PROCLAMATION Month of the Military Child—Mayor Lonergan declared April 2026, as Month of the Military Child, and encouraged all residents to celebrate and observe the month as a way of bringing our community together. Grace, a member of the Oregon Military Teen Panel, explained that the group represents 9th- 12th grade students with a parent in the Oregon National Guard. The panel advocates for military youth, raises awareness of their challenges, and helps connect military families across the state. Motion: Schaub/Cornwell ... award the construction contract for the 2026 Slurry Seal Project to the lowest responsible bidder,Blackline Inc., in the amount of$139,854, and approve an additional $40,000 for this project as a contingency for change orders that may arise during construction, and authorize the City Manager to sign the contract. [5-0] CITY MANAGER'S REPORT The City Manager reported the following: - Attended National League of Cities conference; discussed nationwide issues(immigration, housing) and met with Oregon federal delegation to advocate for City priorities. Raised concerns about costly EPA wastewater regulations and requested $1.8M for Community Center gym project. - Door hangers to notify nearby residents of short-term construction vibrations at Community Center site. - Councilors are invited to the Masonic Lodge for a food bank volunteer appreciation breakfast (Saturday, 9 a.m.). - Budget Committee Meeting is set for April 25. Councilors will receive a budgetary note about some of the midterm financial decisions being made. MAYOR AND COUNCIL REPORTS Councilor Grijalva reported attending the conference in Washington, D.C. and that she gained insight into national issues (public safety, transportation, housing). She added that local challenges mirror nationwide trends and shared the community's concerns with federal representatives. She expressed appreciation for staff support and pride in the City's work. Councilor Cantu stated that she appreciates staff for their ongoing work and acknowledged the value of attending the Washington, D.C. conference. BACKGROUND: HPD does not possess a firearms range. HPD has historically used the Woodburn Police Department Range with previous agreements since 2003. Without the continued use of the Woodburn Police Department Range, HPD personnel must travel significant distances to conduct necessary firearms training. The WPD Range is geographically closer and would continue to assist the HPD in conducting necessary training. DISCUSSION: The Police Department has completed a study of the use of the WPD Range by the HPD. The agreement ensures that WPD personnel will have access to the facility to conduct all necessary training for WPD personnel without significant impact. FINANCIAL IMPACT: The City of Hubbard will pay a new annual range use fee of $1 ,000 for access to the WPD Range. HOOD AVENUE, WOODBURN, OR 97071 PHONE: 503-982-2345 1 FAH: 503-982-2370 Intergovernmental Agreement for Police Firearms Range Usage This Intergovernmental Agreement for police Firearms Range Usage ("Agreement")is made and entered into by and between the City of Woodburn, an Oregon Municipal Corporation ("Woodburn"), and the City of Hubbard, an Oregon Municipal Corporation, for the benefit of the Hubbard Police Department("Hubbard"), under the authority of ORS Chapter 190. RECITALS 1. By the authority granted in ORS Chapter 190, incorporated cities may enter into agreements with other Law Enforcement agencies for the performance of any of the functions and activities that they have the legal authority to perform. 2. Under said authority, the City of Woodburn and the City of Hubbard desire to enter into this Agreement, which allows sworn members of the Hubbard Police Department to use the Woodburn Police Firearms Range subject to the provisions of this Agreement. 3. The Woodburn Police Firearms Range will be used to conduct training. NOW, THEREFORE,the parties agree as follows: TERM 1. This Agreement is effective upon execution hereof on behalf of both parties, and shall not be terminated unless subject to the provisions contained herein. 2. This agreement may be terminated by either party effective upon delivery of written notice to the other party. 3. Notwithstanding the giving of notice of termination, the Hubbard Police Department shall remain obligated with respect to any unfulfilled financial obligation which accrued hereunder prior to the effective date of such termination. Space Left Intentionally Blank 10 �2 OBLIGATIONS 1. Woodburn Police Department(WPD) shall allow use of the Woodburn Police Firearms Range by sworn members of the Hubbard Police Department(HPD) subject to the limitations, provisions, and requirements of Oregon Law and as set forth in this agreement. 2. Woodburn Police Firearms Range usage for general qualifying range training shall be subject to availability and cannot be guaranteed. In order to avoid range-scheduling conflicts, on or about the first of each month a member of HPD should communicate with the Woodburn Police Firearms Rangemaster and they shall mutually agree to a range schedule. 3. Upon the execution of this Agreement, representatives of HPD and WPD shall meet and establish a training schedule for the upcoming 6 months. 4. HPD will be authorized to use the Woodburn Police Firearms Range on at least four (4) opportunities during a calendar year. 5. WPD shall maintain the Woodburn Police Firearms Range and shall be the sole entity authorized to modify or alter the range in any way. 6. The use of the Woodburn Police Firearms Range shall be subject to the following provisions: 5.1 All range and safety rules as set forth in City of Woodburn Police Department Firearms Range Protocol (attached at appendix A) shall be enforced by a HPD sworn representative who shall be present each and every time HPD officers utilize the Woodburn Police Firearms Range. WPD shall have the right to expel from the Woodburn Police Firearms Range any user who violates the Firing Range Protocol, or for any other reason in the WPD's sole discretion. 5.2 The Woodburn Police Firearms Range will be open Monday-Friday from 8:00am to 9:00pm. A representative of HPD will need to contact the WPD Rangemaster in order to specify the date and time of all reservations. 