance. The City agrees to share information with District officials having a need to know such information so long as sharing of said information is allowed by state or federal law and the City. F. MODIFICATION OF AGREEMENT Each party to this agreement will bi-annually review the conditions of the agreement to determine if it is being properly administered, complied with, and to determine its sufficiency to meet program needs. Any modification of the terms of this Agreement shall be executed in writing with the mutual consent of both parties. G. TERM OF AGREEMENT The term of this Agreement shall commence July 1, 2026, and continue through June 30, 2027.This Agreement may be terminated prior to that date by mutual consent of both parties or by one party notifying the other of their intent to discontinue participation no later than 180 days prior to the end of the fiscal year. H. RENEWAL OF AGREEMENT The parties may renew this Agreement on the same terms and conditions as contained herein by executing a mutual written renewal agreement before the end of the term of this Agreement. I. MISCELLANEOUS 1. INDEMNIFICATION Subject to the conditions and limitations of the Oregon Constitution and the Oregon Tort Claims Act, ORS 30.260 through 30.300, City shall Page 4 of 7 24 indemnify, defend, and hold harmless District from and against all liability, loss, and costs arising out of or resulting from the acts of City, its officers, employees, and agents in the performance of this agreement. Subject to the conditions and limitations of the Oregon Constitution and the Oregon Tort Claims Act, ORS 30.260 through 30.300, District shall indemnify, defend, and hold harmless City from and against all liability, loss, and costs arising out of or resulting from the acts of District, its officers, employees, and agents in the performance of this agreement. 2. INSURANCE. Each party shall insure or self-insure and be independently responsible for the risk of its own liability for claims within the scope of the Oregon tort claims act (ORS 30.260 to 30.300). Each party shall be responsible for providing worker's compensation insurance as required by law. 3. PUBLICITY AND USE OF PROPRIETARY MARKS. Each party shall obtain prior written approval from the other parties prior to using the other party's trademarks, trade names, logos, or images (collectively, " Proprietary Marks") in connection with carrying out projects or activities under this IGA. This applies to all uses regardless of whether on the web, in print, or in any other media. Once approved, similar uses in the same context and format will not require additional approval. In the event this agreement expires or terminates for any reason, each party shall immediately discontinue using the other party's Proprietary Marks. 4. ADHERENCE TO LAW. Each party shall comply with all federal, state and local laws and ordinances applicable to this agreement. 5. NON-DISCRIMINATION. Each party shall comply with all requirements of federal and state civil rights and rehabilitation statutes and local nondiscrimination ordinances. 6. RELATIONSHIP OF PARTIES. Neither party, nor the officers, employees or agents of either party, are employees or agents of the other for any reason. Each party shall be separately and exclusively responsible for all acts, errors and/or omissions of its own officers, employees and agents, except to the extent provided in the section entitled "Indemnification" of this Agreement. 7. AUTHORITY. Each Party represents and warrants that it has the full right and power to enter into this IGA and that it is fully ready, willing, and able to perform all its obligations hereunder. 8. ASSIGNMENT.The obligations and duties contemplated by this IGA are specific to the Parties involved. No party may assign the rights and responsibilities contemplated by this IGA to any other individual or entity. Page 5 of 7 25 9. NO THIRD-PARTY BENEFICIARIES. No provisions of this IGA are intended or will be construed to confer upon or give to any person or entity other than the signatories to this IGA any rights, remedies or other benefits under or by reason of this IGA. 10. RECORDS. Each Party shall retain all its own records relating to this IGA and projects/activities carried out under this IGA for a period of six years following expiration or termination of this IGA. 11. NOTICES. Any notice under this IGA must be in writing and will be effective when actually delivered in person or three (3) days after being deposited in the U.S. mail, registered or certified, postage prepaid and addressed to the party at the address stated in this IGA or such other address as either party may designate by written notice to the other. Merger Clause; Waiver.This IGA constitutes the entire agreement between the Parties on the subject matter hereof.There are no understandings, agreements, or representations, oral or written, not specified herein regarding this IGA. No waiver, consent, modification or change of terms of this IGA shall bind either party unless in writing and signed by both parties. Such waiver, consent, modification or change, if made, shall be effective only in the specific instance and for the specific purpose given. Authorize the City Manager, or their designee, to sign the vehicle lease agreement with Leasing Specialists, LLC. BACKGROUND: The Police Department currently operates two police motorcycles that are now beyond their recommended service life due to age, mileage, and increasing maintenance needs. To maintain operational readiness, ensure officer safety, and reduce ongoing repair costs, the Police Department recommends replacing these two units with two new BMW police motorcycles. BMW police motorcycles offer enhanced handling, braking, performance, and reliability when compared to the aging units currently in service. The new motorcycles will be fully outfitted for patrol operations and integrated into the department's existing fleet deployment model. DISCUSSION: Pursuant to ORS 279A.215, the City may utilize a price agreement established through a permissive cooperative procurement to award a contract for goods and services, in lieu of conducting an independent competitive selection process. Through the Oregon Cooperative Purchasing Program, the City identified Leasing Specialists, I.I.C. as an appropriate vendor capable of providing competitively priced lease terms for police vehicles, including specialized police motorcycles. Due to ongoing supply-chain and manufacturing delays, final outfitting costs may increase upon vehicle delivery, and updated financing terms may be required within thirty days of order fulfillment. The Police Department's existing budget will cover the expenses. 