ORDINANCE NO. 2649
AN ORDINANCE AMENDING ORDINANCE NO. 2464 (REGULATION OF TAXICABS;
TAXICAB DRIVERS; TAXICAB COMPANIES), MODIFYING THE REQUIREMENTS FOR THE
ISSUANCE OF A TAXICAB DRIVER PERMIT AND DECLARING AN EMERGENCY
WHEREAS, on March 24, 2010, the Woodburn City Council adopted Ordinance
2464 establishing and providing for the regulation of taxicabs; taxicab drivers; and
taxicab companies; and
WHEREAS, Section 9 of the Ordinance specifies requirements for taxicab driver
permitting, including an application and screening process; and
WHEREAS, Section 9 (E)(6), required the City to deny issuing a Taxicab Permit if
"[d]uring the 10-year period preceding the filing of the initial application, the
applicant's driving privileges were suspended or revoked by any governing jurisdiction
as a result of a driving-related incident"; and
WHEREAS, the City Council has determined that a lookback period of five (5)
years in lieu of ten (10) years is a more reasonable period of time, which also better
aligns with the lookback period of other driver penalties within the current permitting
requirements; and
WHEREAS, regarding the lookback period for an applicant's prior suspension of
driving privileges, a five (5) year lookback period is also more consistent with
comparable cities to the City of Woodburn; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Section 9 (E) of Ordinance 2464 is amended to read as follows:
Section 9.Taxicab Driver Permits Required -Application Process& Requirements.
E. Age, Criminal History, Driving History and Insurability Requirements. Applicants
for a Taxicab Permit may not be issued a permit if any of the following conditions exist:

4. During the 5-year period preceding the submission of the application, the
applicant has:
a. Been convicted of any traffic crime, including but not limited to: Driving
under the Influence of Intoxicants, Reckless Driving, Attempt to Elude a
Police Officer, or Failure to Perform the Duties of a Driver;
b. Been convicted of misdemeanor theft;
c. Had driving privileges suspended or revoked by any governing
jurisdiction as a result of a driving-related incident; or
d. Had greater than 10 traffic infractions as defined in ORS 801 .557;
greater than five serious traffic violations as defined in ORS 801 .477;
greater than five motor vehicle accidents that are required to be reported
to the Oregon Department of Motor Vehicles pursuant to ORS 811 .720; or,
greater than five of any combination of serious traffic violations or motor
vehicle accidents as provided above.
5. The applicant has more than three traffic violations of any kind within the
previous 12 months from the date of the application;
6. The applicant does not have at least 2 years' worth of continuous driving
experience in a United States jurisdiction immediately prior to the date of the
application's submission;
7. The applicant is less than 21 years old; or
8. The applicant is unable to obtain car insurance for any reason.
Section 2. Emergency Clause. This ordinance being necessary for the
immediate preservation of the public peace, health, and safety because it is in the
City's best interest to adopt reasonable regulations that allow taxicab drivers to
receive their permits and local taxicab businesses to actually operate, an emergency
is declared to exist and this ordinance shall take effect immediately upon passage by
the Council and approval by the Mayor.