5.3 Other than sworn HPD Officers, this Agreement does not authorize any other persons including other agencies' officers or agents to shoot at the Woodburn Police Firearms Range as guests of HPD without prior written consent of the WPD. 5.4 The only weapons authorized for discharge at the Woodburn Police Firearms Range are handguns of the type normally utilized by law enforcement, police patrol rifles of the 9mm or .223 caliber only, precision Integrity + Empathy +Respect 11 3 rifles chambered in .308 caliber, and police shotguns. The discharge of explosives devices is prohibited. COMPENSATION 1. Range Fee. Hubbard shall pay to the City an annual range use fee in the amount of one thousand dollars ($1,000.00)per fiscal year for use of the Woodburn Police Firearms Range. The range fee may be adjusted annually based on the January Consumer Price Index for All Urban Consumers (CPI-U)for the West Region, as published by the Bureau of Labor Statistics. Any such adjustment shall be communicated in writing to the Hubbard Police Department no later than March of the applicable calendar year and shall include the January CPI-U data and the newly calculated fee. The adjusted fee shall become effective at the beginning of the following fiscal year(July 1 through June 30). Adjustments to the range fee based solely on the CPI-U shall not require amendment of this Agreement. Any proposed increase exceeding the CPI-U adjustment shall require a formal amendment to this Agreement, executed by both parties, prior to implementation. 2. Hubbard shall make full payment to Woodburn during the month of July for the use of the Woodburn Police Firearms Range during the fiscal year(running July 1 —June 30). If this Agreement is terminated in the middle of a fiscal year, Woodburn shall return to Hubbard a prorated amount of the fee collected for the remaining period of that year. 3. Hubbard shall pay and be held liable for any damage done during their use of the Woodburn Police Firearms Range. Any damage done during the course of training at the Woodburn Police Firearms Range shall be reported immediately to the WPD Rangemaster or a WPD supervisor. If necessary, a member of Public Works from the City of Woodburn shall inspect the damage to determine the extent of the damage and whether the Woodburn Police Firearms Range is safe to use. A member of Public Works shall provide a written quote in order to display the costs associated with any damage done. HPD will only be held responsible for the actual costs to repair the damage. SAFETY 1. HPD shall be exclusively responsible for the protection of its employees and agents and shall provide adequate safety provisions and supervision for its employees and agents who utilize the Woodburn Police Firearms Range. 2. City of Woodburn shall have no responsibility or obligation with respect to safety or supervision of HPD officers or agents who may be utilizing the Woodburn Police Firearms Range. Integrity + Empathy +Respect 12 4 3. City of Woodburn employees who witness or become aware of violations of good safety practices at the Woodburn Police Firearms Range shall report them to the WPD Rangemaster or WPD supervisor. LIMITATIONS OF LIABILITY 1. WPD shall be responsible for any claims, loss or damage resulting from the actions of WPD and its officers, agents and employees in the use of the facilities and participation in the training provided under this agreement. 2. HPD shall be responsible for any claims, loss or damage resulting from the actions of HPD and its officers, agents and employees in the use of the facilities and participation in the training provided under this agreement. 3. City of Woodburn assumes no liability for the actions of HPD officers or agents utilizing the Woodburn Police Firearms Range. City of Woodburn represents and warrants only that it will use its best efforts to maintain the Woodburn Police Firearms Range. 4. Hubbard agrees, to the extent it may under the Constitution and laws of Oregon, to indemnify, defend, and save Woodburn harmless from any and all claims arising out of the acts, errors or omissions of Hubbard as a result of HPD's use of the Woodburn Police Firearms Range or those for whose acts may be held liable under ORS 30.265, ; and further provided that with respect to any single claim or occurrence, Hubbard liability arising out of contribution or indemnity shall not exceed the limits provided by ORS 30.270, if applicable to the asserted claim. 5. Each party shall insure or self-insure and be independently responsible for the risk of its own liability under this Agreement for claims within the scope of the Oregon tort claims act(ORS 30.260 to 30.300). 6. Prior to entry into the Woodburn Police Firearms Range property, Hubbard shall provide a certificate of insurance or certificate of self-insurance which shall name the City of Woodburn, its officers, agents, and employees as additional insured and shall be accompanied by an additional insured endorsement(if applicable). Hubbard will ensure that a current certificate of insurance or certificate of self-insurance is provided prior to the upcoming fiscal year(July 1 —June 30)that this agreement is in effect. COMMUNICATION AND NOTICE 1. Any notice in writing required to be given hereunder shall be sufficient if sent by regular mail or personally delivered to the Chief of Police, City of Woodburn; and to the Chief of Police, Hubbard Police Department. 2. Each party shall designate, and may change from time to time, a representative for communication, negotiations, and general liaison with the other concerning the content, Integrity + Empathy +Respect 13 15 future, and administration of this Agreement. No such designated representative shall be held an agent or attorney-in-fact having authority to bind either party. RELATIONSHIP OF THE PARTIES Neither party shall at any time hold itself out as a subsidiary or affiliate of the other party. Further, nothing contained herein shall be deemed or construed by the Parties, nor by any third parties, as creating the relationship of a joint venture or partnership between the Parties, or a relationship between a party and any suppliers, employees, contractors or subcontractors used by the other party to carry out functions under this Agreement. ASSIGNMENTS This Agreement and all rights and obligations of both Parties hereunder are personal to both parties. As such, neither party shall transfer, assign, or delegate any rights or obligations hereunder. GOVERNING LAW This Agreement is governed by and will be construed in accordance with the laws of the State of Oregon. AMENDMENTS Agreement represents