29 WQQBrR, d re c, r, ar nrae/ f y July 27, 2026 TO: Honorable Mayor and City Council through City Manager FROM: Jesse Cuomo, Community Services Director SUBJECT: Purchase of Fitness Equipment for the Mill Creek Community Center Project RECOMMENDATION: Authorize the City Manager to sign a purchasing agreement with Pacific Fitness Products LLC in the amount of $234,779.45 for the purchase of fitness equipment for the Mill Creek Community Center. BACKGROUND: In February 2026, the City Council approved the Guaranteed Maximum Price (GMP) for the Mill Creek Community Center construction contract with Triplett Wellman in the amount of $18,000,778 (hard cost). The GMP includes both the City's contingency and the contractor's contingency. Construction commenced at the end of February 2026. The new Mill Creek Community Center will include a 2,100-square-foot fitness room featuring a variety of cardio equipment, strength-training machines, and free weights, as well as a 950-square-foot fitness studio designed for group exercise and wellness programming. In addition to the project's hard construction costs, which include structural, electrical, plumbing, and heating, ventilation, and air conditioning (HVAC) systems, the project budget includes soft costs necessary to furnish and equip the facility. These items include event space furnishings, office and lobby furniture, and fitness equipment. Staff solicited proposals from three fitness equipment providers: Life Fitness, TRUE Fitness, and Pacific Fitness. Pacific Fitness submitted the only responsive proposal and provided the equipment selection that best met the City's operational needs and programming goals for the Mill Creek Community Center. In addition, Pacific Fitness is an approved vendor through the State of Oregon's cooperative purchasing program, OregonBuys, allowing the City to utilize an Agenda Item Review: City Manager X City Attorney X Finance X 30 Honorable Mayor and City Council July 27, 2026 Page 2 established procurement contract. In late June 2026, City staff toured the manufacturer's facility to inspect much of the proposed equipment and verify its quality, durability, and functionality prior to making a final recommendation of purchase. The proposed fitness equipment package includes cable strength machines, selectorized weight machines, traditional and slat-belt treadmills, ellipticals, cross trainers, steppers, row machine, recumbent bikes, exercise bike, free weights, and functional training accessories, including resistance bands, medicine balls, and yoga mats. The equipment has been selected to provide a comprehensive fitness experience that accommodates users with a wide range of ages, abilities, and fitness levels while maximizing the square footage available. DISCUSSION: The contract award is in conformance with public contracting laws of the State of Oregon, as outlined in ORS Chapter 279, and the laws and regulations of the City of Woodburn. FINANCIAL IMPACT: The subject project is identified in the adopted fiscal year 2026-27 Budget and funded by the Capital Construction Fund. Customer's notice of delivery schedule cancellation must be received by PFP no less than three(3)workdays prior to the confirmed delivery date and time. Detailed Terms of Delivery Pacific Fitness Products delivery fees include one(1)trip for delivery,installation, product placement,testing,and trash removal. Entertainment Programming,1 return trip No Fee-each additional return trip will be$200.00. The following utilities:electric, internet,cable, must be functioning at the time of delivery to avoid additional return visits. Pacific Fitness Products schedules deliveries 3 weeks in advance.If a rescheduled delivery is canceled anytime within the 3-week period before the scheduled date,the next delivery date may be a minimum of 3 weeks from the date of reschedule. The following additional fees may occur due to lack of readiness if resulting in scheduling conflicts or cancellations. Late cancellation with less than 3 days'notice for delivery:$150 If a confirmed scheduled delivery is canceled the day before or day of,due to lack of facility readiness,there will be additional fees for redelivery and storage of equipment. Re-delivery/return visit rates due to lack of readiness start at$395. Storage rates after 30 days:$2.50/per day per pallet. 3.PARTIAL SHIPMENT:PFP reserves the right to make partial shipments of products ordered by Customer as such products become available for shipment and may invoice separately for each shipment.Partial shipment of products shall not relieve Customer from Customer's obligation hereunder to accept shipments of the remainder of the order. 4.RISK OF LOSS:Title and risk of loss shall pass to Customer upon PFP's delivery of the equipment to a common carrier,authorized 3rd party delivery firm,or to Customer. 5.PAYMENT:Unless otherwise indicated,the terms of payment are as they appear on the signed sales proposal and/or sales order documents.PFP reserves the right to require full or partial payment in advance.All invoiced amounts shall be paid within thirty(30)days unless otherwise stated.Past-due amounts bear interest at 1.5%per month or the maximum allowed by law.Customer shall be responsible for all taxes arising out of or related to the provision of products and services ordered, unless proper tax-exempt paperwork is provided. 