the complete and integrated agreement between the parties with respect to the subject matter hereof, and may be amended only by written amendment executed by both parties. As such, this Agreement cancels and supersedes all prior written and oral agreements, representations, negotiations, and communications between the parties and their representatives with respect to the subject matter hereof. Intent This protocol is intended to provide general guidance for the safe operation of the City of Woodburn firing range. Safe operation of the firing range is a responsibility shared between the users of the firing range and City of Woodburn Public Works staff. The users of the firing range are the Woodburn Police Department, other approved law enforcement agencies and/or authorized users (e.g. hosted firearms courses,firearm demos, test firing, etc.) and authorized agency users with a valid Intergovernmental Agreement (IGA) with the City of Woodburn. Background The City of Woodburn firing range is located at the City of Woodburn Wastewater Treatment Plant (located at 2815 Molalla Road, Woodburn, OR 97071). The safe operation of the firing range requires a shared responsibility between the facility user and the facility host. The firing range user is restricted to law enforcement personnel or other users approved by the Woodburn Police Department (e.g. outside department range instructor, vendor demos, test firing, community police academy participants, etc.) or other users covered through a valid IGA. The firing range is not for use during off-duty and/or personal time off. All WPD range usage must be authorized on-duty work hours. The host of the firing range is the City of Woodburn Public Works Department. Safe operation of the firing range requires that both users and the host of the facility recognize the limitations of the facility and its use. The following protocols/procedures are intended to ensure that both users and host of the facility follow consistent practices to minimize the risk of using the firing range for police training. Procedures for Range Use I —Advanced Notification from the Woodburn Police Department (WPD). WPD will notify the Wastewater Treatment Plant Supervisor and the Public Works Director of scheduled use of the firing range for training (Outside agencies must not training with a WPD rangemaster or designee, who will then conduct the necessary notifications). If the range is STANDARD (inside the protective overhead baffles) range day notice can be provided on the same day of the firearms training time, if there are no conflicts. 15 Appendix A If the range day is NON-STANDARD (outside of the protective overhead baffles) then there must be at least a 48-hour advance notification to the Wastewater Treatment Plant Supervisor and the Public Works Director. A request for a NON-STANDARD training time within a 48-hour advance notification window will not occur without a Wastewater Treatment Plant Supervisor and/or the Public Works Director's personal prior approval, notification alone is insufficient. Live fire training should occur only between the hours of 8:00 AM and 9:00 PM. Firearms training set-up and tear down can occur outside of the listed hours as long as local noise ordinances are not violated. All range reservations should include estimated set-up and tear down/clean-up times. 2—Departmental Notification of Firing Range Use. The Public Works Director will provide email notification to all division managers and supervisors of upcoming firing range usage. Division managers and supervisors will be directed to adjust employee work schedules/work duties as needed. 3 —Senior/Lead Range Officer Notification. On the day of the firing range, the senior/lead range officer should provide personal notification to the Wastewater Treatment Plant Supervisor or other senior member of the Wastewater Treatment Plant staff(Supervisor/staff are typically found within the front office space of the public entrance of the facility). Notification should consist of informing a Wastewater Treatment staff member(s)that firing range users are on site and will be conducting training between scheduled hours. If necessary, discussion of any specific or unusual requirements of the training syllabus to be used should be reviewed with the Wastewater Treatment Plant Supervisor or representative. 4—Access Road Control. All members of the training detachment participating in live fire training should enter the firing range by the access road leading to the firing range from the main entrance to the Wastewater Treatment Plant. The firing range access road gate shall be closed while the firing range is in use. Gate closure is intended to keep unauthorized personnel from proceeding to the firing range area and to serve as a visual cue to Public Works personnel and visitors to the Wastewater Treatment Plant that the firing range is in use. 5 — Warning Light. There is a warning light located at the Wastewater Treatment Plant that serves as a visual notification that the firing range is in use and that movement within the Wastewater Treatment Plant is restricted. Public Works staff will be instructed as to which areas are outside of the firing range danger area. Most of the Wastewater Treatment Plant buildings and plant operation are outside of the firing range danger area. Activation of the warning light is done with a light switch located on a light pole at the southeast corner of the 25-foot yard line of the firing range. Visual confirmation of the Wastewater Treatment Plant warning light activation shall be conducted by a range instructor. The warning light is visible by looking northwest from the south side of the WPD Conex storage box. Integrity -Empathy $Respect 16 Appendix A 6—Notification Process if Warning Lights Mal imnction/Inoperable. If the warning light does not activate, or appears to be malfunctioning, a range instructor will contact the Wastewater Treatment Plant supervisor or other senior employee in person or phone, to notify them of the warning light malfunction before any firearms can be discharged. Training can continue once proper notifications have been made. Wastewater Treatment Plant staff and range instructors will adhere strictly to the reservation times. (See Range Map below for details of warning light and warning light switch locations and contact phone numbers) The City of Woodburn has made improvements to the firing range that included raising the firing range barrier height, installation of warning lights on site, and installation of access road gate restricting access to the firing range when it is in use. (See Range.Map below for additional details for the firing range, access road and gate locations) However,the most important safety measure we can take is communicating that the firing range is in use and that care must be exercised to avoid entering the firing range danger zone. The Public Works Department is responsible for the training of Public Works staff as to the necessary precautions needed to be exercised while the firing range is in use. Public Works will be responsible for controlling visitor movement at the Wastewater Treatment Plant while the firing range is in use. WPD and authorized range users are responsible for the safe operation of the firing range while it is in use. All firing range users must be aware of the limitations and precautions needed for the safe operation of the firing range. If any issues or concerns arise regarding the condition of the firing range and/or it's safe usage, the Woodburn.Police Department Rangemaster shall be contacted and the issue(s)reported. Treat all firearms as though they are loaded. B. Never point a firearm at anyone and/or anything unless you are justified in shooting. C. Be sure of your target and beyond before you pull the trigger. D. Place your trigger finger on the trigger only when the gun is on target and you have decided to shoot. Specific Rules 1. All loading and unloading of firearms will occur only at the time and location designated by the firearms instructor. 2. Keep all firearms holstered unless on the firing line. Unholster only upon command. 3. At no time shall any firearm be cleaned, handled, dry fired, or inspected without approval of a firearms instructor. 4. No use of any tobacco products or talking while on the firing line. 5. Keep your muzzle always pointed in a safe direction. 6. Never go forward of the firing line until the line has been cleared and the command to do so is given. 7. If a squib load occurs or if the firearm breaks; stop shooting immediately, keep the gun pointed downrange and call for assistance. 8. Raise your support hand and call out if you do not understand any command, if you are not ready, or if you observe a safety hazard.Never anticipate a command. 9. Never give a firearm to, or take a firearm from, anyone unless the cylinder or action is open and the firearm is physically and visually checked clear. 10. Confirm the red entrance gate has been closed and the firing range warning light is on before training begins or any firearms are discharged. 2. Confirm that no one has any illnesses or injuries that you should be aware of. 3. Discuss a Range Injury Action Plan in case of serious injury or sudden illness. (See sample Range Injury Action Plan below). 4. Review, at minimum, the four main safety rules (see Range Safety Rules) with all range users prior to the start of any firearms training. Firearm Instructor End Procedures 1. Confirm whether any injuries occurred during training and reminder to wash their hands. 2. Have the students clean the range (sweep the brass, clean the staging area, etc.). a. All agencies must remove all live rounds, spent shell casing and any garbage from the range. b. No garbage or refuse is allowed to be left at the range. c. A burn barrel is available and only allowed to be utilized for burning paper targets or firewood during inclement/cold weather and/or other otherwise allowable burn days. d. Unattended fires are not allowed. e. No garbage, discarded food, live ammunition etc., is allowed in the burn barrel. 3. Have the students go forward and clear their weapons of training ammunition and secure all training magazines and equipment. 4. Have the students load their weapons with duty ammunition while on the firing line. 5. Conduct a short training debrief and inquire about any post training injuries. 6. Confirm the range has been cleaned and the storage areas are secure. 7. Turn off the warning light and open the red gate. Any training that occurs at the firing range should also include the following equipment to provide immediate assistance to anyone needing immediate medical care to include: Automated External Defibrillator(AED) Torniquets Wound clotting kit Various bandages Band-aids Personal Protective Equipment (PPE) Minor Injuries and Illness Procedure 1 —If necessary, ensure that the student's weapon is pointed downrange until it can be secured. 2—If the injury is of a nature that it can be treated on the range (e.g. minor cuts, scrapes) either provide, or direct someone to provide, the assistance necessary. Immediately notify the on-site Rangemaster. 3 —If a student has received a minor injury or feels ill, the decision to allow the student to continue with the course should be based on the following criteria: a—Will the injury/illness cause a safety hazard? b—Will further participation aggravate the injury/illness? c—If the student does not feel medically fit to continue, allow them to exit the course. 4—Document the incident and witnesses present. The following roles and responsibilities should have a primary and an alternate designated: Day-of lead instructor and alternate Radio/Comms (Address is 2815 Molalla Hwy.,Woodburn, OR) Cellphone/911 call (Address is 2815 Molalla Hwy.,Woodburn, OR) Vehicle/Driver identified to open all gates and escort Ambulance/Fire vehicle(s) for emergency medical services to site of the injured/ill First Aid/Trauma Care AED/CPR 1 —If necessary, ensure the student's weapon is pointed down range until it can be secured. 2—Notify dispatch that rescue is required at the range by radio and/or by calling 911. 3 —Identify the range, the location of the range, and the medical status of the injured/ill person. 4—Provide or assign someone to provide first aid. 5 —Assign someone in a vehicle to do the following: a—Drive to the front of the wastewater treatment driveway entrance and ensure all gates are open for emergency medical services. b—Escort the first rescue unit to the site of the injured person. 6—Immediately notify the Rangemaster and notify on-duty patrol supervisor to begin chain of command notifications. 7—If a medical helicopter is used, it may be necessary to assign an instructor to help identify a landing zone with medical/fire personnel. 8 —Once emergency is over, re-secure all gates. 