6.SECURITY INTEREST IN GOODS:Customer grants PFP("Seller")a purchase-money security interest("PMSI")in all goods,equipment,and accessories sold or leased by Seller to Customer(the"Collateral"), including proceeds thereof,to secure payment of all obligations,fees,and costs arising under this Agreement. Default.Customer is in default if it fails to pay any amount when due, breaches this Agreement,or becomes insolvent or subject to bankruptcy proceedings. Seller's Remedies.Upon default,Seller may,to the extent permitted by law,exercise remedies under the Uniform Commercial Code(UCC), including: 1.Repossessing the Collateral,with or without judicial process; 2.Requiring immediate payment of all outstanding obligations; 3.Selling, leasing,or otherwise disposing of the Collateral in a commercially reasonable manner,and pursuing any deficiency balance;and 4.Seeking any other remedies available at law or in equity. Customer Cooperation.Customer agrees to execute any documents and take any actions reasonably requested by Seller to perfect, maintain,and enforce Seller's security interest,including filing UCC-1 financing statements. 7.GOVERNING LAW:This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.The exclusive forums for the resolution of any disputes hereunder shall be Washington state courts in the County of Snohomish or federal courts in the State of Washington. 41 8.RETURNS:New, unused Finished Goods/Product currently sold by PFP may,but only with prior written authorization,be returned.In no case is any equipment to be returned without a proper Return Authorization(RA).RA's must be assigned and approved and can be obtained by contacting your Sales Representative or calling our corporate office at 800-495-2008(8:00 AM-4:00 PM PT).PFP assumes no responsibility for damage caused by shipping or improper packaging,and all items being returned must be received by PFP in the same condition as when originally shipped/delivered.Items being returned from the Customer's site will be handled by the original delivery company and will be prepaid by the Customer.Each returned item is subject to a 10%-30%restocking fee.Orders canceled after shipment from the vendor to PFP or after production begins for built-to-order product are subject to a 20% restocking fee, plus any costs incurred by PFP as a result of termination. 9.ACCEPTANCE BY CUSTOMER:The products shall be deemed accepted by Customer as of the date of receipt and signed acceptance of the Sales Order documents at the completion of delivery and setup.If within ten(10)days after such date Customer gives PFP written notice that the products are not accepted and specifies in detail the reasons, PFP may,at its sole discretion,proceed to make necessary corrections. The Council may call up this item if desired and, by majority vote, initiate a review of the Planning Commission decision. Proposed Development: The subject property is a 22.30-acre property in the Medium Density Residential (RM) zoning district and partially encumbered by the Riparian Area & Wetlands Overlay District (RCWOD). The property is undeveloped and has previously been used for farming. Mill Creek and Hermanson Pond form the western boundary of the property, while S Pacific Highway (Hwy 99E) forms the eastern boundary. The proposal before the Planning Commission was a Preliminary Subdivision, Planned Unit Development, and RCWOD Permit application package to develop the property with a 100-lot subdivision. The applicant proposed 91 duplexes and 9 single-family houses, totaling 191 dwelling units. The subdivision plans include extension of Hawley Street south through the site and Deer Run Lane east across the creek as well as two new internal streets and a private alley. One of the new internal streets, Greenway Terrace, will create a new intersection on S Pacific Highway (Hwy 99E). Roughly half of the lots will utilize the private alley for vehicular access. The applicant's proposal includes donation of approximately two acres of open space to the City and includes paving the existing gravel trail between Deer Run Lane and Wilson Street, installing three benches around the pond, removing invasive species like blackberry and reseeding with native grasses and wildflowers, planting at least 30 trees along the creek, and installing trail wayfinding signage. In addition to these improvements, the applicant proposed to build a 12-foot-wide sidewalk with 9-foot-wide landscape strip on the south side of Greenway Terrace, extending the Mill Creek greenway trail to S Pacific Highway (Hwy 99E). She shared concerns about impacts to Hermanson Pond and wildlife, and concerns about a homeowners association governing the proposed subdivision. After closure of the record, the Commission deliberated on the proposed development and discussed the concerns raised by residents as well as the modifications requested via PUD. Commissioners acknowledged the traffic concerns along Hawley Street and S Pacific Highway (Hwy 99E) and the concerns about impacts to Hermanson Pond and Mill Creek. They reflected on the allowed uses and expected density within the RM zoning district as well as their role in development review. They also commented on the applicant's efforts to preserve and enhance Hermanson Pond and the surrounding area. Ultimately, the Commission concluded that the proposed development adequately addressed the requirements of a PUD to balance code modifications with additional common open space and enhanced public amenities. After concluding their deliberation, the Commission voted unanimously to approve the application package with the conditions recommended by staff in the staff report, except to modify Condition 35.c. to specify four additional lots for a potential cottage cluster within the site. 99