9—Identify all witnesses and document the incident. Purpose The purpose of this plan is to provide expedient and necessary medical care for people who may become seriously ill or injured while participating in training exercises at the firing range. Communications The lead firearms instructor will have a portable radio and a cellular phone for their use anytime the range is being used. Secondary alternates should be identified for radio and cell phone communications. First Aid Supplies Basic First Aid Supplies and a blood pathogen kit are located with the designated area inside the Woodburn Conex storage container. Additional medical kit bag that includes an AED, torniquet, bandages and wound clotting kit and trauma care kit will be brought to any firing range training. Helicopter Signaling Devices Signaling devices (flares, overhead police lights) for identifying a landing zone for a medical helicopter could be utilized from an available marked police vehicle only after consultation and approval from Fire personnel. Helicopter Landing Zone The designated location for landing a medical helicopter will be determined by Fire personnel. Fire Extinguisher A fire extinguisher is located on the work area immediately to the left side of the interior of the main/large WPD Conex storage container. Outside agencies utilizing the firing range should ensure they have access to their own fire extinguisher. BACKGROUND: SPD does not possess a firearms range. SPD has historically used the Woodburn Police Department Range with a previous agreement since 2018. Without the continued use of the Woodburn Police Department Range, SPD personnel must travel significant distances to conduct necessary firearms training. The WPD Range is geographically closer and would continue to assist the SPD in conducting necessary training. DISCUSSION: The Police Department has completed a study of the use of the WPD Range by the SPD. The agreement ensures that WPD personnel will have access to the facility to conduct all necessary training for WPD personnel without significant impact. FINANCIAL IMPACT: The City of Silverton will pay a new annual range use fee of $1 ,000 for access to the WPD Firearms Range. RECITALS 1. By the authority granted in ORS Chapter 190, incorporated cities may enter into agreements with other Law Enforcement agencies for the performance of any of the functions and activities that they have the legal authority to perform. 2. Under said authority, the City of Woodburn and the City of Silverton desire to enter into this Agreement, which allows sworn members of the Silverton Police Department to use the Woodburn Police Firearms Range subject to the provisions of this Agreement. 3. The Woodburn Police Firearms Range will be used to conduct training. NOW, THEREFORE,the parties agree as follows: TERM 1. This Agreement is effective upon execution hereof on behalf of both parties, and shall not be terminated unless subject to the provisions contained herein. 2. This agreement may be terminated by either party effective upon delivery of written notice to the other party. 3. Notwithstanding the giving of notice of termination, the Silverton Police Department shall remain obligated with respect to any unfulfilled financial obligation which accrued hereunder prior to the effective date of such termination. Woodburn Police Department(WPD) shall allow use of the Woodburn Police Firearms Range by sworn members of the Silverton Police Department(SPD) subject to the limitations, provisions, and requirements of Oregon Law and as set forth in this agreement. 2. Woodburn Police Firearms Range usage for general qualifying range training shall be subject to availability and cannot be guaranteed. In order to avoid range-scheduling conflicts, on or about the first of each month a member of SPD should communicate with the Woodburn Police Firearms Rangemaster and they shall mutually agree to a range schedule. 3. Upon the execution of this Agreement, representatives of SPD and WPD shall meet and establish a training schedule for the upcoming 6 months. 4. SPD will be authorized to use the Woodburn Police Firearms Range on at least four (4) opportunities during a calendar year. 5. WPD shall maintain the Woodburn Police Firearms Range and shall be the sole entity authorized to modify or alter the range in any way. 6. The use of the Woodburn Police Firearms Range shall be subject to the following provisions: 5.1 All range and safety rules as set forth in City of Woodburn Police Department Firearms Range Protocol (attached at appendix A) shall be enforced by an SPD sworn representative who shall be present each and every time SPD officers utilize the Woodburn Police Firearms Range. WPD shall have the right to expel from the Woodburn Police Firearms Range any user who violates the Firing Range Protocol, or for any other reason in the WPD's sole discretion. 5.2 The Woodburn Police Firearms Range will be open Monday-Friday from 8:00am to 9:00pm. A representative of SPD will need to contact the WPD Rangemaster in order to specify the date and time of all reservations. 5.3 Other than sworn SPD Officers, this Agreement does not authorize any other persons including other agencies' officers or agents to shoot at the Woodburn Police Firearms Range as guests of SPD without prior written consent of the WPD. 5.4 The only weapons authorized for discharge at the Woodburn Police Firearms Range are handguns of the type normally utilized by law enforcement, police patrol rifles of the 9mm or .223 caliber only, precision Integrity + Empathy +Respect 32 3 rifles chambered in .308 caliber, and police shotguns. The discharge of explosives devices is prohibited. COMPENSATION 1. Range Fee. The range fee may be adjusted annually based on the January Consumer Price Index for All Urban Consumers (CPI-U)for the West Region, as published by the Bureau of Labor Statistics. Any such adjustment shall be communicated in writing to the Silverton Police Department no later than March of the applicable calendar year and shall include the January CPI-U data and the newly calculated fee. The adjusted fee shall become effective at the beginning of the following fiscal year(July 1 through June 30). Adjustments to the range fee based solely on the CPI-U shall not require amendment of this Agreement. Any proposed increase exceeding the CPI-U adjustment shall require a formal amendment to this Agreement, executed by both parties, prior to implementation. 2. Silverton shall make full payment to Woodburn during the month of July for the use of the Woodburn Police Firearms Range during the fiscal year(running July 1 —June 30). If this Agreement is terminated in the middle of a fiscal year, Woodburn shall return to Silverton a prorated amount of the fee collected for the remaining period of that year. 3. Silverton shall pay and be held liable for any damage done during their use of the Woodburn Police Firearms Range. Any damage done during the course of training at the Woodburn Police Firearms Range shall be reported immediately to the WPD Rangemaster or a WPD supervisor. If necessary, a member of Public Works from the City of Woodburn shall inspect the damage to determine the extent of the damage and whether the Woodburn Police Firearms Range is safe to use. A member of Public Works shall provide a written quote in order to display the costs associated with any damage done. SPD will only be held responsible for the actual costs to repair the damage. SAFETY 1. SPD shall be exclusively responsible for the protection of its employees and agents and shall provide adequate safety provisions and supervision for its employees and agents who utilize the Woodburn Police Firearms Range. 2. City of Woodburn shall have no responsibility or obligation with respect to safety or supervision of SPD officers or agents who may be utilizing the Woodburn Police Firearms Range. City of Woodburn employees who witness or become aware of violations of good safety practices at the Woodburn Police Firearms Range shall report them to the WPD Rangemaster or WPD supervisor. LIMITATIONS OF LIABILITY 1. WPD shall be responsible for any claims, loss or damage resulting from the actions of WPD and its officers, agents and employees in the use of the facilities and participation in the training provided under this agreement. 2. SPD shall be responsible for any claims, loss or damage resulting from the actions of SPD and its officers, agents and employees in the use of the facilities and participation in the training provided under this agreement. 3. City of Woodburn assumes no liability for the actions of SPD officers or agents utilizing the Woodburn Police Firearms Range. City of Woodburn represents and warrants only that it will use its best efforts to maintain the Woodburn Police Firearms Range. 4. Silverton agrees, to the extent it may under the Constitution and laws of Oregon, to indemnify, defend, and save Woodburn harmless from any and all claims arising out of the acts, errors or omissions of Silverton as a result of SPD's use of the Woodburn Police Firearms Range or those for whose acts may be held liable under ORS 30.265, ; and further provided that with respect to any single claim or occurrence, Silverton liability arising out of contribution or indemnity shall not exceed the limits provided by ORS 30.270, if applicable to the asserted claim. 5. Each party shall insure or self-insure and be independently responsible for the risk of its own liability under this Agreement for claims within the scope of the Oregon tort claims act(ORS 30.260 to 30.300). 6. Prior to entry into the Woodburn Police Firearms Range property, Silverton shall provide a certificate of insurance or certificate of self-insurance which shall name the City of Woodburn, its officers, agents, and employees as additional insured and shall be accompanied by an additional insured endorsement(if applicable). Silverton will ensure that a current certificate of insurance or certificate of self-insurance is provided prior to the upcoming fiscal year(July 1 —June 30)that this agreement is in effect. COMMUNICATION AND NOTICE 1. Any notice in writing required to be given hereunder shall be sufficient if sent by regular mail or personally delivered to the Chief of Police, City of Woodburn; and to the Chief of Police, Silverton Police Department. Each party shall designate, and may change from time to time, a representative for communication, negotiations, and general liaison with the other concerning the content, future, and administration of this Agreement. No such designated representative shall be held an agent or attorney-in-fact having authority to bind either party. RELATIONSHIP OF THE PARTIES Neither party shall at any time hold itself out as a subsidiary or affiliate of the other party. Further, nothing contained herein shall be deemed or construed by the Parties, nor by any third parties, as creating the relationship of a joint venture or partnership between the Parties, or a relationship between a party and any suppliers, employees, contractors or subcontractors used by the other party to carry out functions under this Agreement. ASSIGNMENTS This Agreement and all rights and obligations of both Parties hereunder are personal to both parties. As such, neither party shall transfer, assign, or delegate any rights or obligations hereunder. GOVERNING LAW This Agreement is governed by and will be construed in accordance with the laws of the State of Oregon. AMENDMENTS Agreement represents the complete and integrated agreement between the parties with respect to the subject matter hereof, and may be amended only by written amendment executed by both parties. As such, this Agreement cancels and supersedes all prior written and oral agreements, representations, negotiations, and communications between the parties and their representatives with respect to the subject matter hereof. Intent This protocol is intended to provide general guidance for the safe operation of the City of Woodburn firing range. Safe operation of the firing range is a responsibility shared between the users of the firing range and City of Woodburn Public Works staff. The users of the firing range are the Woodburn Police Department, other approved law enforcement agencies and/or authorized users (e.g. hosted firearms courses,firearm demos, test firing, etc.) and authorized agency users with a valid Intergovernmental Agreement (IGA) with the City of Woodburn. Background The City of Woodburn firing range is located at the City of Woodburn Wastewater Treatment Plant (located at 2815 Molalla Road, Woodburn, OR 97071). The safe operation of the firing range requires a shared responsibility between the facility user and the facility host. The firing range user is restricted to law enforcement personnel or other users approved by the Woodburn Police Department (e.g. outside department range instructor, vendor demos, test firing, community police academy participants, etc.) or other users covered through a valid IGA. The firing range is not for use during off-duty and/or personal time off. All WPD range usage must be authorized on-duty work hours. The host of the firing range is the City of Woodburn Public Works Department. Safe operation of the firing range requires that both users and the host of the facility recognize the limitations of the facility and its use. The following protocols/procedures are intended to ensure that both users and host of the facility follow consistent practices to minimize the risk of using the firing range for police training. Procedures for Range Use I —Advanced Notification from the Woodburn Police Department (WPD). WPD will notify the Wastewater Treatment Plant Supervisor and the Public Works Director of scheduled use of the firing range for training (Outside agencies must not training with a WPD rangemaster or designee, who will then conduct the necessary notifications). If the range is STANDARD (inside the protective overhead baffles) range day notice can be provided on the same day of the firearms training time, if there are no conflicts. 36 Appendix A If the range day is NON-STANDARD (outside of the protective overhead baffles) then there must be at least a 48-hour advance notification to the Wastewater Treatment Plant Supervisor and the Public Works Director. A request for a NON-STANDARD training time within a 48-hour advance notification window will not occur without a Wastewater Treatment Plant Supervisor and/or the Public Works Director's personal prior approval, notification alone is insufficient. Live fire training should occur only between the hours of 8:00 AM and 9:00 PM. Firearms training set-up and tear down can occur outside of the listed hours as long as local noise ordinances are not violated. All range reservations should include estimated set-up and tear down/clean-up times. 2—Departmental Notification of Firing Range Use. The Public Works Director will provide email notification to all division managers and supervisors of upcoming firing range usage. Division managers and supervisors will be directed to adjust employee work schedules/work duties as needed. 3 —Senior/Lead Range Officer Notification. On the day of the firing range, the senior/lead range officer should provide personal notification to the Wastewater Treatment Plant Supervisor or other senior member of the Wastewater Treatment Plant staff(Supervisor/staff are typically found within the front office space of the public entrance of the facility). Notification should consist of informing a Wastewater Treatment staff member(s)that firing range users are on site and will be conducting training between scheduled hours. If necessary, discussion of any specific or unusual requirements of the training syllabus to be used should be reviewed with the Wastewater Treatment Plant Supervisor or representative. 4—Access Road Control. All members of the training detachment participating in live fire training should enter the firing range by the access road leading to the firing range from the main entrance to the Wastewater Treatment Plant. The firing range access road gate shall be closed while the firing range is in use. Gate closure is intended to keep unauthorized personnel from proceeding to the firing range area and to serve as a visual cue to Public Works personnel and visitors to the Wastewater Treatment Plant that the firing range is in use. 5 — Warning Light. There is a warning light located at the Wastewater Treatment Plant that serves as a visual notification that the firing range is in use and that movement within the Wastewater Treatment Plant is restricted. Public Works staff will be instructed as to which areas are outside of the firing range danger area. Most of the Wastewater Treatment Plant buildings and plant operation are outside of the firing range danger area. Activation of the warning light is done with a light switch located on a light pole at the southeast corner of the 25-foot yard line of the firing range. Visual confirmation of the Wastewater Treatment Plant warning light activation shall be conducted by a range instructor. The warning light is visible by looking northwest from the south side of the WPD Conex storage box. Integrity -Empathy $Respect 37 Appendix A 6—Notification Process if Warning Lights Mal imnction/Inoperable. If the warning light does not activate, or appears to be malfunctioning, a range instructor will contact the Wastewater Treatment Plant supervisor or other senior employee in person or phone, to notify them of the warning light malfunction before any firearms can be discharged. Training can continue once proper notifications have been made. Wastewater Treatment Plant staff and range instructors will adhere strictly to the reservation times. (See Range Map below for details of warning light and warning light switch locations and contact phone numbers) The City of Woodburn has made improvements to the firing range that included raising the firing range barrier height, installation of warning lights on site, and installation of access road gate restricting access to the firing range when it is in use. (See Range.Map below for additional details for the firing range, access road and gate locations) However,the most important safety measure we can take is communicating that the firing range is in use and that care must be exercised to avoid entering the firing range danger zone. The Public Works Department is responsible for the training of Public Works staff as to the necessary precautions needed to be exercised while the firing range is in use. Public Works will be responsible for controlling visitor movement at the Wastewater Treatment Plant while the firing range is in use. WPD and authorized range users are responsible for the safe operation of the firing range while it is in use. All firing range users must be aware of the limitations and precautions needed for the safe operation of the firing range. If any issues or concerns arise regarding the condition of the firing range and/or it's safe usage, the Woodburn.Police Department Rangemaster shall be contacted and the issue(s)reported. Treat all firearms as though they are loaded. B. Never point a firearm at anyone and/or anything unless you are justified in shooting. C. Be sure of your target and beyond before you pull the trigger. D. Place your trigger finger on the trigger only when the gun is on target and you have decided to shoot. Specific Rules 1. All loading and unloading of firearms will occur only at the time and location designated by the firearms instructor. 2. Keep all firearms holstered unless on the firing line. Unholster only upon command. 3. At no time shall any firearm be cleaned, handled, dry fired, or inspected without approval of a firearms instructor. 4. No use of any tobacco products or talking while on the firing line. 5. Keep your muzzle always pointed in a safe direction. 6. Never go forward of the firing line until the line has been cleared and the command to do so is given. 7. If a squib load occurs or if the firearm breaks; stop shooting immediately, keep the gun pointed downrange and call for assistance. 8. Raise your support hand and call out if you do not understand any command, if you are not ready, or if you observe a safety hazard.Never anticipate a command. 9. Never give a firearm to, or take a firearm from, anyone unless the cylinder or action is open and the firearm is physically and visually checked clear. 10. Confirm the red entrance gate has been closed and the firing range warning light is on before training begins or any firearms are discharged. 2. Confirm that no one has any illnesses or injuries that you should be aware of. 3. Discuss a Range Injury Action Plan in case of serious injury or sudden illness. (See sample Range Injury Action Plan below). 4. Review, at minimum, the four main safety rules (see Range Safety Rules) with all range users prior to the start of any firearms training. Firearm Instructor End Procedures 1. Confirm whether any injuries occurred during training and reminder to wash their hands. 2. Have the students clean the range (sweep the brass, clean the staging area, etc.). a. All agencies must remove all live rounds, spent shell casing and any garbage from the range. b. No garbage or refuse is allowed to be left at the range. c. A burn barrel is available and only allowed to be utilized for burning paper targets or firewood during inclement/cold weather and/or other otherwise allowable burn days. d. Unattended fires are not allowed. e. No garbage, discarded food, live ammunition etc., is allowed in the burn barrel. 3. Have the students go forward and clear their weapons of training ammunition and secure all training magazines and equipment. 4. Have the students load their weapons with duty ammunition while on the firing line. 5. Conduct a short training debrief and inquire about any post training injuries. 6. Confirm the range has been cleaned and the storage areas are secure. 7. Turn off the warning light and open the red gate. Any training that occurs at the firing range should also include the following equipment to provide immediate assistance to anyone needing immediate medical care to include: Automated External Defibrillator(AED) Torniquets Wound clotting kit Various bandages Band-aids Personal Protective Equipment (PPE) Minor Injuries and Illness Procedure 1 —If necessary, ensure that the student's weapon is pointed downrange until it can be secured. 2—If the injury is of a nature that it can be treated on the range (e.g. minor cuts, scrapes) either provide, or direct someone to provide, the assistance necessary. Immediately notify the on-site Rangemaster. 3 —If a student has received a minor injury or feels ill, the decision to allow the student to continue with the course should be based on the following criteria: a—Will the injury/illness cause a safety hazard? b—Will further participation aggravate the injury/illness? c—If the student does not feel medically fit to continue, allow them to exit the course. 4—Document the incident and witnesses present. The following roles and responsibilities should have a primary and an alternate designated: Day-of lead instructor and alternate Radio/Comms (Address is 2815 Molalla Hwy.,Woodburn, OR) Cellphone/911 call (Address is 2815 Molalla Hwy.,Woodburn, OR) Vehicle/Driver identified to open all gates and escort Ambulance/Fire vehicle(s) for emergency medical services to site of the injured/ill First Aid/Trauma Care AED/CPR 1 —If necessary, ensure the student's weapon is pointed down range until it can be secured. 2—Notify dispatch that rescue is required at the range by radio and/or by calling 911. 3 —Identify the range, the location of the range, and the medical status of the injured/ill person. 4—Provide or assign someone to provide first aid. 5 —Assign someone in a vehicle to do the following: a—Drive to the front of the wastewater treatment driveway entrance and ensure all gates are open for emergency medical services. b—Escort the first rescue unit to the site of the injured person. 6—Immediately notify the Rangemaster and notify on-duty patrol supervisor to begin chain of command notifications. 7—If a medical helicopter is used, it may be necessary to assign an instructor to help identify a landing zone with medical/fire personnel. 8 —Once emergency is over, re-secure all gates. 9—Identify all witnesses and document the incident. This plan is utilized by WPD members and should be utilized as a guideline or minimum action plan for any authorized outside law enforcement agency or other authorized firing range user. Purpose The purpose of this plan is to provide expedient and necessary medical care for people who may become seriously ill or injured while participating in training exercises at the firing range. Communications The lead firearms instructor will have a portable radio and a cellular phone for their use anytime the range is being used. Secondary alternates should be identified for radio and cell phone communications. First Aid Supplies Basic First Aid Supplies and a blood pathogen kit are located with the designated area inside the Woodburn Conex storage container. Additional medical kit bag that includes an AED, torniquet, bandages and wound clotting kit and trauma care kit will be brought to any firing range training. Helicopter Signaling Devices Signaling devices (flares, overhead police lights) for identifying a landing zone for a medical helicopter could be utilized from an available marked police vehicle only after consultation and approval from Fire personnel. Helicopter Landing Zone The designated location for landing a medical helicopter will be determined by Fire personnel. Fire Extinguisher A fire extinguisher is located on the work area immediately to the left side of the interior of the main/large WPD Conex storage container.
